The extension and additional resources will ensure that NIAID can fully transition to a more secure and efficient cloud storage solution, thereby enhancing data accessibility and security for staff. Failure to approve this modification could result in incomplete data migration, potential data loss, and continued reliance on outdated storage technology, which may hinder NIAID’s operational efficiency and data security.
b. Project background.
Within the U.S. Department of Health and Human Services (HHS) National Institute of Health (NIH), the NIAID conducts and supports basic and applied research to better understand, treat, and ultimately prevent infectious, immunologic, and allergic diseases.
The Office of Cyber Infrastructure and Computational Biology (OCICB) manages technologies supporting NIAID biomedical research programs. Within OCICB, the Customer Services Branch (CSB) provides technical and tactical cyber technologies (CT) management and intramural support for biomedical research programs in NIAID.
CSB delivers CT infrastructure to facilitate electronic communication within NIAID through global scientific and clinical data exchange. CSB provides a framework for automated information sharing and collaboration.
In 2023, NIAID identified the need to migrate its data from older on-premises home-share storage technology to a more secure and efficient cloud storage solution, OneDrive. To facilitate this migration, NIAID sought a commercial-off-the-shelf (COTS) file migration tool and support services, including data discovery and optimization of redundant files. The acquisition included technical services to configure, assess and classify, transfer, and validate data to support NIAID’s adoption of OneDrive.
On September 21, 2023, NIAID awarded a Firm Fixed Price order to FedStore Corporation as a result of full and open competition through NASA SEWP (Solutions for Enterprise-Wide Procurement) in the amount of $752,873.27 to provide these data migration services. The total period of performance is from September 25, 2023, to September 24, 2024, under Contract/Order NNG15SD21B/75N93023F00413. The data migration tool provided by FedStore is DryvIQ Migrate, which is being used for this project. The infrastructure has been set up, and discovery scans are almost complete.
However, the data already evaluated is dynamic and ever-growing, possible rendering the information already collected as outdated unless the extension is granted to complete the full migration to OneDrive. The extension is crucial to ensure that all data is accurately migrated, thereby enhancing data accessibility and security for NIAID staff.

a. Acquisition Authority.
This acquisition is conducted under the authority of 41 United States Code (U.S.C.) § 4106(c), as implemented in the Federal Acquisition Regulation (FAR) 16.505(b)(2).
According to FAR 16.505(b)(2)(i)(C), an exception to the fair opportunity process can be used when the order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issues under the contract, provided that all awardees were given a fair opportunity to be considered for the original order.
5. Demonstration that the proposed contractor(s) unique qualifications or the nature of the acquisition requires use of the exception cited.
a. Name and address of the proposed contractor(s).
FedStore Corporation 1 Research Court, Suite 450 Rockville, MD 20850
b. Nature of the acquisition and proposed unique qualification of the contractor(s).
The ongoing OneDrive Data Migration project is critical for NIAID to transition from aging on-premises home-share storage to a more secure and efficient cloud storage solution. The project involves the migration of a significant volume of dynamic and unstructured data, initially estimated at 705TB but now determined to be closer to 1.1 Petabytes, with 940TB requiring migration.
The contractor, FedStore Corporation, was awarded the original contract through full and open competition and has been instrumental in setting up the necessary infrastructure and performing the initial data discovery and migration tasks. The unique qualifications of FedStore Corporation and their familiarity with the project are key reasons for this logical follow-on:
1. Expertise in DryvIQ Migrate Platform: FedStore Corporation has demonstrated expertise in configuring, deploying, and managing the DryvIQ Migrate platform, which is essential for the successful migration of NIAID's data to OneDrive. Their technical knowledge and experience with the platform have been critical in overcoming significant technical challenges.
2. Established Infrastructure and Progress: The contractor has already set up the infrastructure, including the necessary virtual machines and networking configurations, and has nearly completed the discovery scans. Switching contractors at this stage would result in significant delays and additional costs, as a new contractor would need to familiarize themselves with the existing setup and potentially replicate much of the work already completed.
3. Continuity and Efficiency: Given the dynamic nature of the data and the technical complexities involved, continuity is crucial. FedStore Corporation's ongoing involvement ensures that the project can proceed without interruption, leveraging their existing knowledge and progress to date. This continuity is in the interest of economy and efficiency, as it avoids the duplication of efforts and additional costs associated with onboarding a new contractor.
4. Timely Completion: The extension is necessary to accommodate the unforeseen technical issues and the increased volume of data to be migrated.
FedStore Corporation is uniquely positioned to complete the project within the extended timeframe, having already navigated the initial technical hurdles and established a working process.
In conclusion, FedStore Corporation's unique qualifications and current involvement in the project make them the logical choice for this follow-on modification. Their continued participation ensures the efficient and effective completion of the OneDrive Data Migration project.
6. Determination by the Contracting Officer that the anticipated cost/price to the Government will be fair and reasonable.
NASA SEWP has already determined the prices of supplies and fixed-price services, as well as the rates for services offered at hourly rates, are fair and reasonable under its IDIQ contracts.
Prior to the award of this contract modification, the Contracting Officer will conduct a final determination to ensure that the anticipated price to the Government remains fair and reasonable.
7. Any other facts supporting the use of other than full and open competition.
Proceeding with the modification is critical to avoid several negative consequences that would arise if the project is not completed as planned. First and foremost, NIAID would waste a significant portion of the $752,873.27 already spent on the OneDrive Data Migration project, along with the 11 months of effort already invested. This would result in a substantial loss of both financial and human resources, undermining the progress made thus far.
Additionally, the dynamic nature of the data means that without timely migration, the information already collected could become outdated and useless. This would negate the progress made in evaluating, validating, and cataloging the data, requiring additional resources to re-evaluate and re-validate the data.
Moreover, maintaining and upgrading the aging on-premises home-share storage will incur greater costs, especially as the current system is set to expire in 2025. If the data is not migrated by then, more funds will be required to upgrade the antiquated, more costly home-share storage. This would place an unnecessary financial burden on NIAID, diverting funds from other critical areas.
Furthermore, delaying the migration would continue to waste available resources and hinder collaboration among NIAID staff. OneDrive offers enhanced accessibility and functionality, allowing staff to access their files from multiple devices and platforms, co-author documents, sync files locally and in the cloud, and work offline. Without the migration, these benefits would not be realized, leading to continued inefficiencies and limiting the ability of NIAID staff to collaborate effectively.
Given these factors, it is clear that the current contractor, FedStore Corporation, is uniquely positioned to complete the project efficiently and effectively. Their familiarity with the project, established infrastructure, and technical expertise make them the logical choice for this follow-on modification. Switching contractors at this stage would result in significant delays, additional costs, and potential disruptions to the project.
In summary, proceeding with the modification is essential to avoid wasting significant resources, ensure the data remains current and useful, prevent increased costs associated with maintaining outdated storage technology, and enhance the efficiency and collaboration capabilities of NIAID staff. These factors strongly support the use of other than full and open competition for this modification.
8. Statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the exception to fair opportunity before any subsequent acquisition for the required supplies or services.
NIAID is committed to promoting competitive procedures whenever possible. To remove or overcome barriers to competition in future acquisitions, the following proactive measures will be implemented.
Frequent market research will be conducted to identify new companies and products that meet the Government’s requirements. This includes regularly reviewing vendor and trade publications and attending industry conferences and training sessions to stay updated on emerging technologies and solutions.
NIAID IT staff will regularly engage with IT manufacturers and vendors. Through meetings with industry representatives and participation in training sessions, NIAID will gain valuable insights into new and innovative solutions.
The agency will continually re-evaluate the IT currently in use, assessing the performance, cost-effectiveness, and technological advancements of various manufacturers and products to ensure the Government receives the best value for future acquisitions.
NIAID will also develop and implement strategies to address potential barriers to competition.
This includes identifying areas where proprietary solutions may limit competition and seeking alternative solutions that promote open standards and interoperability.
While the current situation necessitates the use of FedStore Corporation’s DryvIQ Migrate software and associated services to meet agency requirements, these actions will help ensure that future acquisitions are conducted in a more competitive environment. By taking these steps, NIAID aims to promote fairness and achieve the best value for the Government.
