About this file
This document is a Justification for Exception to Fair Opportunity (JEFO) for a sole source task order against the GSA 8(a) STARS III contract 47QTCB21D0333 awarded to Cherokee Nation System Solutions LLC. The U.S. Secret Service (USSS) Procurement Division is proposing the award on behalf of the Office of the Chief Financial Officer Risk Management (OCFO) and Risk Management & Assurance (RM&A) Division.
The requirement is for Quality Assurance contractor support to provide Information Technology General Controls (ITGC) testing, develop and execute software test plans, and provide expert advice and technical support to implement the USSS RM&A internal control program. The total estimated value is $6,942,573 over a base period and four option years. The JEFO cites the authority under FAR 16.505(b)(2)(i)(E) as the Small Business Act (15 U.S.C. 637(a)) which authorizes the 8(a) sole source award. The Contracting Officer has determined the pricing to be fair and reasonable based on the existing 8(a) STARS III contract rates.

4. Statutory exception and supporting rationale.
The applicable statutory FAR citation and basis for using an exception to fair opportunity process is:
☒ FAR 16.505(b)(2)(i)(E). A statute expressly authorizes or requires that the purchase be made from a specified source.

5. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.
Price are anticipated to be fair and reasonable based on the fact that this is an order against an existing GSA 8(a) STARS III contract where prices have been determined to be fair and reasonable. The government utilized the 8(a) STARS III pricing tool and requested rough order of magnitude from two sources to come up with the independent government cost estimate
(IGCE).
6. Any other facts supporting the justification.
None.
7. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the exception to fair opportunity before any subsequent acquisition for the supplies or services is made.
This is a requirement that is already in the 8(a) small business program. The USSS is required to keep this requirement in the 8(a) program unless the Small Business Administration authorizes a release.
