About this file
This is a Justification for an Exception to Fair Opportunity (JEFO) submitted by the Defense Health Agency Contracting Activity (DHACA) under Federal Acquisition Regulation 16.505(b)(2)(i)(B), with Control Number FY26-0482, dated October 2024.
DHACA is requesting approval to extend the current bridge task order with incumbent contractor Amyx, Inc. for Acquisition Support Services (AQSS) without competition. The extension covers a base period from February 15, 2026 through June 14, 2026, plus one option period from June 15, 2026 through October 14, 2026. The services include non-personal acquisition support for the Head of the Contracting Activity (HCA), Deputy Assistant Director for Acquisition (DAD-A), and DHACA functions encompassing Program Management Office, Career Management, Acquisition Process Improvement, Business Operations Division, Procurement Policy, Acquisition Systems, Government Purchase Card, Quality Management, and administrative support services. The estimated values for the base period and option period are redacted in the document.
The justification cites the exception basis that only one awardee is capable of providing the required services at the required quality level because the services are unique or highly specialized. The rationale explains that while the follow-on requirement, Contracting and Acquisition Support Services (CASS), was competed under solicitation HT001524R0010 with proposals received on September 19, 2024, the original May 2025 award date has been delayed due to source selection process delays caused by higher-than-anticipated proposal volume, Office of General Counsel personnel transitions, proposal review complexity, and impacts from the government shutdown. DHACA asserts that recompeting or bridging to another contractor would result in service break, loss of critical support, mission failure, and inefficiencies from a new contractor's learning curve. The document confirms this is not a new requirement and the prior action was not competed.

5. Rationale Supporting the Exception to Fair Opportunity:
The incumbent contractor, Amyx, Inc., is currently providing contracting support services to DHACA on current bridge contract HT005019F0002, while the follow-on requirement was competed and during the source selection process.
The follow-on requirement, Contracting and Acquisition Support Services (CASS), was solicited on SAM.gov under HT001524R0010 and proposals were received on 19 September 2024.
The anticipated award date was originally May 2025 but moved to due to unforeseen delays encountered during the source selection process. A confluence of factors contributed to this schedule adjustment, as described below.
Primarily, the number of proposals received was than anticipated, which required a more extensive evaluation by the source selection team. Additionally, the source selection timeline was impacted by personnel transitions within the Office of the General Counsel (OGC). Concurrently, reviews took an extended amount of time due to the of proposals, and the cascading impact. Finally, as a result of the Government shutdown, additional delays were created in the source selection process, further impacting the projected award date.
Recompeting the requirement or executing a bridge to any other source or allowing current services to expire would result in a substantial loss of the current functionality and sustainment of the DHACA. The cost and time it would take to bring on a new contractor for the limited time needed until award and start of performance for the new contract would lead to a break in service, loss of critical support, and mission failure for AD-Support, DHACA and its two major functions comprised of Component Acquisition Executive (CAE) and HCA.
A loss of efficiencies would also be a direct result of having a new contractor’s learning curve meet existing metrics.
6. Other Facts:
