About this file

This document summarizes a sole source justification for a federal contract award. The U.S. Army Contracting Command at Rock Island Arsenal issued a task order to KBR Services under the LOGCAP V contract vehicle to provide dining facility services at Fort Knox, Kentucky from July through August 2023. The services were required to feed cadets during the Cadet Summer Training program. The estimated value of the task order is $4 million. A sole source award to KBR was justified due to the urgent need to have dining services begin by July 8th, insufficient time to compete the requirement among multiple LOGCAP V contractors, and because KBR was uniquely prepared as the regional LOGCAP V contractor in the area to quickly provide the services.

questions regarding the requirement on 05 July 2023, and KBR sent ACC-RI a Rough Order of Magnitude on 07 July 2023. The TO was fully executed by ACC-RI as a UCA on 11 July 2023.

Obtaining services through the LOGCAP contract was the only feasible alternative for the urgent requirement. On 30 June 2023, Cadets were given Meals Ready to Eat (MRE) for breakfast, lunch and dinner. MREs were not a viable option for the remainder of CST since the approved and issued operations order required all Cadets and support personnel to be fed only one MRE per day and two Unitized Group Ration, A for lunch and dinner. The military occupational specialty 92G Army cooks took over three DFACs on 01 July 2023 and ran the facilities until LOGCAP took over on 08 July 2023. The 92G Army cooks were part of the support units assigned to feed Cadets in the field. The 92Gs were not able to conduct both missions as removing the 92G Army cooks from field feeding would have detrimental effects on the CST Cadre schedule for assessing and providing world class training for future Army Officers. Once LOGCAP took over the DFACs, the 92G Army cooks returned to the field to continue field feeding and get the CST schedule back on track.

There was insufficient time to compete the requirement among the four LOGCAP V multiple-award IDIQ contract holders. Up to procurement administrative lead-time is necessary to ensure adequate time for ACC-RI to award a new task order using fair opportunity procedures for a requirement valued at . For example, a minimum of is required to provide adequate time to request and receive proposals from the four LOGCAP V contract holders. FKKY CST DFAC requirements were redefined on 01 July 2023 to only feed Cadets at five DFACs with a Full Operational Control (FOC) date of 08 July 2023. The award for this requirement needed to be issued immediately, to provide adequate time for the contractor to begin mobilization efforts to meet the required Government’s requested FOC date.

The competitively awarded LOGCAP V contract vehicle resulted in the establishment of four multiple-award IDIQ contracts on 12 April 2019. ACC-RI awarded KBR the NORTHCOM Task Order for ‘Setting the Theater’ activities, which includes crisis action planning and emerging requirements. KBR was the only contractor to receive a LOGCAP V Task Order in the NORTHCOM region. LOGCAP V is designed so that the Regional LOGCAP Contractor conducts pre-activation planning, which would include efforts prior to LOGCAP being authorized to perform services, to shorten response time and establish the conditions for successful execution of future operations. Pre-activation planning includes developing an in-depth knowledge of the area of operations, a robust vendor base with possible sub-contractors, and an in depth understanding of the geo-political environment to function in a multitude of possible scenarios. As already stated herein, the LOGCAP V Acquisition Plan states that all requirements approved under a JEFO are to be sourced to the regionally aligned contractor and incorporated without further competition.

If this JEFO is not approved, attempting to replicate the contracted LOGCAP services would be extremely difficult, if not impossible, in the short term and food services for the

Cadets at FKKY would cease. The U.S. military does not have the organic capability to self-perform these functions without detriment to other ongoing missions. Existing contracts in the area of operations do not have the similar scope, ceiling, capability, and responsiveness to replace LOGCAP in its entirety, and the time required to solicit and award an equivalent stand-alone contract would take .

6. Market Research: ACC-RI and the LOGCAP Program Management Office performed market research in June 2023 by contacting knowledgeable individuals within Government regarding market capabilities to meet requirements. This included confirming the existing DFAC contractor at Fort Knox no longer had the capability to maintain enough staffing to support the DFACs for CST 2023. Market research revealed that because LOGCAP V required all offerors to demonstrate a global capability, the other LOGCAP V contractors can provide these services. However, market research also confirmed, that as outlined in paragraph 5, LOGCAP V was designed so that the contractor awarded the ‘Setting the Theater Task Order’ is uniquely situated to perform on this requirement to support continental U.S. (CONUS) based Army Command conducting operations in CONUS. In this case, KBR in NORTHCOM was awarded the ‘Setting the Theater Task Order.’ Additionally, awarding the requirement to other LOGCAP V contractors would require a task order level competition for which there was no time.

7. Actions to Increase Competition: ACC-RI will compete the follow-on contract to the maximum extent possible, within the confines of the law.
