Department of the Army Class Justification for Exception to Fair Opportunity Under Multiple Award Indefinite Delivery Contracts
1. Contracting Activity: U.S. Army Contracting Command – Rock Island (ACC-RI), Rock Island Arsenal, Rock Island, IL 61299-8000.
2. Description of Action: U.S. Forces-Afghanistan (USFOR-A) requests four firm-fixed-price modifications, two with Aegis Defense Services, LLC (hereafter referred to as Aegis) and two with Triple Canopy, Inc. ACC-RI will execute this action against contract W52P1J-19-D-0001 with Aegis and W52P1J-19-D-0005 with Triple Canopy under the Security Support Services - Global (SSS-G) multiple-award Indefinite Delivery, Indefinite Quantity (IDIQ) contract. ACC-RI projects award for
Operations and Maintenance, Army funds. The Senior Contracting Official approved the Acquisition Plan for SSS-G on July 13, 2017, in accordance with (IAW) Defense Federal Acquisition Regulation Supplement 207.103(d)(i)(B) and Army Federal Acquisition Regulation Supplement 5107.103-90.
ACC-RI competitively awarded SSS-G in November 2018 to five contractors:
Aegis W52P1J-19-D-0001 Janus W52P1J-19-D-0002 Reed W52P1J-19-D-0003
SOC W52P1J-19-D-0004
Triple Canopy W52P1J-19-D-0005
By August 2019, ACC-RI had still not received requirements packages suitable for competition under the new contracts; therefore, 10 extension task orders, six to Triple Canopy and four to Aegis, were approved under Justification for Exception to Fair Opportunity (JEFO) 19-091. The extensions included Aegis’ task orders W52P1J-20-F- 0075 for North Atlantic Treaty Organization Special Operations Component Command – Afghanistan (NSOCC-A) and W52P1J-20-F-0094 at Camp Pittman under SSS contract W52P1J-19-D-0001 and Triple Canopy’s task orders W52P1J-20-F-0093 for Shindand (now known as Camp Duskin and Camp Bishop) and W52P1J-20-F-0092 for Joint Task Force (JTF) under SSS contract W52P1J-19-D-0005. The task orders were to serve as bridge actions to continue security services while the Government resolved the outstanding issues with regard to validation of the requirements packages, and began conducting competitions for the new requirements. Task orders W52P1J-20-F-0075 and W52P1J-20-F-0093 are being combined and competed as a single requirement called Special Operations Joint Task Force – Afghanistan (SOFJT-A), and Task orders W52P1J-20-F-0094 and W52P1J-20-F-0092 are being combined and competed as a single requirement with the name remaining JTF.
The follow-on requirement for SOJTF-A was solicited on October 10, 2019, and JTF on December 13, 2019 to all five SSS-G contractors with award anticipated on November

22, 2019 for SOJTF-A and January 15, 2020 for JTF; however, ACC-RI encountered delays in the evaluation process, thus requiring additional time until award. The current NSOCC-A and Duskin/Bishop task orders , and current JTF and Pittman task orders . Modifications to extend the existing task orders to Aegis and Triple Canopy under SSS-G will serve as further bridges to continue security services until ACC-RI completes the follow-on award and transition.
3. Description of Supplies/Services: SSS-G provides security support services within the borders of Afghanistan, Kuwait, and Africa. Performance of these services occur in an austere environment that requires 24/7/365 days of coverage. The contractor will provide all labor, equipment, weapons and ammunition as defined in the SSS-G Performance Work Statement (PWS) for NSOCC-A, Camp Duskin and Camp Bishop, JTF, and Camp Pittman in order to provide continuous, responsive, and uninterrupted security services with highly skilled personnel that have a background in security to support the mission. Specific security support services the vendor provides include armed security guards for vehicle entry control points, personnel entry control points, roving patrols and guard towers. The vendors also provide guard shift supervisors and guard site supervisors for accurate reporting and communication with both USFOR-A and ACC-RI points of contact. The requested extension is broken out below:
The estimated value of was developed by ACC-RI based on historical prices and current ceiling rates. ACC-RI is including an on all locations in case of protest.
4. Authority Cited: Federal Acquisition Regulation (FAR) 16.505(b)(2)(i)(B). Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized.
5. Reason for Authority Cited: ACC-RI began its SOJTF-A competition in October 2019 with the original solicitation being sent out on October 10, 2019, to all five SSS-G contractors with four of the five contractors submitting proposals. Four amendments were issued on the SOJTF-A solicitation through November 21, 2019, and final proposals were received November 22, 2019. Out of the four proposals received by

ACC-RI, only one was deemed to be technically acceptable. ACC-RI opened discussions and received updated technical proposals from the three deemed technically unacceptable. Upon a technical evaluation of the updated technical proposals, it was determined all were still unacceptable. ACC-RI was supposed to award the task order on December 6, 2019, to allow the time required for mobilization; therefore, the need for an extension of current services is required to complete meaningful discussions in order to make the offers more competitive.
ACC-RI began its JTF competition in December 2019 with the original solicitation being sent out on December 13, 2019, to all five SSS-G contractors with all submitting proposals. Seven amendments were issued on the JTF solicitation through December 27, 2019, and final proposals were received January 6, 2020. Of the five proposals received, one was determined a no-go on the past performance section of the competition (but was still sent for a technical evaluation) and three proposals, including the one determined no-go on past performance, were determined technically unacceptable.
ACC-RI was supposed to award the JTF task order on January 15, 2020, to allow time for mobilization; therefore, Only Aegis is capable of providing the highly specialized security services at NSOCC-A and Pittman in the interim. Additionally, only Triple Canopy is capable of providing the

Aegis and Triple Canopy already have a presence established at their respective locations, and have achieved mobilization, biometrics, and the required arming authorities for these task orders. Only Aegis and Triple Canopy employees have command access cards in place and base line security screenings completed.
6. Market Research: ACC-RI received competition for these services under SSS-G, indicating the other contract holders are interested in providing the services. However, for reasons described in paragraph 5, only Aegis and Triple Canopy can provide the services until ACC-RI completes the award.
7. Actions to Increase Competition: The subsequent milestones below reflect the actions taken in order to increase competition on the follow-on task order for security services in SOJTF-A:
