About this file

This document is a Justification for Exception to Fair Opportunity (JEFO) for a task order to be awarded to Peraton, Inc. by the Washington Headquarters Services Acquisition Directorate for the Office of the Under Secretary of Defense (Comptroller). The task order will procure Global Exchange (GEX) Mapping and Interface Support Services, with a base period of 12 months and two 12-month option periods, funded by FY22 O&M funds. The total contract is anticipated to be a firm-fixed price task order with Time and Materials travel CLINs, covering the period from September 27, 2022, to September 26, 2025.

The justification explains that Peraton is the sole provider of GEX support services, having been novated by Northrop Grumman and selected by DLA to provide GEX integration, testing, and support for the Department of Defense. The task order is being issued on a sole-source basis under the J6 Enterprise Technology Services (JETS) multiple-award IDIQ contract. The government determined that using a different vendor would disrupt financial transactions, potentially causing mission failure, and that Peraton is uniquely capable of handling the GEX sustainment and mapping tasks. The Contracting Officer has conducted market research and determined no small businesses are capable of performing these services, and the price is expected to be fair and reasonable.

JUSTIFICATION FOR EXCEPTION TO FAIR OPPORTUNITY (JEFO)

UNDER FEDERAL ACQUISITION REGULATION SUBPART 16.5

1. AGENCY AND CONTRACTING ACTIVITY:

Agency: Office of the Under Secretary of Defense (Comptroller)

(OUSD(C))

Contracting Activity: Washington Headquarters Services (WHS) Acquisition Directorate (AD)

2. DESCRIPTION OF ACTION:

This Justification for Exception to Fair Opportunity approval supports issuing a new firm-fixed price Task Order (TO) with T&M Travel CLINs to Peraton, Inc. for the procurement of OUSD(C) Global Exchange (GEX) Mapping and Interface Support Services. The Washington Headquarters Services Acquisition Directorate (WHS/AD) will execute this Task Order as a follow-on to the Defense Logistics Agency’s (DLA) GEX Task Order SP4709-17-D-0022 / SP4709-21-F-0007, which is a task order that effectively operates as a single-award IDIQ under the DLA J6 Enterprise Technology Services (JETS) Multiple-Award Indefinite Delivery Indefinite Quantity (IDIQ) contract SP4709-17- D-0001 – SP4709-17-D-0143. It is anticipated that this task order will be funded with FY22 O&M funds with a base period of twelve (12) months and two twelve (12) month option periods.

3. DESCRIPTION OF SUPPLIES/SERVICES:

This requirement is in support of the Office of the Under Secretary of Defense (Comptroller) (OUSD(C)). This task order is for Peraton, Inc. to define, develop, and maintain GEX interfaces and maps that will allow for

GEX support services were previously provided on contract with Peraton, Inc. under DLA Contract# SP4709-17-D-0022, Task Order HQ0034-21-F-0564.

OUSD(C) has a requirement to accordance with FAR 15.404-1 Proposal Analysis Techniques to ensure the award will be at a fair and reasonable price. The quote will be analyzed in accordance with FAR 15.404-1(b).

It is anticipated that the Government will use IAW FAR 15.404-1(b) Proposal analysis techniques to include (1) Comparison of proposed prices to historical prices paid; and (2) Comparison of proposed prices with independent Government cost estimates.

6. ANY OTHER FACTS SUPPORTING THE JUSTIFICATION:

N/A

7. ACTIONS TO REMOVE OR OVERCOME ANY BARRIERS THAT LEAD TO THE

EXCEPTION TO FAIR OPPORTUNITY BEFORE ANY SUBSEQUENT ACQUISITION

FOR THE SUPPLIES OR SERVICES IS MADE:

Administered by DLA, the GEX Task Order was awarded under a master IDIQ entitled J6 Enterprise Technology Services (JETS), a multiple award IDIQ. The GEX Task order operates as a single award IDIQ held by Peraton, Inc. Though the task order acts as a single award IDIQ, DLA requests that users of the task order write a JEFO for their contract file, hence the reason that this document was prepared.

The Contracting Officer and Contracting Specialist conducted market research prior to this JEFO to determine whether any small businesses might be capable of doing this work but came to the conclusion that there were not such small businesses. WHS/AD, however, continues to conduct market research on an ongoing basis to identify any small businesses that may be capable of performing GEX support service in the future.
