Any offeror that fails to provide proper documentation of their ability to meet the below standards will receive an unacceptable rating for Technical Acceptability and will not be considered for the award.

The Staffing Plan will be evaluated on the Offeror’s capability to meet the Government’s requirement for individual(s) with experience qualification levels as follows:

a. Superintendent

The project superintendent shall have a minimum of 5-year of successful experience in construction with at least 3 of those years as a superintendent on projects similar in size and complexity, as identified in SOW Section 01 30 00 Administrative Requirements, paragraphs 1.6.1, 1.6.2, and 1.6.3.

b. OR- (II) five (5) years of continuous general industry safety experience in supervising/managing general industry (managing safety programs or processes or conducting hazard analyses and developing controls),-OR- (III) If the SSHO has a Third-Party, Nationally Accredited (ANSI or National Commission for Certifying Agencies - NCCA) SOH-related certification, only 4 years of experience is needed, as required in SOW Section 01 35 26 Government Safety Requirements, paragraph 1.6.1.1.

Volume 2. Past Performance Offerors must show past performance information, to include no more than three (3) recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information). The offeror shall include documentation regarding their relevant past performance as it directly relates to the work being procured under this solicitation.

The offeror SHALL NOT go back any farther than 3 years for the submitted data. The past performance data shall document a successful history of past contract performance.

In conducting the Past Performance evaluation, the Government reserves the right to use both the information provided in the offeror’s Past Performance and information obtained from other sources, such as the Past Performance Information Retrieval System (PPIRS) or similar systems, Defense Contract Management Agency (DCMA) and commercial sources. Offerors are reminded that both independent data and data provided by offerors in their proposals may be used by the Government to evaluate offeror past performance. However, the burden of providing thorough, complete, and current past performance information as requested in this paragraph remains with the offerors. Proposals that do not contain the information requested by this paragraph risk rejection or a less than acceptable performance rating by the Government. All past performance comments received will be taken into account and could affect the overall rating. The overall past performance evaluation is a subjective decision based on the whole of all data received. In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”

Submission Requirements. The offeror shall submit a Past Performance Volume containing the following:

The submittal shall include rationale supporting your assertion of relevance and how it was determined that the work performed previously was the same or similar in nature, size, and complexity to the work specified by this solicitation. Offerors are required to explain what aspects of the contracts are deemed relevant to the proposed effort, and to what aspects of the proposed effort they relate.

The offeror shall include a breakout of the proposed labor categories with fully loaded hourly labor rates, G&A, overhead, profit, and total estimated material and other costs.” The Offeror shall provide fully burdened labor rates for all personnel for the base year and all option years as well as projected costs for the supplies, equipment and material in accordance with the historical estimates provide in the PWS (Technical Exhibits 3). BASIS FOR AWARD

1.0 BASIS FOR AWARD

A Lowest Price Technically Acceptable (LPTA) approach will be used; the evaluation criteria are described herein. The policies and procedures under the Federal Acquisition Regulation (FAR) Part 12, Acquisition of Commercial Items, in conjunction with FAR Part 15, Contracting By Negotiation and FAR Part 19, Small Business Program, will be utilized for this procurement. The Government will award a contract resulting from this solicitation to a responsible Contractor whose proposal conforms to the solicitation and will be most advantageous to the Government.

The award will be made to the lowest priced technically acceptable proposal. Proposals will be evaluated for technical acceptability but will not be ranked using the non-price Factor and SubFactors. For an Offeror to be considered for award, the proposal must receive an “Acceptable” rating in every non-price Sub-Factor. A proposal receiving a rating of “Unacceptable” in any non-price Sub-Factor will receive an “Unacceptable” rating on Technical Capability (Non-Price) and not be eligible for award.

A basis for trade-offs between cost/price and non-cost/price factors are not permitted.

Award will be made to the responsible offeror whose proposal is deemed technically acceptable (technical capability) and offers the lowest price.

The Government will evaluate the offeror’s technical proposal to determine whether it satisfies the minimum for successful contract performance. In order to be considered for award, offerors proposal must receive “acceptable” rating in every non priced factor and subfactor.

The Government intends to evaluate proposals and award one (1) contract without discussions with offerors. Therefore, the offeror’s initial proposal shall contain its best pdp13920.docx Painting IDIQ Section 01 11 00 Page terms from a technical and price standpoint. However, in accordance with (IAW) FAR Part 15.306, shall discussions become necessary, the Government reserves the right to hold them. If this occurs, a competitive range will be determined and offerors notified.

The competitive range may be limited for purposes of efficiency IAW FAR Part 15.306 (c)(2).

The Contracting Officer will make a determination of responsibility in accordance with the standards of FAR 9.104. In order to be determined responsible, a prospective contractor must meet all standards of FAR 9.104-1.

Army Contract Writing System (ACWS) Transition Information for Offeror

Include the language below in:

· Solicitations originating in PADDS/PD2

· Location: Section L or 52.232-5 Addendum

Army Contract Writing System (ACWS) Transition Information for Offerors

a. The Department of the Army is in the process of deploying a new contract writing software application to Army contracting offices worldwide. Known as the Army Contract Writing System (ACWS), this modern software application will replace legacy Army contract writing systems.

b. During this transition period, Offerors are hereby advised:

1. The Contracting Office may use any combination of contract writing systems to create and release documents related to this solicitation (i.e., solicitation amendments and awards, if any). As a result:

i. Solicitation may contain different offer submission instructions than other solicitations released by the same Contracting Office (i.e., requiring offer submission via the Procurement Integrated Enterprise Environment (PIEE) Solicitation Module versus e-mail). Offerors should review all offer submission instructions contained in the solicitation documents and direct any questions or concerns to the designated point of contact contained in the solicitation.

ii. If ACWS is deployed prior to contract award, documents received from the Contracting Officer or view on the System for Award Management (SAM.gov) or other forums may appear noticeably different than the initial solicitation or previous solicitations or awards from the same Contracting Office. This is normal and expected.

iii. A change between contract writing systems may cause important information concerning solicitation response (amendments) or accepted terms (awards) to take on different formatting or appear in different parts of later documents issued. Offerors shall review all documents carefully to locate this important information and direct any questions or concerns to the designated point of contact contained in the solicitation.

2. The Government does not intend to use the transition between contract writing systems to effect any changes to solicitation or award terms and conditions without accompanying document narratives explicitly stating such changes are deliberate and desired.
