Authority: 10 U.S.C. 3204(a)(1) as implemented in Federal Acquisition Regulation 6.302-1(b)(3), "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements." Also, note that 42 U.S.C. Section 6961 applies federal, state, and local law to federal facilities.

3) Individual Hauler Accounts: Each organization or building creating their own account with an authorized hauler is not cost efficient. There is only one authorized franchise that can service JBLM area of operations. Each unit/building will have to set up their own account with the same authorized hauler, which in this case instead of using JBLM tonnage rates, will use Pierce County rates. Pierce County rate per ton is $359.27 with an annual estimate of Using JBLM tonnage rate is with an annual estimate of Pierce County rates will apply whether a building is in use or not; JBLM rates are billed based on what is actually used. Having a unit/building have their own contract with the same franchise will increase the cost and decrease the response time in requesting service changes.
13. Fair and Reasonable Cost Determination: I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable. The techniques identified at (FAR 15.404-1(c)(2)(iii), FAR 15.404-1(b)(2)(ii), FAR 15.404-1(b) (2)(iii), and FAR 15.404-1(b)(2)(v)) will be used to ensure award at fair and reasonable prices. The Contracting Officer used a comparison of industry costs for similar work. The use of previous contract prices and costs already determined fair and reasonable, which are regulated by Washington State law under Tariff No. 9, will support the analysis. The Independent Government Cost Estimate (IGCE) will primarily be an analysis of the contractor's proposed cost. Additionally, the techniques identified at (e.g. FAR 15.404-1(c)(2)(iii)) Proposal analysis techniques will be used to further ensure award will be at fair and reasonable prices. In addition, the services being procured are under a regulated industry. After award, the contract must be filed with the WUTC. The WUTC monitors the prices received from Harold Lemay Enterprises, Inc.

Based on the foregoing justification, I hereby approve the procurement of Joint Base Lewis-McChord (JBLM) Municipal Solid Waste Disposal (Refuse Services) on an other than full and open competition basis pursuant to the authority of 10 U.S.C. 3204(a)(1) as implemented in Federal Acquisition Regulation 6.302-1(b)(3), “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.” The estimated value of the contract is for up to a five year period of performance consisting of a base year and four option years, from approximately 01 November 2022 through approximately 31 October 2027. The approval is subject to availability of funds, and provided that the services and property herein described have otherwise been authorized for acquisition.
