PERFORMANCE WORK STATEMENT (PWS)
NON-PERSONAL SERVICES CONTRACT
MUSICIAN SERVICES
CATHOLIC SERVICES
JBLM RELIGIOUS SUPPORT OFFICE
1.0 OVERIEW.
1.1 The Government requires Musician Services (Pianist/Keyboardist/Organist) in support of military religious and worship activities. The Contractor shall provide support to the MAIN POST CATHOLIC WORSHIP SERVICE Religious Support Office (RSO), Chaplains, and Religious Affairs Specialists for Department of the Army (DA).The location(s) and time(s) specified in the PWS or modified in the contract by the Contracting Officer.
1.2 The contractor shall facilitate the communal, public worship life enhancing full and active participation of the assembly/congregation through provision of musical environment for Catholic worship services, in collaboration with Military Chaplain, Chaplain Staff, Religious Affairs Specialists, and Civilian workforce.
1.3 Chapel Worship Services provide and ensure the free exercise of religion for Soldiers, their family members, Department of Defense civilians, and other authorized personnel in the military community. Music is a crucial part of worship elements and plays an important role in enhancing the worship experience of participants.
2.0 SCOPE OF WORK:
2.1 This is a Non-Personal Services Contract between the JBLM Religious Support Office (RSO) and the contractor to perform tasks in order to provide deliverables identified herein. This PWS defines the requirements/deliverables of the contractor; ensuring the individual Free Exercise of Religion for military personnel, family members, and authorized personnel; a statutory requirement under USC Title X.
2.2 This contract does not create an employer-employee relationship between the Government and Contractor, as well as any corporation, partnership, business association, other party or legal entity with which the Contractor may be associated. The Government assumes no responsibility for costs incurred for services performed by the contractor that are not included in this contract. There are no provisions for lodging, employee benefits, medical care, retirement or Workmen's Compensation Insurance. Payment will be made monthly on a per service basis.
2.3 The Contractor shall provide support for those services for which no Unit Ministry Team (UMT) members (Chaplains and Religious Affairs Specialists), RSO Department of the Army (DA) Civilians and volunteers can provide. The contract cannot duplicate duties required or provided by these entities as contracted services are an exception to policy.
2.4 This contract is not a fulltime position with a standard 9:00 AM to 5:00 PM, Monday through Friday-type work environment. Workdays and hours may vary according to the approved Calendar of Events, tasks outlined in the CLINs and the time of meetings. Many of the tasks will require holiday, evening, and weekend hours.
2.5 No UMT member, military member, DA Civilian, fellow contractor or volunteer can supervise or direct the Contractor or control the method by which he/she performs the required tasks. Under no circumstances shall a work schedule be prepared for the Contractor or the impression be given that the Contractor is an employee of the Government. It is the responsibility of the Contractor to guard against any actions that are of the nature of personal services, give the impression of personal services or portray his/her position as that of an employee.
2.6 Under no circumstances shall a Contractor provide direction to a Religious Affairs Specialist (RAS), general military member, a DA Civilian, fellow contractor or volunteer, nor shall he/she represent in an official capacity of the Federal Government, U.S. Army or the local congregation that the contract supports.
3.0 PERIOD OF PERFORMANCE. The Government contemplates a four-year contract consisting of a 12 month base plus three 12-month optional periods of performance.
3.1 Base Year: date of award plus 12 months
3.2 Option Year I: end of base plus 12 months
3.3 Option Year II: end of previous option plus 12 months
3.4 Option Year III: end of previous option plus 12 months
4.0 PLACE OF PERFORMANCE AND SCHEDULE OF SERVICES.
4.1 For Catholic Services, the Place of Performance is at Government facility, JBLM.
4.1.1 Main Post Chapel- BLDG 2001 South Liggett and Ninth Div Drive
4.1.2 McChord Chapel- BLDG 746 Col Joe Jackson Blvd.
4.1.3 Other RSO office or event locations located on JBLM in accordance with published religious worship, observance schedules and Memorial Ceremonies/Services.
4.2 For Catholic Service Rehearsals, the Place of Performance is at Government facility, JBLM.
4.2.1 Main Post Chapel- BLDG 2001 South Liggett and Ninth Div Drive
4.2.2 McChord Chapel- BLDG 746 Col Joe Jackson Blvd.
4.2.3 Other RSO office or event locations located on JBLM in accordance with published religious worship, observance schedules and Memorial Ceremonies/Services.
5.0 REQUIREMENTS (TASKS).
5.1 General. (The following tasks are to be applied to sections 5.2, 5.3 and 5.4)
5.1.1 Contractor shall attend planning and coordination meetings and provide necessary musical input for services.
5.1.2 Contractor personnel shall regard personal information on all applicants, volunteers, and participants as confidential. Contractor shall comply with all privacy and confidentiality laws and regulations. As required by public laws and military regulations, the Contractor shall divulge information of illegal activities to the proper authorities.
5.1.3 The Contractor personnel shall present a neat, well-groomed appearance appropriate for religious worship services and other activities identified in this PWS while performing under this contract.
5.1.4 Contractor personnel shall behave in a professional manner befitting US military religious support activities. Contractor personnel shall demonstrate dignity and respect, keeping in harmony with the values and norms of the Army Chaplain Corps. Contractor personnel shall refrain from using offensive language such as swearing, cursing, disparaging language, and other such communications.
5.1.5 Rehearsals shall take place either Saturday between 1500-1800 or at least one hour before the service.
5.1.6 The contractor will provide musical services for the 0900 & 1200 at MPC and 2- 4 times a month at the 1030 McChord Chapel.
5.2 Pianist/Organ/Keyboard Musician Services.
5.2.1 Contractor shall provide Piano, Keyboard, Organ Catholic Music Support
Service to include preludes, postludes, offertory, accompanying singing of hymns/choruses/spiritual songs and the choir, background music for meditation, prayers, and communion.
5.2.2 Contractor shall perform Catholic style music.
5.2.3 Contractor shall perform in accordance with the following schedule:

5.2.3.1 Weekly. To be coordinated with the Staff Chaplain. Not to exceed 1 hour per rehearsal. Maximum 124 services.
5.2.3.2 The Contractor shall arrive 30 minutes prior to the scheduled service and remain 5 minutes following the benediction.
5.3 Contractor Pianist/Organist/Keyboardist shall participate in rehearsal services.
5.3.1 Contractor shall provide rehearsal using Piano, Keyboard, Organ Catholic Music
Support Service to include preludes, postludes, offertory, accompanying singing of hymns/choruses/spiritual songs and the choir, background music for meditation, prayers, and communion.
5.3.2 Contractor shall perform rehearsal using Catholic style music.
5.3.3 Contractor shall perform in accordance with the following schedule:

5.3.3.2 Special Services rehearsals, to be coordinated with Staff Chaplain. Not to exceed 1 hour each. Maximum 2 rehearsals.
5.3.3.3 The Contractor shall arrive 30 minutes prior to the rehearsal.
5.3.3.4 Rehearsal locations shall be in accordance with paragraph 4.0 above.
5.3.4 The Contractor shall perform at all rehearsals and miss no more than 2 per year.
5.4 Music Support for Memorials.
5.4.1 Memorial ceremonies and services are determined by, and coordinated with, the
Chapel Pastor. The Contractor shall provide worship support to include the prelude and postlude music for the ceremony as well as accompaniment of any musical pieces required as part of the program.
5.4.2 Standard: The contractor will be prepared to support a memorial ceremony on short notice if necessary as commanders determine the timing based upon operational tempo and unit needs. The contractor will need to rehearse on the day prior and the ceremony not to exceed 30 minutes.
5.4.3 Contractor shall perform in accordance with the following schedule:

5.4.3.1 The Contractor shall arrive 30 minutes prior to the rehearsal.
5.4.3.2 Rehearsal locations shall be in accordance with paragraph 4.0 above.
5.4.4 The Contractor shall perform at all scheduled services and miss no more than 2 per year.
6.0 CONTRACTOR QUALIFICATIONS. The Contractor shall provide a resume and documentation to substantiate personal qualifications. Although a specific degree is not mandatory, any credentials pertaining to this position, training and experience is considered in the award.
6.1 Musician:
6.1.1 Musicians shall be musically proficient on their specific instrument, proficient in reading music, and possess experience performing in religious worship settings.
6.1.2 Musicians shall possess sufficient experience playing their specific musical instruments appropriate at public worship services. Generally the Government requires a minimum of two years of experience. This requirement is waiverable by the COR upon senior installation Chaplain’s review and approval of key personnel resumes of primary or replacement contractor personnel. Any request for waiver must address how proposed contractor employee’s knowledge, skills, education, or training prepared the employee to perform the tasks satisfactorily absent two years of relevant experience.
6.1.3 Contractor shall provide a resume which identifies contractor personnel’s professional and spiritual understanding of church music, determined by a history of working specifically in development of musical worship plans.
6.1.4 Contractor shall provide audition video of vocalists or vocal soloists or contractor shall make vocalists or vocal soloists available for audition prior to performance under this contract.
6.2 Background Checks and Investigations: Contract personnel shall submit to and pass a thorough Criminal History Background Check per Public Law 101-647, Section 231, Crime Control Act of 1990; DoD 1402.5, Criminal History background Checks on Individuals in Child Care Services, AFI 31-501 Background Checks/Investigations and 36 WG/HC OI 31-3, Background Investigation. The background check will be coordinated by the Chaplain Division and includes an Installation Records Check and a Child Care National Agency Check and Inquires.
6.3 Competency of Contractor Personnel. All services under this contract are to be performed by an adult. Applicants must be willing to undergo a background check. The Contractor shall be fully qualified to perform the required services without any supervision or direction by Government Personnel.
7.0 GOVERNMENT FURNISHED INSTRUMENTS/EQUIPMENT.
7.1 Performance is at a Government Facility. Therefore, FAR Part 45.000(b)(5) applies.
Specifically, Government property that is incidental to the place of performance, when the contract requires contractor personnel to be located on a Government site or installation, and when the property used by the contractor within the location remains accountable to the Government. Items considered to be incidental to the place of performance include, for example, include office space, desks, chairs, telephones, computers, and fax machines. The Government will provide musical instruments although not specifically meeting the definition of GFP/GFE under the above cited FAR reference.
7.2 The Government will provide Contractor access to chapel or other congregational spaces in order to perform the requirements.
8.0 SECURITY REQUIREMENT. The Contractor shall comply with all security requirements to access the installation.
8.1 AT Level I Training. All Contractors, including subcontractors, requiring access to Army installations, facilities, and controlled-access areas will complete AT Level I awareness training within 45 calendar days after the contract start-date or effective date of incorporation of this requirement into the contract, whichever is applicable. The Contractor will submit certificates of completion for each affected contractors and subcontractors employee to the COR or to the KO, within 7 calendar days after training is completed. 8.2 Access and General Protection/Security Policy and Procedures. The Contractor and all associated subcontractors will comply with applicable installation, facility, and area commander installation/facility access and local security policy and procedures (provided by Government representative). The Contractor will also provide all information required for background checks to meet installation-access requirements to be accomplished by the installation provost marshal office, director of emergency services, or security office. The Contractor must comply with all personal identity verification requirements as directed by DOD, HQDA, and local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the force protection condition (FPCON) at any individual facility or installation change, the Government may require changes in Contractor security matters or processes.
8.3 iWATCH Training. The Contractor and all associated sub-contractors shall brief all employees on the local iWATCH program (training standards provided by the requiring activity ATO). This locally developed training will be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the COR. This training shall be completed within 30 calendar days of contract award and within 05 calendar days of new employees commencing performance with the results reported to the COR NLT 30 calendar days after contract award.
8.4 OPSEC Training. New employees must be trained within 30 calendar days of their reporting for duty and annually thereafter. OPSEC Awareness for Military Members, DoD Employees and Contractors is available at the following website:

9.0 BACKGROUND CHECK REQUIREMENTS.
9.1 The Contractor will not have reoccurring contact with children and therefore will not need a
Background Check in accordance with AD 2014-23.
9.2 Anyone (contractor or sub-contractor) working under this contract who has contact with children under 18 years of age shall be screened with the appropriate background checks as governed by the Army Directive 2014-23 "Conduct of Screening and Background Checks For Individuals Who Have Regular Contact With Children in Army Programs", dated 10 September 2014. A copy of the Army Directive can be found at http://www.apd.army.mil/pdffiles/ad2014_23.pdf. The background check requirements for Contractors can be found in Enclosure 3 - Screening and background checks for appropriated and non-appropriated fund personnel, military personnel, foreign national employees overseas, and contractors.
9.3 Background checks will be initiated and paid for by the Government. The cost for the pre-employment screening is the responsibility of the Contractor. The Commander Designated Entity (COE) at the Installation supports IMCOM by coordinating, submitting https://jko.jten.mil/courses/atl1/launch.html https://securityawareness.usalearning.gov/opsec/index.htm and tracking child related background checks. They also review and compile the results to identify whether they contain derogatory information to be passed on for a suitability determination. The COE will advise and assist CONTRACTOR and sub- CONTRACTOR employees completing all required documents required for the background check process.
COE contact information will be provided upon contract award.
9.4 The following is a list of the required screenings per the Army Directive 2014-23.
9.4.1 REGULAR/RECURRING contact with children: Definition: Contact with children more than an average of one (1) day a week for three (3) or more months OR daily for a period of one month or longer.
9.4.1.1 Required screening: Pre-employment screening: I) Application, 2)
Interview, 3) Reference check, 4) Statement of Previous Arrest or Charge, 5) Assessment of individual's eligibility, qualifications, temperament and suitability for work with children, 6) Tentative offer of employment (Proponent: Contractor is responsible organization);
9.4.1.2 Preliminary investigation: I) Installation Record Check (if applicable), 2) FBI Fingerprint check, and 3) Local Civilian Law Enforcement Check (Proponent: Government/Commander Designated Entity is responsible organization).
9.4.1.3 CNACI - Child Care National Agency Check and Inquiries (Proponent:
Government/Commander Designated Entity is responsible organization).
The CNACI will be initiated after successful completion of the preliminary investigation. If deemed appropriate by the local Garrison Commander, a contractor can start working under Line Of Sight Supervision (LOSS) after successfully completing the preliminary investigation. If LOSS is not feasible, favorable CNACI results are required BEFORE the contractor can start working under this contract.
9.4.2 SHORT TERM/OCCASIONAL contact with children: Definition: Contact with children that does not fall under the definition of Regular/Recurring contact.
9.4.2.1 Required screening: Pre-employment screening: I) Application, 2)
Interview, 3) Reference check, 4) Statement of Previous Arrest or Charge, 5) Assessment of individual's eligibility, qualifications, temperament and suitability for work with children, 6) Tentative offer of employment (Proponent: Contractor is responsible organization).
9.4.2.2 Preliminary investigation: 1) Installation Record Check (if applicable), 2) FBI Fingerprint check, and 3) Local Civilian Law Enforcement Check (Proponent: Government/Commander Designated Entity is responsible organization).
9.4.2.3 An employee must successfully complete the required screening and preliminary investigation BEFORE working under this contract.
9.4.3 No person, regardless of circumstances, will be approved to work with children if the individual has been convicted of a sexual offense, a drug felony, a violent crime or a criminal offense involving a child or children. If the background check investigation reveals any other derogatory information a suitability determination has to be made by the Army. The adjudication of derogatory information is processed through an Army Program Review Board (PRB). Further details about the adjudication process can be found in Enclosure 6 of the AD 2014-23. At any time a Contractor can decide not to proceed with the PRB process.
9.4.4 Additional information on the background check process can be found at:

9.4.5 Re-verification (IRC and FBI fingerprint check) is required every 5 years.
10.0 QUALITY ASSURANCE. The Government shall evaluate the Contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan. This plan is primarily focused on what the Government must do to ensure that the Contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s).
11.0 PERFORMANCE REVIEW. The Senior Chaplain will complete performance reviews of the
Contractor performance and submit to the COR for the Contactor File using these tools:
11.1 The Chapel/Program Sponsoring Chaplain Contractor Quarterly Performance Report, submitted by the 5th day of the end of the current quarter.
12.0 DELIVERABLES. The Contractor shall submit Monthly Report to the COR by Close of Business (COB) on the 5th business day of every month. Submit invoice for the previous month in the Wide Area Work Flow.
12.1 The report shall include:

12.1.2 Period covered by the report
12.1.3 Date and Name of preparer
12.1.4 Task Title(s) and Number(s)
12.1.5 Problem Areas
12.1.6 General Comments
12.2 Monthly Status Report completed by the 5th working day of the following month. This report shall be submitted electronically to the COR, in an MS Office format. No more than 2 reports submitted late. 98% accuracy of the content presented.
13.0 TRAVEL. The Government does not anticipate travel in the performance of this PWS.
14.0 OTHER DIRECT COSTS. The Government does not anticipate ODCs in the performance of this PWS.
15.0 CONTRACTING OFFICER’S REPRESENTATIVE (COR). The Government will provide a COR who will be identified by separate letter. The COR monitors all technical aspects of the contract and assists in contract administration The COR is authorized to perform the following functions: assure that the Contractor performs the technical requirements of the contract; perform inspections necessary in connection with contract performance; maintain written and oral communications with the Contractor concerning technical aspects of the contract; issue written interpretations of technical requirements, including Government drawings, designs, specifications; monitor Contractor's performance and notify both the KO and Contractor of any deficiencies; coordinate availability of government furnished property and provide site entry of Contractor personnel. A letter of designation issued to the COR, a copy of which is sent to the Contractor, states the responsibilities and limitations of the COR, especially with regard to changes in cost or price, estimates or changes in delivery dates. The COR is not authorized to change any of the terms and conditions of the resulting order.
16.0 KEY PERSONNEL. The Contractor shall provide a Project Manager (PM) who shall be responsible for the performance of the work. The name of this person and an alternate who shall act for the Contractor when the PM is absent shall be designated in writing to the KO within 24 hours of contract award. The PM or alternate shall have full authority to act for the Contractor on all contract matters relating to daily operation of this contract. The PM or alternate shall be available between the hours of (insert hours) 07:30 – 16:30. The Contractor shall provide written notice to the KO prior to changing the PM or alternate PM no later than five (5) working days prior to the change.
17.0 DEFINITIONS AND ACRONYMS.
17.1 Definitions:
17.1.1 Contractor: A supplier or vendor awarded a contract to provide specific supplies or services to the Government. The term used in this contract refers to the prime.
17.1.2 Contracting Officer: A person with authority to enter into, administer, and/or terminate contracts, and make related determinations and findings on behalf of the Government. Note: The only individual who can legally bind the Government.
17.1.3 Contracting Officer’s Representative: An employee of the U.S. Government appointed by the contracting officer to administer the contract. Such appointment shall be in writing and shall state the scope of authority and limitations. This individual has authority to provide technical direction to the Contractor as long as that direction is within the scope of the contract, does not constitute a change, and has no funding implications. This individual does NOT have authority to change the terms and conditions of the contract.
17.1.4 Contractor Personnel: Employee or subcontractor who is hired by the contractor to perform a service outlined in the PWS.
17.1.5 Defective Service: A service output that does not meet the standard of performance associated with the PWS.
17.1.6 Deliverable: Anything that can be physically delivered, but may include non-manufactured things such as meeting minutes or reports.
17.1.7 Government Furnished Property (GFP) or Government Property (GP): Property in the possession of, or directly acquired by, the Government and subsequently made available to the Contractor.
17.1.8 Key Personnel: Contractor personnel that are evaluated in a source selection process and that may be required to be used in the performance of a contract by the Key Personnel listed in the PWS.
17.1.9 Liturgical Worship. Public worship done by a specific religious group, according to its particular traditions.
17.1.10 Physical Security: Actions that prevent the loss or damage of Government property.
17.1.11 Postlude. Appropriate music provided up to 5 minutes after the conclusion of the worship service.
17.1.12 Prelude. Appropriate music provided up to 5 minutes prior to the start of the worship service.
17.1.13 Quality Assurance: The Government procedures to verify that services being performed by the Contractor are acceptable IAW established standards and requirements of this contract.
17.1.14 Quality Assurance Surveillance Plan: An organized written document specifying the surveillance methodology to be used for surveillance of contractor performance.
17.1.15 Quality Control: All necessary measures taken by the Contractor to assure that the quality of an end product or service shall meet contract requirements.
17.1.16 Rehearsal. A period of up to 60 minutes that the Contractor provides musical support or choir direction to singers (Choirs, Chorales, Praise Team, etc.) and/or other congregational members to rehearse songs or musical programs for performance at future worship services or special events.
17.1.17 Staff Chaplain. A person who oversees a worship service or supervises all the activities of a service group.
17.1.18 Worship Service. Communal worship often occurring on Saturday or Sunday.
