About this file

This is a Justification and Approval (J&A) document for a sole source Blanket Purchase Agreement (BPA) award issued by the Naval Sea Systems Command, Naval Surface Warfare Center, Dahlgren Division (NSWCDD).

The BPA is being awarded on a sole source basis to Applied Physical Electronics, L.C. (APELC) for critical equipment and services covering eight product service codes including instrument manufacturing for measuring and testing electrical signals, national defense R&D services, maintenance and repair of laboratory equipment, electronic countermeasures equipment, and electrical and electronic components. The estimated total cost not to exceed $500,000 is anticipated to be funded through Navy Working Capital Fund annual service cost center (SCC) funds over fiscal years 2026-2030. Individual calls under the BPA will be firm fixed price and shall not exceed the simplified acquisition threshold per call, with government credit card and wide area workflow (WAWF) authorized as payment methods. The period of performance is five years from the date of award, with delivery dates determined in each individual call.

NSWCDD justifies sole source procurement based on APELC's proprietary RS-105 system and MIL-STD 2169 Marx generators (1.3 MVolt) that are essential for electromagnetic pulse (EMP) testing and validation of functional requirements. Market research identified no other vendors, authorized resellers, or alternative solutions capable of meeting the specialized requirements due to hardware compatibility and proprietary limitations. The BPA addresses critical procurement timeline reductions needed to prevent schedule slippage when test assets become unavailable. The BPA will be synopsized on SAM.gov on March 30, 2026, with the Contracting Officer determining costs to be fair and reasonable. The contracting officer is Doritha J. Newman.

JUSTIFICATION AND APPROVAL

JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command, Naval Surface Warfare Center, Dahlgren Division (NSWCDD), Contracts Department

2. Description of the Action Being Approved

Award of a firm fixed priced Blanket Purchase Agreement (BPA) on a sole source basis for critical equipment and services to be used by

, manufactured by Applied Physical Electronics, L.C.

(APELC).

3. Description of Supplies/Services

The BPA will cover products and services with the following product service codes and North America Industry Classification System (NAICS):

334515 Instrument Manufacturing for Measuring and Testing Electricity and Electrical Signals

AC13 National Defense R&D Services; Department of Defense - Military;

Experimental Development

J066 Maint/Repair/Rebuild of Equipment- Instruments and Laboratory Equipment

N099 Installation of Equipment - Miscellaneous 5865 Electronic Countermeasures, Counter-Countermeasures and Quick Reaction

Capability Equipment 5999 Miscellaneous Electrical and Electronic Components 6625 Electrical and Electronic Properties Measuring and Testing Instruments 6640 Laboratory Equipment and Supplies

The BPA will reduce the procurement timelines and enable NSWCDD to establish calls to satisfy recurring requirements that cannot be accurately predicted. Calls under the BPAs will be Firm Fixed Price and shall not exceed the simplified acquisition threshold per call. Individual calls placed under this agreement will identify definitive requirements. The BPA shall include the terms to allow the government credit card and wide area workflow (WAWF) as the methods of

will experience schedule slippage and lost productivity if the equipment’s products are not suitable for use. Due to the continuous use of hardware and systems, it is critical that a solution be implemented for the procurement of hardware and software; rapid maintenance or repairs;

troubleshooting or helpdesk support as soon as possible.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

Market research has not identified any other vendors who can meet the Government’s requirements. Market research and discussions with the OEM, APELC, confirm that there are no authorized resellers for their products and services. It has also been determined that this requirement is inherently noncompetitive due to the proprietary nature of the hardware and services. This makes APELC the only solution to provide the required products and services.

The proposed BPA will be synopsized on the SAM.gov Federal website on 30 March 2026. It is anticipated that only APELC will express interest in this requirement. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than APELC to provide the required hardware, equipment and services.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.

8. Actions to Remove Barriers to Competition

For the reasons set forth in Paragraph 5, NSWCDD has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NSWCDD will assess whether competition for future requirements is feasible.
