About this file
This document is a Justification for Other Than Full and Open Competition for Solicitation SPRBL1-24-R-0006 issued by the Defense Logistics Agency Land and Maritime. The justification explains that the MX-12607 Image Intensifiers (I2 Tubes) being procured under Contract SPRBL1-24-D-0006 are sole source to Elbit Systems of America. The previous contract W91CRB-21-D-0017 was also awarded to Elbit Systems of America on a sole source basis due to compatibility issues with I2 Tubes from other manufacturers. The government will continue to seek additional competition through subcontracting opportunities and market research, but currently the I2 Tubes are only available from Elbit Systems of America. The total value of the previous sole source contract was $92,440,406.17. The government does not possess the technical data package for the I2 Tubes, which prevents them from competing the requirement.

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
SOLICITATION SPRBL1-24-R-0006
DLA Land & Maritime Justification for Other Than Full & Open Competition
(March 2023)
10. Actions to Increase Competition:
a. The solicitation and the resultant contract will include subcontracting opportunities. A small business subcontracting plan will be required per FAR 52.219-9 Small Business Subcontracting Plan (Sep 2023), and DFARS 252.219-7003 Small Business Subcontracting Plan (Dec 2019). FAR 52.244-5 Competition in Subcontracting (Dec 1996), will be included and requires a contractor to select subcontractor and suppliers on a competitive basis to the maximum extent possible.
b. The Government will continue to conduct market research to ascertain if technical advancements have been made so that I2 Tubes from different manufacturers can be mixed in the AN/AVS-6 without adverse effects described in Section 5.
11. Previous Justification and Approval: DFARS 206.304(a)(4)(S-70) and DFARS PGI 206.303- 2(b)(i)(B) requires an assessment of “whether the planned actions to remove any barriers to competition cited on the previous justification were completed.” The previous J&A (Attachment 1) stated that multiple SSAs were posted to FedBizOpps website (replaced by SAM.gov) in an effort to yield additional viable vendors. While the SSAs failed to do so, the actions stated on the previous J&A were completed.
12. Other Facts:
a. Procurement History: The table below provides the previous acquisition history for the I2 Tubes.
Table 2. Procurement History.
Contract Number Award Date Contractor Extent

W91CRB-21-D-0017 August 20, 2021 Elbit Systems of America
Sole Source, FAR 6.302-1

b. The U.S. Army Contracting Command awarded a sole source, five-year IDIQ production contract to Elbit. Contract W91CRB-21-D-0017 was awarded to provide continuity of support for the procurement of the ANVIS.
c. Acquisition Data Availability: The Government does possess the TDP for the I2 Tubes but as stated above, I2 Tubes from different manufacturers are not compatible.
d. Subcontracting Competition: The Government will seek to maximize subcontracting competition with the inclusion of terms and conditions requiring large business concerns to submit a Small Business Subcontracting Plan for acquisitions meeting the $750,000 threshold.
