About this file

This is a Justification for Other Than Full and Open Competition (J&A) for a Defense Logistics Agency (DLA) Land and Maritime solicitation (SPE7MX25R0022) for electrical solenoids. The contract is for a three-year, firm-fixed-price Indefinite Quantity Contract (IQC) to procure 490 electrical solenoids annually, used specifically in Bradley Fighting Vehicle Systems. The estimated total contract value is redacted, but the procurement is not being competitively bid due to limited manufacturing sources.

The market research identified three potential vendors: Rocker Solenoid Company, Transaero INC., and Ram Manufacturing Company, all small businesses. These vendors were the only sources approved by the design control activity to manufacture the item, possessing the complete technical data and manufacturing capabilities. The solicitation was synopsized on November 14, 2024, with a sources sought notice posted on October 25, 2024. The contract will be solicited as a non-commercial contract using FAR part 15, with the DLA determining that technical data is not available to permit full and open competition. The procurement is planned for posting on DIBBS around January 30, 2025.

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

SOLICITATION SPE7MX25R0022

DLA Land & Maritime Justification for Other Than Full & Open Competition ( 3)

The use of the authority cited below:

[X] AMC 1. Suitable for competitive acquisition for the second or subsequent time.

The use of the authority cited is based on:

[X] AMSC B. This part must be acquired from a manufacturing source(s) specified on a source control or selected item drawing as defined by the current version of DoD-STD-100. Suitable technical data, Government data rights, or manufacturing knowledge are not available to permit acquisition from other sources, nor qualification testing of another part, nor use of a second source part in the intended application. Although, by DoD-STD-100 definition, altered and selected items shall have an adequate technical data package, data review discloses that required data or data rights are not in Government possession and cannot be economically obtained. If one source is available, AMCs 3, 4, or 5 are valid. If at least two sources exist, AMCs 1 or 2 are valid.

The approved sources listed above, confirmed by the SAPD Product Specialist during the technical review of the NSN for placement on this long-term contract initiative, are currently the only sources approved by the design control activity to manufacture the item. They are also the only sources that possess the complete technical data, rights to the data, and capability necessary to manufacture the item for the required form, fit, function, and quality.

6. Efforts to ensure that offers are solicited from as many sources as practicable are:

[X] The acquisition was synopsized on November 14, 2024, with an update added on 1/28/2025.

[X] The solicitation will be posted to DIBBS on or about January 30, 2025.

[X] A sources sought notice was posted on October 25, 2024, for a period of 5 days, with 1 response received from BHPE, LLC, which appeared to be an automated bot repsonse. Buyer sent a follow-up email to BHPE on 4/2/2025 and did not receive a response from the sender of the automated message. No responsible vendors responded to the Sources Sought Notice.

7. I hereby determine that the anticipated cost to the Government will be fair and reasonable. A price analysis will be conducted using historical pricing, the Producer’s Price Index (PPI), and a learning curve analysis. Offerors may also be required to submit information other than certified cost or pricing data if deemed necessary by the Contracting Officer, in order to determine prices fair and reasonable. Based on the above techniques, the Contracting Officer anticipates the costs to the Government will be fair and reasonable.

8. Market Research/Efforts to Obtain Competition:

Market Survey [10 U.S.C. 3204(e)(2)(D)]:

[X] A market survey was conducted on/during 10/21/2024 through 10/24/2024.

Total number of vendors contacted: Three vendors were contacted; three responded.

Names of vendors contacted and responding:

- Rocker Solenoid (CAGE 07797): Responded

- Transaero INC. (CAGE 27541): Responded

- Ram Manufacturing (CAGE 55725): Responded

DLA Land & Maritime Justification for Other Than Full & Open Competition (March 2023)

9. Additional facts supporting other than full and open competition are:

[X] Based upon the attached technical certification, technical data is not available and cannot be developed to permit full and open competition. The data presently available reflects the minimum needs of the Government.

During the project development stage, the NSN included on this solicitation was provided to the DLA Land & Maritime Value Management (VM) Unit and the Strategic Acquisition Programs Directorate (SAPD) Product Specialist for review; no additional sources were identified during those reviews and all means to obtain a technical data package adequate for manufacture of the items has been exhausted.

10. A listing of sources, if any, indicating an interest in the acquisition is:

- Rocker Solenoid (CAGE 07797)

- Transaero INC. (CAGE 27541)

- Ram Manufacturing (CAGE 55725)

11. The following actions are being taken to identify additional sources:

[ X ] Solicitation contains DLA Procurement Note, L22 Restriction of Alternate Offers for Source Controlled Items

The previous J&A was reviewed, and all actions were accomplished. See attachment.

I hereby certify that the information contained in this justification is accurate and complete to the best of my knowledge and belief. If not exceeding $750,000, this signature serves as the approval.
