About this file
This justification document supports a sole source modification to an existing contract with Gen-Probe, Inc. for additional COVID-19 testing services. The Regional Health Contracting Office-Central is modifying contract W81K00-20-P-0277 to add a Molecular Diagnostic PCR identification and sensitivity system, reagents, and consumables from Gen-Probe, Inc. for COVID-19 testing at Evans Army Community Hospital. The period of performance for the additional services is from the date of award through 30 September 2021. Funding comes from Fiscal Year 2021 Department of Defense health program operations and maintenance funds. The justification cites the authority of Federal Acquisition Regulation 13.501(a)(1)(ii) for this non-competitive procurement as Gen-Probe, Inc. is the only company that can immediately provide continuity of critical COVID-19 testing to meet Department of Defense requirements.

Instrument/Service/Reagent/Consumables for Various Viruses
Version – March 2017 FOR OFFICIAL USE ONLY
Molecular diagnostic analyzers, service and reagents/consumables for various viral assays, which expires 30 September 2021. An option year package for the renewal will follow, subject to the availability of Fiscal Year 2022 funds. Industry has indicated that a 30 to 60 day validation correlation process is required. This is necessary to deliver, install, validate and correlate the system prior to becoming fully operational. Additionally, with the RMF requirement, and if the potential new vendor does not have a current ATO, the timeframe needed is substantially longer. In order to continue providing for molecular diagnostic analyzers and reagents/consumables for various STD and COVID- 19 assays, that are critical to the Department of Defense mission of providing access to patient care, a modification to the current contract is required. Gen-Probe, Inc., is the only company that possesses the ability to immediately support the continuation of this requirement, because they are the incumbent and the required analyzer is currently in use.
6. Efforts to Obtain Competition: Contract W81K00-20-P-0277 was awarded to Gen- Probe, Inc., with a period of performance of 1 October 2020 to 30 September 2021. It is not feasible to compete the requirement at this time because the directives from the Secretary of Defense and Secretary of the Army to test all deploying and training units for COVID-19 as soon as possible. Upon approval of this justification, contract W81K00- 20-P-0277 will be modified to accommodate the COVID-19 testing.
7. Actions to Increase Competition: When the current analyzer reaches end of life, the customer will research other competitive solutions to meet the Government’s need for fairness of competition.
8. Market Research: Based on market research, there are other vendors capable of providing molecular diagnostic analyzers, service and reagents/consumables for various viral assays testing under a cost-per-test arrangement, but there are none who have a single platform to provide multiple types of testing. Additionally, due to the extreme time constraint to re-solicit the requirement, evaluating and awarding the new contract, along with the aforementioned delivery/install/validation process, it is not possible for another vendor to fully and immediately support this effort and meet the requirements of this modified contract.
