FEDERAL BUREAU OF INVESTIGATION
FINANCE DIVISION | PROCUREMENT SECTION
JUSTIFICATION AND APPROVAL (J&A) FOR OTHER THAN FULL AND
OPEN COMPETITION
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION IN ACCORDANCE WITH 41 U.S.C. 3304 (A) (1)(
Requisition Number: DJF-21-1800-PR-0002498
Date: 6/28/2021 Estimated Contract Dollar Value: $27, 752.28
1. Identification of the agency and contracting activity.
The U.S. Department of Justice, Federal Bureau of Investigation (FBI), National Acquisitions Program Unit (NAPU), has prepared this justification for other than full and open competition to acquire the following brand-name products on behalf of the TACOPS Ill / Tactical Operations Section / Operational Technology Division:
Hawkeye Pro Semi-Rigid 90-degree Borescopes, Model HSR 009 0159 55
2. The nature and/or description of the action being approved, i.e., sole source, limited competition, establishment of a new source, etc.
The proposed action is to acquire replacement parts for existing equipment as listed:
Six (6) Hawkeye Pro Semi-Rigid 90-degree Borescopes, Model HSR 009 0159 55, including FOB shipping destination.
This procurement will be advertised on SAM.gov as a brand-name solicitation, with small business set-aside. The resultant contract is intended to be awarded as a one-time, firm-fixed price contract.
3. A description of the supplies or services required to meet the agency’s needs.
Specific characteristics of the borescopes that are specific to brand-name include: Semi- Rigid 90-degree Borescopes, Model HSR 009 0159 55, 0.9 mm diameter, 150 mm length, 55-degree field of view, 90 degree viewing angle. TACOPS Ill requires borescopes that match the original ones as closely as possible to minimize modifications of the TACOPS Ill's specialized equipment. The semi-rigid borescopes measure less than 1 mm diameter, 6 inches in length, a field of view of 55 degrees and a 90 degree look angle with a high pixel count of 10,000 pixels or more.
4. The statutory authority permitting other than full and open competition.
The statutory authority permitting other than full and open competition is 41 U.S.C. 253
(c)(l) as implemented by the Federal Acquisition Regulation (FAR) 6.302-1 entitled, "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements" – Application for Brand Name.
The TACOPS Ill / Tactical Operations Section / Operational Technology Division has developed specialized equipment, and the original supplier of borescopes is no longer producing them. Therefore, TACOPS Ill requires borescopes that match the original ones as closely as possible to minimize modifications of the TACOPS Ill's specialized equipment.
5. Demonstrate the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority.
TACOPS Ill currently uses borescopes during specific operations, and additional units are required. To maintain continuity with existing specialized hardware and operating procedures, TACOPS Ill desires the acquisition of the same scopes that are currently in-use; however, the original manufacturer is no longer making the borescopes. Therefore, TACOPS Ill requires new borescopes that closely match the original ones to minimize redesign of our specialized equipment and maintain operational capabilities.
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.
The Federal Bureau of Investigation (FBI) requirement will be posted on the Sam.gov website as a brand-name only, open market requirement, with small business set-aside. This announcement will give an opportunity for authorized resellers of the Hawkeye Pro Semi- Rigid Borescopes to demonstrate their ability to meet the FBI’s specific need through a submission of their technical capabilities and cost information.
7. The anticipated dollar value of the proposed acquisition, including options if applicable, and a determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The anticipated dollar value for this award is $27,722.28. Prior to issuing an award, the Contracting Officer will determine the proposed price is fair and reasonable in accordance with
FAR 13.106-3.

8. A description of the market research conducted and the results.
Significant market research efforts conducted by TACOPS Ill include researching various equipment and supply companies in the market through internet searches and discussions with multiple vendors. This market research revealed that there are vendors available that offer the required Hawkeye Pro Semi-Rigid Borescopes brand-name equipment.
9. Any other facts supporting the use of other than full and open competition.
Please see section five (5) above.
10. A listing of any sources that expressed a written interest in the acquisition.
This requirement will be posted on www.sam.gov as a brand-name only, open market requirement, with small business set-aside. This announcement will give an opportunity for authorized resellers of the Hawkeye Pro Semi-Rigid Borescopes to demonstrate their ability to meet the FBI’s specific needs through a submission of their technical capabilities and cost information.
11. A statement of any actions the agency may take to remove or overcome any barriers to competition, if subsequent acquisitions are anticipated.
The actions of the TACOPS Ill / Tactical Operations Section / Operational Technology Division to identify potential sources possessing the ability to satisfy this and similar requirements are ongoing. Over time, additional sources may become available and identifiable through market surveys from vendors’ websites, magazine articles, product literature published by manufacturers, distributors, dealers, collaboration with other Federal agencies, or other means. The ability to predict this possibility is difficult. Therefore, the barriers to competition they impose are impossible to avoid.
