About this file

This document is a Justification and Approval (J&A) for a sole source contract modification to extend security services in support of a construction renovation project at Naval Air Station Sigonella in Italy. The modification extends the existing firm-fixed-price contract N6817122P0209 with Singularity Security Group LLC for an additional 24-26 months to provide Construction Surveillance Technicians, Cleared American Guards, and a Site Security Manager.

The extension is necessary due to a 20-month delay in the NAVFAC construction contract, which has pushed the project completion from October 2024 to June 2026. The security personnel possess specialized expertise in SCIF construction, intelligence operations, counter-surveillance, and physical security required to ensure the construction complies with Intelligence Community and DoD security requirements. Recompeting this requirement would result in significant delays, duplication of costs, and a risk of losing security continuity. The contracting officer determined the costs will be fair and reasonable, and plans to compete similar security services for future construction projects.

J&A No. 24-0091

ANNEX 1 – JUSTIFICATION AND APPROVAL

(CLASS) JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity

The requiring activity is COMMAND TASK FORCE 67 (CTF 67), Naval Air Station Sigonella (NAS SIG), Italy. The contracting activity is NAVSUP Fleet Logistics Center Sigonella (FLCSI) Site Naples.

2. Description of the Action Being Approved

Approval is sought to execute a contract modification to increase the scope of the existing firm-fixed-price contract N6817122P0209 with Singularity Security Group LLC (SSG). The increase in scope is for a time extension of their services to provide adequate construction security and surveillance services. This work is to support the secure construction renovation project at NAS SIG, in accordance with the Intelligence Community Directive (ICD) 705 and Department of Defense (DoD) policies. The Naval Facilities Engineering Systems Command (NAVFAC) construction contract is approximately 20 months behind schedule. The initial end date of the construction contract was 31 October 2024. The originally intended work encountered difficulties on-site that were unknown at the time of the award of the initial construction contract, which has pushed the end date of the project to 30 June 2026, thus requiring construction security surveillance services in support of the construction schedule.

3. Description of Supplies/Services

The SSG personnel currently on-site at NAS SIG possess security experience specifically related to SCIF construction, Intelligence Operations, Counter-Intelligence Operations, Counter- Surveillance Operations, Technical Surveillance Counter-Measures, Physical Security, or a combination of these areas. They have familiarity and knowledge of the sixteen (16) standard divisions of construction, and knowledge of technical listening devices commonly used by foreign intelligence services. Personnel possess familiarity and knowledge with established security protocols and known challenges in assembling high security systems coordinating procurements, transportation, storage and installation of the US Government provided collateral equipment.

The proposed contract extension is for a total duration of 24 months for five (5) Construction Surveillance Technicians (CSTs) and 5 Cleared American Guards (CAGs), 26 months for the Site Security Manager (SSM), and 25 months for the CST Lead and CAG Lead. The extension of services is critical to ensuring that the construction renovation project complies with the requirements defined in the ICD 705, "Physical and Technical Security Standards for Sensitive

The CSTs, and corresponding lead are currently being utilized in support of changes to the current facility in NAS SIG required for the renovation. The CAGs, and corresponding lead are currently being utilized to act as controlling authorities to and from the facility, as well as roving inspectors of changes to the current facility in NAS SIG required for the renovation. The SSM is overseeing the CSTs and CAGS in support of changes to the current facility at NAS SIG required for the renovation, as well as assisting in developing site security plans for contractors to follow to ensure compliance with ICD 705 requirements.

4. Statutory Authority Permitting Other Than Full and Open Competition

The statutory authority permitting other than full and open competition is 41 U.S.C. 1901, as implemented by FAR 13.501(a)(1)(ii).

5. Rationale Justifying Use of Cited Statutory Authority

This proposed sole source requirement is to extend existing contract N6817122P0209 to SSG. As previously stated, the NAVFAC construction contract is approximately 20 months behind schedule. The initial end date of the construction contract was 31 October 2024. The originally intended work encountered difficulties on-site that were unknown at the time of the award of the initial construction contract, which has pushed the end date of the project to 30 June 2026. The delay in the on-going construction contract will require the support of the CSTs and CAGs until 30 April 2026, the CST/CAG Leads until 31 May 2026, and the SSM by 30 June 2026. The construction labor requires observation by the CSTs and CAGs to ensure compliance with security regulations. SSG must adhere to the Construction Security Plan (CSP) to meet Defense Intelligence Agency (DIA) requirements to receive final facility accreditation for construction. If this request for extension is not approved, the NAVFAC construction project is at risk for schedule delay, risk of continuity for security accreditation of the SCIF, and duplication of costs.

The delay in the construction schedule drives the need for an extension of security services to clear and monitor construction personnel on site. If this extension was re-competed, it would require a minimum of 6 months to get to award, coupled with a minimum of three months to get contractor personnel cleared for entry to Europe and even longer to work onboard Sigonella.

This extenuated timeframe needed to re-compete this requirement would further delay an already late construction project. All personnel required by the proposed modification are currently on site, possess current visas, and accreditation required to work in Italy and onboard NAS Sigonella.

The continuity required for security of documentation is imperative for SCIF security accreditation. Christopher Miller, the Regional Security Officer and DIA Certified SCIF Inspector, and CTF-67 provided a signed memo on 15 March 2024 stating that the work must be continued by SSG to ensure that oversight is not lost on documentation and that the CSP has been properly followed. In addition to the delay created by a re-competition, bringing a new contractor onboard would create an unnecessary duplication of cost, as that contractor would need to review and analyze SSG’s previous records for certification.

As these specialized services are in an overseas location, the short turn-around time needed to have the personnel in place, and the continuity of management for the personnel accreditation process necessitate contracting with the existing source for these services. The basic contract was competitively awarded in August 2022. In response, there were two quotes received. SSG’s quote was rated as the best value quote to the Government, with the lowest price, and being rated as having outstanding combined technical/risk and substantial confidence past performance ratings.

Conducting a new competition is not expected to yield new sources to meet this requirement as evidenced by the lack of submissions to the intent to sole source synopsis posted to SAM.gov.

The services are specialized, the vendor pool is small, and SSG was selected as the best value contractor that quoted the lowest price to meet the requirement.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

The contracting officer intends to post a synopsis of the intended sole source modification to the Government-wide point of entry (GPE), the System for Award Management (SAM) website. While the Government has determined not to solicit from more than one source, if any responses are received, it will retain the information to use as market research for any future opportunities.

7. Determination of Fair and Reasonable Cost

The total estimated value of this modification is . The contracting officer anticipates that the cost to the Government of the additional services covered by this J&A will be found fair and reasonable.

8. Actions to Remove Barriers to Future Competition

For the reasons set forth in Paragraph 5, NAVSUP FLCSI has no plans at this time to compete the subject extension. However, NAVSUP FLCSI fully anticipates competing requirements for similar security services on future construction projects.
