General Services Administration Federal Supply Schedule Limited Source Justification
Completion Instructions: Health and Human Services (HHS) has established a standard template for preparation of a Limited Source Justification (LSJ). For Federal Supply Schedule (FSS) acquisitions over the Simplified Acquisition Threshold (SAT), Operating Divisions (OPDIVs) shall prepare the template in accordance with these completion instructions. 2. Nature and/or description of the action being approved.
a. Acquisition purpose and objectives.
The purpose of this acquisition is to provide Operations & Maintenance Support to the Joint
Administration Application Development Environment 2 (JAADE2) and the 30+ applications which make up Admin Apps which reside in the environment. The acquisition will serve as a logical follow-on to the existing FY24 O&M Task Order that expires November 26,2024. The acquisition will bridge the gap between the FY24 O&M Task Order and the award of the new Blanket Purchase Agreement (BPA) which is currently undergoing voluntary corrective action.

AdminApps makes up 30+ administrative applications which support the agency and contain a High Value Asset (HVA) application, a Enterprise Administrative Support Environment (EASE) as well as other critical applications that handle onboarding, Freedom of Information Act (FOIA) requests, Commissioner inquiries, Grants Management, Ethics, providing downstream systems employee data such as Active Directory and many other critical administrative functions.
b. Project background.
Under the previous BPA that was awarded to Mackson Consulting LLC, there was an O&M Task Order with a POP ending on 11/26/2023. A limited sole-source award was issued to Mackson to continue O&M work while the new JAADE2 BPA was going through the procurement cycle. The O&M Task Order was ultimately extended until 11/26/2024. The current TO contract award is HHSF223201810004B/75F40123F19018. The previous BPA award was competed to all Small Business.
The current LSJ requested is for a logical follow-on Task Order for O&M. This Task Order will include one
(1) 3-month base, two (2) 3-month option periods and one 1-month option period. This will allow the continuity of operations while the BPA acquisition is undergoing voluntary corrective action. It will also allow for a 60-day transition with the current vendor. The total award would be less than dollars.
3. Description of the supplies or services required to meet the agency�s needs (including the estimated value).

b. Project Description.
Along with serving as a bridge between the FY24 O&M Task Order and the new BPA award, the FDA JAADE2 Environment requires support services for the 30+ applications and databases which are known as AdminApps. To support the FDA missions managed through the applications residing in the AdminApps Environment, the AdminApps team works closely with the business owners and the Contractor support team to ensure the applications continue to perform efficiently, user service requests are handled in a timely manner, security policies are adhered to, and assessments are continually made to identify areas where upgraded technologies or processes may enhance the user experience.

a. Acquisition authority.
This acquisition is conducted under the authority of the Multiple Award Schedule Program. In accordance with Federal Acquisition Regulation (FAR) 8.405-6(a), consideration of schedule contractors will be restricted to fewer than the number required at FAR 8.405-1, FAR 8.405-2, FAR 8.405-3 (i.e., fewer than three FSS contractors). FAR 8.405-6 (a)(1)(i), for a proposed order or BPA with an estimated value exceeding the micro-purchase threshold not placed or established in accordance with the procedures in FAR 8.405-1, FAR 8.405-2, or FAR 8.405-3, the only circumstances that may justify the actions are-

(A) An urgent and compelling need exists, and following the procedures would result in unacceptable delays;
(B) Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized;
(C) In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order or BPA must not have been previously issued under sole-source or limited-sources procedures.
This acquisition is conducted under the authority of the Multiple Award Schedule Program. In accordance with FAR 8.405-6(b), consideration of schedule contractors will be restricted only to the item peculiar to one manufacturer. An item peculiar to one manufacturer can be a particular brand name, product, or a feature of a product, peculiar to one manufacturer. A brand name item, whether available on one or more schedule contracts, is an item peculiar to one manufacturer.
b. Demonstration of the proposed contractor(s) unique qualifications to provide the required supply or service.

Mackson Consulting is the current vendor providing O&M services to the AdminApps program. The current vendor has an in-depth knowledge of the JAADE2 legacy environment and the 30+ applications known as AdminApps that reside within that environment.
5. Determination by the ordering activity Contracting Officer that the order represents the best value consistent with FAR 8.404(d).
The pricing for the labor categories for the services are consistent with the previous BPA pricing which was awarded through full and open competition by selecting the vendor with the lowest price and acceptable technical proposal. The Government will seek additional discounts prior to award. The Government has put together an IGCE for the requested services.
6. Description of the market research conducted among schedule holders and the results, or a statement of the reasons market research was not conducted.
Market research was conducted in preparation for awarding the new BPA, which was issued as a small business set-aside. This TO will be a limited amount of time and requires the current vendor�s expertise on the JAADE2 environment and the 30+ applications which reside in the environment known as AdminApps. There is O&M work under the current TO which needs to be completed.
No other vendor has specialized knowledge of the JAADE2 environment and 30+ applications that make up the AdminApps program. The current vendor is required to provide O&M support
