About this file
This is a Justification for Other Than Full and Open Competition (J&A) under FAR 6.302-1 for solicitation SPE7MX26R0038 issued by the Defense Logistics Agency (DLA) Land and Maritime.
The acquisition seeks a Parts Kit, Fluid Pre (NSN 4330011255432) in the quantity of 2,265 units for the C-130 Hercules aircraft under a firm-fixed price indefinite delivery, indefinite-quantity contract with a total length of three years (one-year base period plus two one-year option periods). The Government has restricted this acquisition to a single source, Pall Aeropower Corporation (CAGE 18350), as the only approved manufacturing source by the design control activity. The justification cites AMC 3 (acquire for the second or subsequent time directly from the manufacturer) and AMSC D, noting that the manufacturer retains proprietary technical data essential to maintaining part quality and that this data is not economically available to the Government. The Government will conduct price analysis against historical prices and certified cost or pricing data as required by FAR 15.403-4 to ensure fair and reasonable pricing. Market research efforts included posting a Sources Sought Notice to SAM.gov from February 25 to March 4, 2026 (yielding no responses), conducting a market survey on February 25, 2026 (contacting Pall Aeropower and Jamaica Bearing, both of whom responded), and synopsizing the acquisition for 15 days on or about March 23, 2026. The solicitation will remain posted to the DLA Internet Bid Board System for a minimum of 30 days and includes DLAD Procurement Note L04, which allows vendors to submit alternate offers and request technical acceptability evaluation for future procurements. The Contracting Officer approved this J&A on March 24, 2026, as the estimated value does not exceed $10,000,000.

The use of the authority at 10 U.S.C. 3204(a)(1) is based on:
[X] AMC 3. Acquire, for the second or subsequent time, directly from the manufacturer.
The following AMSC descriptions are available in DFARS PGI 217.7506 Part 2.
[X] AMSC D. The data needed to acquire this part competitively is not physically available, it cannot be obtained economically, nor is it possible to draft adequate specifications or any other adequate, economical description of the material for a competitive solicitation. AMCS 3, 4, or 5 are valid.
Companies listed at table in paragraph 5 are the only approved manufacturing sources by the design control activity. This manufacturer retains data rights, or technical data that are not economically available to the Government, and the data or knowledge is essential to maintaining the quality of the part. Although DLA does not possess adequate data, lacks rights to data, and/or has no record of an alternate Design Control Activity approved source. The data presently available reflects the minimum needs of the Government. Also, it was indicated that there is no outstanding DLA Form 339 request for additional sources.
On 2/9/2026, the Product Specialist of record certified the accuracy of the approved source(s) and applicable AMC/AMSC codes. A copy of the certificate is attached.

7. I hereby determine that the anticipated cost to the Government will be fair and reasonable.
A price analysis will be conducted based on a comparison of proposed prices received in response to the solicitation and/or a comparison of proposed prices to historical prices paid. Certified cost or pricing data, when required by FAR 15.403-4, and data other than certified cost or pricing data, will be requested and obtained as necessary to establish a fair and reasonable price, and a cost analysis may be performed on the data submitted.
