About this file
This justification and approval document outlines a sole source award of a Small Business Innovation Research (SBIR) Phase III contract to CORVID Technologies. The Naval Research Laboratory requires development of a surface-to-air missile interceptor debris model for anti-ship cruise missile defense simulations. The contract will involve predictive high-fidelity computational physics simulation, supercomputing facilities, and process identification analysis. CORVID Technologies was awarded related SBIR Phase I and Phase II contracts, including contract N68335-18-C-0455, and successfully developed post-intercept debris modeling tools. The justification cites CORVID's relevant experience and the derived nature of Phase III work in accordance with SBIR program guidelines and Federal Acquisition Regulation part 5 as the basis for this sole source award. The period of performance is one base year and two option years, with funding to be specified annually across fiscal years 2020 through 2022.

REPLY REFER TO:
J&A No.: J&A6.302-5-20HD03 1 Sep 20
JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Identification of Agency and Contracting Activity.
Naval Research Laborat01y, 4555 Overlook Avenue, SW, Washington, DC 20375-5000.
2. Nature/Description of Action.
This is a justification to award a Small Business Innovation Research (SBIR) Phase III contract to CORVID Technologies (DUNS: 040707460).
CORVID Technologies was awarded various Depa11ment of Defense SBIR Phase I and Phase II contracts for post-intercept debris modeling and prediction tools, including N68335-18-C-0455 on 18 June 2018, resulting from Navy SBIR Solicitation 2018.1, Topic N181059.
3. Description of Supplies/Services.
The Naval Research Laborato1y's Tactical Electronic Warfare Division, Electronic Warfare Modeling/Simulation Branch (Code 5770) has a requirement for the development of a surface-to air missile interceptor debris model for anti-shi cmise missile ASCM defense for use in testbed simulations. The
The required debris modelin will simulate debris attems of interceptor detonation and target destrnction to enhance effectiveness. To achieve this, the requirement is divided into four task areas:
Page 1 of5 predictive High Fidelity Computational Physics (HFCP) simulation tools, supercomputing facilities, and PID analysis experience was leveraged to successfully model surface to air missile interceptor debris including all components from both the interceptor and the target. The approach was agnostic to specific interceptor and target combinations for maximum flexibility, and worked towards developing prototype software. As documented in the Market Research Report, CORVID has been awarded several SBIR Phase I and Phase II contracts for development of post intercept debris modeling and prediction tools. Given the success of these SBIR awards, it is anticipated that requirement will leverage the demonstrated technology for further development and use in the .
6. Description of Efforts Made to Ensure Offerors Were Solicited from as Many Potential Sources as Practicable/ Public Notification through Government Point of Entry (GPE).
As described above, only CORVID Technologies is being considered for a Phase III award due to the nature of the acquisition. In accordance with FAR 5.202(a)(7), this proposed contract action does not require public notification to the GPE.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer will determine prior to award that the negotiated price of the contract executed under this justification is fair and reasonable pursuant to FAR Subpart 15.4. Because this acquisition meets the threshold for the requirement of certified cost or pricing data, a cost analysis shall be used to evaluate the reasonableness of individual cost elements, and price analysis should be used to verify that the overall price offered is fair and reasonable in accordance with FAR 15.404-1(a)(3). This determination will be documented in Business Clearance Memorandum, which will be included in the contract file.
8. Description of Market Research or Statement of the Reason Market Research was not Conducted.
FAR 10.001(a)(2) indicates that market research appropriate to the circumstances must be conducted. SBIR Phase III procurements are such that traditional market research to identify alternative sources is generally unnecessary. As described above, the Phase III work derives from, extends, or completes efforts performed under Phase I and Phase II. However, market research was conducted to ensure that a SBIR Phase III award was a valid approach and to gain a better understanding of the requirement.
9. Any Other Supporting Facts.
Assistant Secretary of the Navy (Research, Development and Acquisition) memorandum, “Small Business Utilization for a Strategic Advantage,” dated 6 August 2018, directs DON acquisition teams to:
“Leverage the agile, time-saving authorities resident in the SBIR/STTR Program's Phase III award process, to include direct SBIR/STIR Phase III awards without future competition, where applicable. Direct SBIR/STTR Phase III awards without further competition are an authorized exception to competition requirements and Programs are encouraged to employ this exception where such action meets performance requirements and affordability;”
The SBA’s SBIR/STTR Policy Directive (dtd. 02 May 2019) also states the following:
“The competitions for SBIR/STTR Phase I and Phase II awards satisfy any competition requirement of the Armed Services Procurement Act, the Federal Property and Administrative Services Act, and the Competition in Contracting Act. An agency that wishes to fund an SBIR/STTR Phase III award, which is an extension of prior Phase I and/or Phase II awards, is not required to conduct another competition for the Phase III award in order to satisfy those statutory provisions. As a result, in conducting actions relative to a Phase III SBIR/STTR award, it is sufficient to state for purposes of a Justification and Approval, if one is deemed required by the agency, that the project is an SBIR/STTR Phase III award that is derived from, extends, or completes efforts made under prior SBIR/STTR Funding Agreements and is authorized pursuant to 15 U.S.C.
638(r)(4). Further justification is not needed.”
10. Listing of Interested Sources.
Not Applicable.
11. Actions Taken to Remove Barriers to Competition.
The Contracting Officer anticipates that competitors will enter the market once the product is commercialized. It is likely that future acquisitions will be competed using full and open competition and commercial item acquisition procedures. The Contracting Officer is not aware of any specific actions that would further remove barriers to competition.
12. Period of Performance.
One base year, and two option years
13. Total Estimated Dollar Value of the Acquisition Covered by this J&A, with Funding Specified by Year and Appropriation.
FY20 FY21 FY22 Total
14. Actions Attempted to Make Immediate Acquisition Competitive and Cost/Benefit Analysis.
No actions were attempted to make the immediate acquisition competitive; no cost/benefit analysis was performed. As described above, only CORVID Technologies is being considered for Phase III award due to the nature of the acquisition.
