About this file

This is a Justification and Approval (J&A) document for other than full and open competition under FAR 6.302-1, authorizing a sole-source acquisition by the Defense Logistics Agency (DLA) Weapons Support (Columbus). The contracting activity seeks to establish an Indefinite Delivery Contract (IDC) successor to FAR Part 12 IDIQ SPE7LX21D0060 (expiring 12/30/2025) using FAR Subpart 13.5 simplified procedures for four National Stock Numbers (NSNs). The contract term consists of a one-year base period with four one-year option periods exercisable at government discretion.

The four NSNs being acquired are MBITR broadband antenna components, a power supply charger, and a battery tray manufactured exclusively by Thales Defense & Security (CAGE 23386). These items are components for the military AN/PRC-148 tactical broadband radio and the commercially similar AN/PRC-6809 radio. The items have been determined to be commercial or "of a type" commercially available with modification. Thales is designated as the sole approved source based on form, fit, and functional interchangeability requirements and design control approval. The justification indicates items are available only from one responsible source under 10 U.S.C. 3204(a)(1). Market research conducted via a Sources Sought Notice on SAM.gov (04/23/2025–04/29/2025) yielded no competing offers. Estimated annual quantities range from 24 to 1,518 units depending on the NSN. Current unit pricing under the expiring contract is $73.23–$808.72 per item with 120-day delivery. Future NSNs may be added through bilateral modification with technical certification. The acquisition includes DLAD Procurement Note L27 for item additions and Note L04 permitting alternate offers with technical acceptability evaluation for future procurements.

The use of the authority at 10 U.S.C. 3204 (a)(1) is based on:

AMC 3. Acquire, for the second or subsequent time, directly from the manufacturer AMC 5. Acquire directly from the sole source contractor, who is not the manufacturer.

The following AMSC descriptions are available in DFARS PGI 217.7506 Part 2.

[ X ] AMSC D. The data needed to acquire this part competitively is not physically available, it cannot be obtained economically, nor is it possible to draft adequate specifications or any other adequate, economical description of the material for a competitive solicitation. AMCS 3, 4, or 5 are valid.

The initial Tech Cert document for project CL25252001 was completed by DLA Weapons Support (Columbus) Product Specialist on 09/16/2025. On 12/04/2025 SAPD Branch Product Specialist reviewed the project NSNs and updated the AMSC from “Z” to “D” for NSN 6160-01-487-1151. A revised Tech Certification was received on 12/10/2025 certifying the supporting NSN tech/quality data including AMC/AMSC codes and approved sources, are complete and accurate.

has concurred with the Contracting Officer’s commercial determination that these items not commercial-off-the-shelf items but are “of a type” available in the marketplace with modification.

The Product Specialist confirmed the data presently available reflects the minimum needs of the Government and the data needed to acquire these parts competitively is not physically available, it cannot be obtained economically, nor is it possible to draft adequate specifications or any other adequate, economical description of the materials for a competitive solicitation enabling a “Brand Name or Equal” full and open solicitation per FAR 52.211-6. The Quality Assurance Specialist updated the item descriptions and provided his concurrence that this item falls under the definition commercial provided in subparagraph (3)(ii) of the commercial item definition in FAR 2.101. The Material Master within SAP indicates “Y” in the COTS field indicating that the technical community has decided that these items are commercial-off-the-shelf and/or are “of a type” commercially available. The SAPD 12/10/2025 Technical Certification is included as J&A Attachment #1.

6. Efforts to ensure that offers are solicited from as many sources as practicable are:

[X] A sources sought notice was issued on SAM.gov on 04/23/2025 and closed 04/29/2025.

[X] The acquisition will be synopsized on SAM.gov, for a period of 15 days.

[X] Dealers of the approved source(s) will be solicited.

[X] The solicitation will be posted on the DLA Internet Bid Board System (DIBBS) for a period of 30 days.

7. I hereby determine that the anticipated cost to the Government will be fair and reasonable.

The items of this solicitation have been determined of a type sold commercial; therefore cost & pricing data will not be required in accordance with FAR 15.403-1(c)(3). The basis for the Government’s fair and reasonable price determination is anticipated to be PPI based price analysis and/or the analysis of other than cost or price data such as informal cost break-downs and/or material invoices with final negotiated pricing reviewed in comparison with recent past reasonable purchases (adjusted for passage of time and quantity sensitivity), in addition to comparison to any available commercial market prices for potentially similar items, to support a reasonableness determination.

8. Market Research/Efforts to Obtain Competition:

A Sources Sought Notice was posted to www.sam.gov on 04/23/2025 and closed 04/29/2025 with an “interest” email received from BHPE (9SWS7) who provided no quote or market survey response. On 04/23/2025 the Contracting Officer was advised by of DLA Weapons Support (Columbus) Value Management (VE) that there are no new approved sources or open VE projects for these NSNs.

A formal market survey was conducted by DLA Weapons Support (Columbus) -ZBB Branch Contracting Officer on/during 04/23/2025 sending a survey to Thales Defense & Security (23386)

Other market research efforts included Contracting Officer review of the purchase history and internet market research. A review of GSAadvantage.gov was completed for active GSA contracts covering the project NSNs or their associated approved part numbers, but no active contracts were found. The information collected during the market survey is summarized as follows:

Thales Defense & Security (Thales) (23386): Thales Defense & Security is a large business manufacturer and a division of Thales SA (F6481) located in France. A market survey was completed by of Thales Defense & Security Aftermarket Support for prior LTC project CL24080003 containing 17 NSNs. Several NSNs from this initial project were deleted and/or later moved to separate LTC projects CL25252001 and CL25213001, but the survey response is applicable to all three (3) DLA LTC projects. The market survey responses indicated the following key information in addition to any online commercial product information obtained by the Contracting Officer.

- Thales Defense & Security is in Clarksburg. MD with over 1600 employees.

- Thales is interested in a DLA Long-Term Contract.

- Thales is the sole approved source of supply on all four (4) project NSNs.

- Thales does not consider these items commercial per FAR 2.101(b) as they are sold to the Government.

- Thales provided redacted commercial sales invoice #73202 to Brancor Aviation for PN 16005001, invoice #73204 to Allied Defense Industries for PN 1600629-1 (which appears a Government Sale), and invoice #72109 to General Technical Services for PN 1600787-1. All three (3) invoices showed quantities and customer names, but unit prices were redacted as Thales considers the price information proprietary.

- Thales confirmed that the antennas and accessories on this initiative are used on both the military specific AN/PRC-148 radio and other models including public available radio AN/PRC-6809.

- Thales currently holds DLA LTC SPE7LX21D0060 (expiring 12/30/2025) which includes the four (4) NSNs contained on CL25252001. Thales Defense & Security (23386) has provided these NSNs to DLA on delivery orders against LTC(s) since 2020. Unit pricing for the final contract performance period for these NSNs are shown in the chart below.

Commercial Determination: The items on this project have been determined by the Contracting Officer to be commercial and/or “of a type” items sold commercially in accordance with FAR 2.101. FAR Part 13.5 Simplified Procedures for Certain Commercial Items procedures will be used for acquisition and the SAP Material Master (MM03) COTS Field indicates ‘Yes’ for the project NSNs, indicating the technical community has made the recommendation to determine the items to be commercial or commercial of-a-type.

The Contracting Officer’s determination was supported by information obtained during market research for the 4 NSNs contained on this project and their availability for public purchase. Thales Defense & Security (23386) sells these antennas, power supply, and battery holders direct to the Government and via a network of approved distributors.

. All four (4) project NSNs are sole sourced to OEM Thales Defense & Security (23386) who also manufactures the end item they are used on (AN/PRC-148 broadband tactical radios (21M).

Thales manufactures its products for federal, state, and local governments along with commercial/industrial users. The AN/PRC-148 radio is restricted for sales only to the US Military due to its data/signal encryption, but it is similar to a commercially available Thales broadband radio under part# AN/PRC-6809 that shares similar physical, material, and operational characteristics without the NSA Type-1 encryption. Thales products and technical data can be found on their corporate website located at www.thalesDSI.com.

Approved source of supply and OEM Thales Defense & Security (23386) returned a complete DLA Weapons support (Columbus) market survey and is contained in the electronic contract file in Records Management.

Thales survey response indicated that the project items are not commercial in their opinion as the AN/PRC- 148 is military specific due to its encryption and is only sold to the Government. Further discussions with Ms.

Robin Little of Thales found that the AN/PRC-148 radio shares form-fit-function with their commercially available broadband radio AN/PRC-6809 that has no NSA Type-1 encryption and is available for non-military sales and share the spares included on this initiative without sales restrictions. Thales indicated that the radio antennas, power supply (charger), and battery holders included on this project are not specific to the AN/PRC-148 radios. These items meet the description “of a type” sold in the marketplace with common modification being the frequencies and encryption-levels required by end users and Thales sells them direct at www.thalesdsi.com and through authorized distributors on the internet.

Review of GSAadvantage.gov found no current Federal Supply Schedules (FSS) for the approved part numbers and/or NSN(s).

9. A listing of sources, if any, indicating an interest in the acquisition is:

23386 / Thales Defense & Security – Market survey response received.

9SWS7 / BHPE – Did not return survey response.

10. The following actions are being taken to overcome barriers to competition before any subsequent acquisition is made:

[ X ] The solicitation contains DLAD Procurement Note, L04 Offers for Part Numbered Items, which describes the process for submitting an alternate offer on the current procurement and requesting evaluation of an alternate product’s technical acceptability for future procurements of the same item.

DLA Weapons Support (Columbus) encourages vendors that may be interested in becoming an approved source, even if there is not an active solicitation, to contact the DLA Weapons Support (Columbus) Source Approval Monitor at DSCCAO-SAR@dla.mil for additional information on the steps required to submit a Source Approval Request Package for evaluation.

[ X ] Other:

Based upon the technical certification on file in DLA Weapons Support (Columbus) – VEP complete technical data for the project NSNs is not available and cannot be developed to permit full and open competition. The data presently available reflects the minimum needs of the Government.

The Government will continue to conduct market research to ascertain if changes occur in the marketplace that would enable future actions for this item to be competitive.

In the past, DLA Weapons Support (Columbus) has hosted Captains of Industries to bring in industry leaders for particular commodities or weapon systems to help decrease barriers for companies looking to become sources of supply.

A Sources Sought Notice has been issued on www.sam.gov for a minimum period of five business days.

Buyers continue to conduct market research to ascertain if changes have occurred in the marketplace that would enable items to become competitive.

Solicitations will be posted on www.sam.gov

In accordance with DFARS PGI 206.303-2.
