JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

ADDENDUM (attach copy of original J&A for add-ons or revisions)

1. The Defense Logistics Agency, DLA Land and Maritime, is the contracting activity.

2. The action being approved is the acquisition of supplies on other than a full and open competition basis. This DLA Land and

Maritime acquisition is for an Indefinite Quantity Contract (IQC) with firm fixed price for the duration of a 3-year base periods with 2 one-year option periods for a potential total of 5 years. This procurement is for multiple NSNs and supports end item(s) identified in the tables below and in Section B of the solicitation.

3. The supplies required to meet the using activity's needs are described as follows:

This initiative is to provide support for Weapon System(s) identified in the table below, for use by the Department of Defense.

The item(s) being procured is listed below and includes the Reference Number Category Code (RNCC), which is a code that designates the relationship of the part number to an item of supply. The Reference Number Variation Code (RNVC) which indicates that a cited part number is or is not item identifying or is for information only. The proposed acquisition is for a DLA-managed item(s) for which a small business identified in the table below is the only manufacturing source. The items being solicited are code and part number items with an Acquisition Method Code (AMC) / Acquisition Method Suffix Code (AMSC) of (3/D). The approved source is:

RNCC CODE:

3 - Design Control Reference. The primary number used to identify an item of production or a range of items of production, by the manufacturer (individual, company, firm, corporation, or government activity) which controls the design, characteristics, and production of the item by means of its engineering drawings, specifications, and inspection requirements, (when used to identify a reference number where the design control reference is no longer active (original design activity), the reference number will be coded with reference number variation code (RNVC) 9).

5 - Secondary Reference. Secondary reference. Any additional number, other than a primary number (codes 1, 2, 3, 4), informative reference (code 6) or vendor item drawing reference (code 7) assigned to an item of production or supply by a commercial or government organization, which represents the same item of production or supply to which the national stock number (NSN) was assigned. The reference number may have had an RNCC of 1, 2, 3, 4, or 7 but has since been replaced in the item-of-supply concept of the NSN by another primary number. Includes additional numbers assigned by the design control organization; superseded or discontinued reference numbers which may have resulted from: a manufacturer's change in numbering system; the manufacturer no longer produces the item or is no longer a technically approved source; the manufacturer or supplier for that number is out of business. Note: An RNCC 5 reference with a reference number variation code (RNVC) of 2 shall not be added to an NSN with a standard military drawing (SMD) or military specification coded RNCC-RNVC 2-2 unless the reference is registered on the qualified products list (QPL) for the SMD or mil spec.

(obsolete, superseded, cancelled, or discontinued reference numbers coded RNCC 5 shall be coded reference number variation code 9. All secondary reference extra-long reference number (ELRNS), whether current, (obsolete, superseded, cancelled, or discontinued, shall be coded RNCC 5 and RNVC 1).

4. The statutory authority permitting other than full and open competition is:

5. If restricted to the only source(s) of supply; include source(s) and CAGE code:

In-Mar Systems, Inc (0BJH3) is the only manufacturing source approved to obtain the data needed not being available to the Government. The same source listed above is the only manufacturing source that own the data rights to manufacture the item(s). The Government does not currently possess or have access to detailed technical data sufficient to provide a description of all required form, fit, and function characteristics of the part(s).

The AMC(s)/AMSC(s) is also listed below. AMC code(s) describes to the contracting officer and other Government personnel the results of a technical review of a part and its suitability for breakout, and AMSC code(s) provides the Contracting Officer and other Government personnel with engineering, manufacturing, and technical information. Pursuant to FAR 6.303-2(c), the SAPD Technical Personnel certified on 08/19/2021 that the supporting data, including the AMC(s)/AMSC(s) code(s) and approved source(s), is complete and accurate. Reference table below:

AMSC D: The data needed to acquire this part competitively is not physically available, it cannot be obtained economically, nor is it possible to draft adequate specifications or any other adequate, economical description of the material for a competitive solicitation. AMCS 3, 4, or 5 are valid.

A description of the Federal Supply Groups (FSG) and the Federal Supply Class (FSC) for the item(s) is listed below. The FSG is represented by the first two digits of the NSN and identifies, by title, the commodity area covered by classes within the group.

The FSC is represented by the first four digits of the NSN, and the code covers a relatively homogeneous area of commodities, in respect to their physical or performance characteristics, or in the respect that the item included therein is such as are usually requisitioned or issued together or constitute a related grouping for supply management purposes. 6. Efforts to ensure that offers are solicited from as many sources as practicable are:

The acquisition will be synopsized for 15 days prior to the solicitation opening on https://sam.gov/. At the conclusion of the synopsis period, the solicitation will be posted on the internet via the DLA Internet Bid Board System (DIBBS) for 30 days.

For this project, the Sources Sought was conducted by the Contracting Officer. A Sources Sought was issued on FedBizOpps on 10/08/2021 and closed on 10/18/2021. A market survey and an excel spreadsheet were provided for contractors to fill out for this posting. From the Sources Sought Notice, one response was received from Total Industrial Supplies, Inc.

(7XPT6) who provided a market survey and is interested in the LTC (Reference Attachment 1).

7. I hereby determine that the anticipated cost to the Government will be fair and reasonable.

Certified cost and pricing data is not required, as the dollar value of the requirement does not exceed the $2M threshold. Other than certified cost or pricing data may be requested if adequate price competition is not received. A price analysis will be conducted using historical pricing, the Producer Price Index (PPI) and learning curve analysis. By using the above techniques, the Contracting Officer anticipates that the cost to the Government will be fair and reasonable.

8. Market Research/Efforts to Obtain Competition:

Market Survey [10 U.S.C. 2304(f)(3)(D)]:

A Market Survey was conducted on/during: 08/18/2021 and 10/06/2021

Total number of vendors contacted: 12

Names of vendors responding: In-Mar Systems (0BJH3), Jag Components (7YJE4), Lecuyer Aviation (84E19), Mark Electronics, Inc. (0PPN6), Service Pump & Supply Co (0M502), Total Industrial Supplies, Inc. (7XPT6), V. Lopez Jr.

& Sons G.E.C., Inc. (44JG2)

Techniques used to conduct survey: Email to include a Market Survey questionnaire and an Excel spreadsheet and the posting of a Sources Sought Notice with a Market Survey questionnaire and an Excel spreadsheet attached.

Type of information requested: Inquired about the interest of pursuing a Long-Term Contract (LTC) for 5-year period to include delivery, cost and pricing data and commercial requirements.

Summary of information received: The SSS emailed 12 vendors the market survey: Am-Mac, Inc. (0VW10), Black Bay Aerospace (7QEZ4), In-Mar Systems (0BJH3), ITL, LLC (7BGA2), Jag Components (7YJE4), Lecuyer Aviation (84E19), Mark Electronics, Inc. (0PPN6), Service Pump & Supply Co (0M502), SIT Corp (1MQB3), Statz Corp (3WGD1), Talong Air (58CE0), and V. Lopez Jr. & Sons G.E.C., Inc. (44JG2), with two vendors providing a survey. V. Lopez Jr. & Sons responded with the spreadsheet only along with a cover sheet and pricing. Jag Components responded stating they would definitely be interested in a LTC for these products; that they are just a reseller so they can't answer the majority of the questions, and suggest contacting the manufacturer, In-Mar, to get the answers to these questions.

The current Contracting Officer emailed 9 vendors the market surveys: Am-Mac, Inc (0VW10), Black Bay Aerospace (7QEZ4), ITL, LLC (7BGA2), Mark Electronics, Inc. (0PPN6), Service Pump & Supply Co (0M502), SIT Corp (1MQB3), Statz Corp (3WGD1), Talong Air (58CE0), and V. Lopez Jr. & Sons G.E.C., Inc. (44JG2). Mark Electronics responded stating they no bid.

Service Pump responded stating they no bid as their relationship with In-Mar is completely ad hoc and they cannot reliably estimate pricing or availability and the risk is too high. I received an out of office response from Am-Mac (Reference Attachment 1).

Based on market research, a proposal is anticipated by In-Mar Systems, Jag Components, Lecuyer Aviation, and V. Lopez Jr.

& Sons.

Information received regarding the commerciality of the item(s): The requirement will be solicited based on FAR Part 15 procedures. Two market surveys indicate the item(s) as non-commercial and one as commercial. The Data Refresh Spreadsheet received from the Sourcing Strategy Branch ZAA and MM03 indicates the item(s) as non-commercial. A search online indicates the item(s) as non-commercial. The Contracting Officer has determined the item(s) to be non-commercial and a separate memorandum detailing this determination has been prepared and is included in the solicitation file.

9. Additional facts supporting other than full and open competition:

Based upon the technical certification on file in DLA Land and Maritime-VEP technical data is not available and cannot be developed to permit full and open competition. The data presently available reflects the minimum needs of the Government.

Forecast information is available to the potential source(s) for the source item(s). The DLA Supplier Requirements Visibility Application (SRVA) is a database that is available via the DLA Internet Bid Board System (DIBBS). SRVA provides potential sources the opportunity to search for information on DLA’s anticipated requirements based on updated monthly forecasts.

Essentially it provides 24 months of sole source and competitive projected purchase order quantities. Potential alternate sources for current source item(s) can easily see DLA’s forecasted procurements and can contact the Value Management Unit to become approved sources for sole source and code and part number item(s). The DLA Land & Maritime Value Management Unit continually seeks out sole source, limited competition, over-priced, low reliability and hard to buy items to improve their value and support posture. The DLA Land & Maritime Internet website contains information for all potential sources on how to challenge prices, how to submit a Value Engineering Change proposal, a link to DoD’s Value

Engineering program and the necessary contact info for both the DLA Value Engineering program and the DoD Value Engineering program.

All prior buys were under the SAT and no J&As were required.
