About this file

This is a Justification for Other Than Full and Open Competition (J&A) document supporting a sole-source/limited-source acquisition by the Defense Logistics Agency (DLA) Land & Maritime.

The procurement is for an Indefinite Quantity Contract (IQC) with firm fixed price covering a 3-year base period plus two 1-year option periods (5 years total) for a single National Stock Number (NSN 6140013742243): a 12-volt, 56-ampere-hour lead-acid rechargeable storage battery used in Mine-Resistant Ambush Protected (MRAP) vehicles, Joint Light Tactical Vehicles (JLTV), and 30 other military weapon systems. The item is governed by a source control drawing with only two approved manufacturing sources: Clarios, LLC (CAGE 0UJ55) and Battery Power Centre Australasia PTY, LTD (CAGE Z8H00). The justification cites 10 U.S.C. 3204(a)(1) as statutory authority for limiting competition, based on unavailable technical data preventing breakout to additional sources and the source-controlled nature of the item. The estimated basic annual demand is $31,009 with a three-year base total of $7,752 (values redacted in original document). The acquisition will be synopsized for 15 days on SAM.gov followed by 30-day posting on the DLA Internet Bid Board System (DIBBS). A market survey was conducted on 05/19/2025 contacting only Clarios, LLC, which responded positively. The item has been determined to be commercial under FAR Part 12. Two sources indicated interest: BHPE, LLC and Clarios, LLC. The document was approved by the Contracting Officer on 08/01/2025, Competition Advocate on 09/08/2025, and Head of Contracting Activity on 09/09/2025.

4. The statutory authority permitting other than full and open competition is:

10 U.S.C. 3204(a)(1): Available from only one or a limited number of sources

5. If restricted to the only source(s) of supply; include source(s) and CAGE code:

This item is governed by a source control drawing. Clarios, LLC (0UJ55) and Battery Power Centre Australasia PTY, LTD (Z8H00) are the only sources listed on the applicable source control drawing and, as such, are the only sources approved to manufacture the item. The Government does not currently possess or have access to detailed technical data sufficient to provide a description of all required form, fit, and function characteristics of the part. This item being solicited is a Storage Battery, specifically a Lead Acid Rechargeable Battery. This battery features a Voltage of 12V with an Ampere Hour Capacity of 56Ah. The Dimensions are 9.938 inches in length, 7.812 inches in height, and 6.750 inches in width. The Terminal Type is a Post; the Case Design is Sealed Plastic, and the Electrolyte is Lead Acid. This battery is commonly used in Mine-Resistant Ambush Protected (MRAP) vehicles and the Joint Light Tactical Vehicle (JLTV) 12. It is also compatible with 30 other weapon systems, making it a versatile power source for military operations.

The use of the authority cited is based on:

The AMC(s)/AMSC(s) is also listed below. AMC code(s) describes to the Contracting Specialist and other Government personnel the results of a technical review of a part and its suitability for breakout, and AMSC code(s) provides the Contracting Specialist and other Government c011802 Cross-Out c011802 Cross-Out c011802 Cross-Out

personnel with engineering, manufacturing, and technical information. Pursuant to FAR 6.303-2(c), the SAPD Technical Personnel certified on 05/02/2025 that the supporting data, including the AMC(s)/AMSC(s) code(s) and approved source(s), is complete and accurate (See Attachment 1). Reference table below:

AMC(s) AMSC(s)

AMC 1: Suitable for competitive acquisition for the second or subsequent time.

AMSC B: This part must be acquired from a manufacturing source(s) specified on a source control or selected item drawing as defined by the current version of DoD-STD-100. Suitable technical data, Government data rights, or manufacturing knowledge are not available to permit acquisition from other sources, nor qualification testing of another part, nor use of a second source part in the intended application. Although, by DoD-STD-100 definition, altered and selected items shall have an adequate technical data package, data review discloses that required data or data rights are not in Government possession and cannot be economically obtained. If one source is available, AMCs 3, 4, or 5 are valid.

If at least two sources exist, AMCs 1 or 2 are valid.

6. Efforts to ensure that offers are solicited from as many sources as practicable are:

The acquisition will be synopsized for 15 days prior to the solicitation opening on https://sam.gov/. At the conclusion of the synopsis period, the solicitation will be posted on the internet via the DLA Internet Bid Board System (DIBBS) for 30 days.

For this project, the Sources Sought was conducted by the Contracting Specialist. A Sources Sought was issued on SAM.gov on 05/15/2025 and closed on 05/26/2025. A market survey and an excel spreadsheet were provided for contractors to fill out for this posting. From the Sources Sought Notice, an auto response was received by BHPE, LLC (9SWS7) .

7. I hereby determine that the anticipated cost to the Government will be fair and reasonable.

Certified cost and pricing data is not required since the item has been deemed commercial under FAR Part 12—Acquisition of Commercial Items. In addition, since the item has been found to be commercially available to the general public, buyer will compare proposed prices to commercial prices. Uncertified cost or pricing data may be requested if adequate price competition is not received. A price analysis will be conducted using historical pricing, the Producer Price Index (PPI) and learning curve analysis. By using the above techniques, the Contracting Specialist anticipates that the cost to the Government will be fair and reasonable (See Attachment 2).

8. Market Research/Efforts to Obtain Competition:

Market Survey [10 U.S.C. 3204(e)(2)(D)]:

A Market Survey was conducted on/during: 05/19/2025

Total number of vendors contacted: 1

Names of vendors responding: Clarios, LLC (0UJ55)

Techniques used to conduct survey: Email to include a Market Survey questionnaire and an Excel spreadsheet and the posting of a Sources Sought Notice with a Market Survey questionnaire and an Excel spreadsheet attached.

Type of information requested: Inquired about the interest of pursuing a Long-Term Contract (LTC) for 5-year period to include delivery, cost and pricing data and commercial requirements.

Summary of information received: The SAPD Strategic Sourcing Specialists did not email the market survey to any vendors when the project was created.

Since no market surveys were emailed by the SAPD Strategic Sourcing Specialists, the Contracting Specialist emailed the market survey to the following source: Clarios, LLC (0UJ55) – formerly known as Optima Batteries, INC. (0UJ55). The approved source “Battery Power Centre Australasia PTY, LTD (Z8H00)” does not have any valid/existing business information within any of DLA systems. Clarios did respond with the survey and stated they are a large manufacturer that is interested in pursuing an LTC the item is commercial (See Attachment 3).

Based on market research, a proposal might be anticipated by BHPE, LLC and Clarios, LLC.

Information received regarding the commerciality of the item(s): The requirement will be solicited based on FAR Part 12 procedures. This item is of a type customarily used by the general public or by non-governmental entities for purposes other than governmental purposes, and has been offered for sale, lease, or license to the general public. The commerciality code on the Data Pull Spreadsheet received from the Sourcing Strategy Branch ZAA stated “N” and is the same within MM03.

The prior LTC (SPE7LX19R0142) was determined to be commercial as FAR Part 12 and the acquisition plan provided the findings. This LTC was awarded on contract (SPE7LX20D0048). Per PGI 212.102, the prior commercial determination shall serve as a determination for subsequent

procurements of such item. Since this item can be found by part number and are available for purchase by the public; the Contracting Specialist has deemed this item to be commercial, with the approval of the Supervisor. The BPA Pricing Office was not contacted for assistance. The commercial details and a separate memorandum detailing this determination are listed in Tabs 5 and 15, within the Stack 1 - Acquisition Planning & Solicitation file.

9. Additional facts supporting other than full and open competition:

Based upon the technical certification on file in DLA Land and Maritime-VEP technical data is not available and cannot be developed to permit full and open competition.

10. A listing of sources, if any, indicating an interest in the acquisition is:

BHPE, LLC (9SWS7)

Clarios, LLC (0UJ55)

11. The following actions are being taken to identify additional sources:

The solicitation contains Procurement Notes L22 “Restriction of Alternate Offers for Source Controlled Items.” The data presently available reflects the minimum needs of the Government.

Forecast information is available to the potential source(s) for the source item(s). The DLA Supplier Requirements Visibility Application (SRVA) is a database that is available via the DLA Internet Bid Board System (DIBBS). SRVA provides potential sources the opportunity to search for information on DLA’s anticipated requirements based on updated monthly forecasts. Essentially it provides 24 months of sole source and competitive projected purchase order quantities. Potential alternate sources for current source item(s) can easily see DLA’s forecasted procurements and can contact the Value Management Unit to become approved sources for sole source and code and part number item(s).

The DLA Land & Maritime Value Management Unit continually seeks out sole source, limited competition, over-priced, low reliability and hard to buy items to improve their value and support posture. The DLA Land & Maritime Internet website contains information for all potential sources on how to challenge prices, how to submit a Value Engineering Change proposal, a link to DoD’s Value Engineering program and the necessary contact info for both the DLA Value Engineering program and the DoD Value Engineering program.
