About this file

This is a Justification and Approval (J&A) document for a class exception to fair opportunity procurement under Federal Acquisition Regulation (FAR) Subpart 16.5.

The Defense Information Systems Agency (DISA) J-6 seeks class approval to issue multiple Communication Service Authorizations (CSAs) against the General Services Administration's Enterprise Infrastructure Solutions (EIS) Government-wide Acquisition Contract (GWAC) for special construction services supporting established telecommunications circuits at Fort Belvoir. The procurement is valued at $14,167,553 and covers 30 special construction projects to be awarded in fiscal year 2026. The special construction work involves implementing, rearranging, or relocating physical plant infrastructure—such as external cabling and fiber optic lines—necessary to deliver voice and data services from Verizon Business Network Services LLC's existing network solution task order (HC1013-22-F-0003) into Fort Belvoir buildings. Awards will be fixed-price with economic price adjustment task orders funded via Program Designator Code. The CSAs will be non-severable services and will be discontinued upon completion of construction.

The sole-source award to Verizon is justified as a logical follow-on to the competitively awarded network solution task order under FAR 16.507-6(b)(3). Verizon is the incumbent provider of all voice and data services at Fort Belvoir with a period of performance extending to July 30, 2032. Market research determined that only Verizon possesses the technical capability and infrastructure knowledge to seamlessly connect required services to buildings in the necessary timeframe. The J&A notes that recompeting would delay critical services by one or more years and that special construction requirements cannot be accurately estimated pre-award, as they are typically discovered during service implementation. Cost/price fairness will be determined using FAR 15.404-1 analysis techniques and historical pricing databases maintained by DITCO. The Procuring Activity Competition Advocate has approved this exception under Class Exception Number JA26-042.

JUSTIFICATION & APPROVAL (J&A) FOR FEDERAL ACQUISITION

REGULATION (FAR) SUBPART 16.5 ACQUISITIONS

EXCEPTION TO FAIR OPPORTUNITY

Multiple Award Schedule/Multiple Award Contract (MAC) Orders under MAC/ Fair Opportunity – FAR 16.507-2

Purchase Request Number: Ft. Belvoir Special Construction Contract Number: GS00Q17NSD3009 Task/Delivery Order Number: Multiple Communication Service Authorizations (CSAs) Procurement Title: Class J&A for Defense Information Systems Agency (DISA) J-6 Enterprise Infrastructure Solutions (EIS) Special Construction Estimated Value: $14,167,553 Statutory and Regulatory Authority: 10 U.S.C. 3204(a) and FAR 16.507-6(b)(3)

Class Exception to Fair Opportunity Number: JA26-042

Upon the basis of the following justification, I, as Procuring Activity Competition Advocate (PACA), hereby approve this exception to fair opportunity pursuant to the authority of FAR 16.507-6(b)(3)

1. REQUIRING AGENCY AND CONTRACTING ACTIVITY:

Requiring Agency:

DISA J-6

7010 Defense Pentagon, Washington, DC 20301

Contracting Activity:

DISA/Defense Information Technology Contracting Organization (DITCO) PS8214 2300 East Drive, Building 3600, Scott AFB, IL 62265-5406

2. NATURE/DESCRIPTION OF ACTION(S): The purpose of this J&A is to obtain class approval to issue multiple CSAs against the General Service Administration’s (GSA’s) EIS Government-wide Acquisition Contract (GWAC) for special construction in support of various established circuits for DISA J-6 Mission Partners (MPs) located in or around Ft. Belvoir. The CSAs will result in fixed price with economic price adjustment task orders funded via Program Designator Code (PDC).

All CSAs will be awarded in fiscal year (FY) 2026. As a non-severable service, CSAs will be discontinued upon completion of the special construction. The total ceiling of this class J&A is $14,167,553 based on the estimates provided in the attached Ft. Belvoir special projects spreadsheet. FY26 operations and maintenance funding will be provided for these extensions.

The applicable north American industry classification code is 517111 telecommunications.

3. DESCRIPTION OF SUPPLIES/SERVICES: The special construction work required will support circuits already in place on the EIS network solution task order HC1013-22-F-0003. As various MPs utilize these telecommunication services, individual CSAs must be issued to allow each MP to fund their portion of the effort. Special construction is defined on EIS as providing an access arrangement “through the implementation, rearrangement or relocation of physical plant” or to implement a different route “than that which the contractor would otherwise use to provide an access arrangement for the government”. In other words, infrastructure outside of the building such as cabling or fiber is currently insufficient to continue the services as needed inside of the building, requiring the contractor to construct additional infrastructure to properly support the established telecommunications services.

4. SUPPORTING RATIONALE, INCLUDING A DEMONSTRATION THAT THE

PROPOSED CONTRACTOR’S UNIQUE QUALIFICATIONS OR THE NATURE OF THE

ACQUISITION REQUIRES USE OF AN EXCEPTION TO FAIR OPPORTUNITY:

(a) Exception to Fair Opportunity. 16.507-6(b)(3) The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order.

(b) Justification.

(1) Description of the justification and discussion regarding cause of the sole source situation. Network solution task order HC1013-22-F-0003, competitively awarded to Verizon Business Network Services LLC, hereafter referred to as Verizon, provides all voice and data services necessary for Ft. Belvoir with a period of performance ending July 30, 2032. It has been found, in order to provide all the necessary voice and data services, special construction is needed. This special construction will build up the infrastructure outside of the buildings in Ft. Belvoir for the services to ride over and be delivered inside of the buildings.

Allowing for fair opportunity on EIS, the Department of Defense (DoD) Chief Information Officer (CIO) required contracting vehicle for telecommunications services, was considered but found not to be feasible. As Verizon is the current provider of the network solution services and must connect those services to their infrastructure to make them operable, only Verizon can provide a seamless and cost-effective solution to connect the services to the buildings. Given this, and the special construction requirements’ direct tie to the network solution task order, the only viable solution is to award this effort as a logical follow-on to the previously competed

network solution task order.

(2) Minimum Government requirements. Verizon will provide special construction services in support of the data and voice telecommunication services being provided on task order HC1013-22-F-0003. The scope of this effort is to provide 30 special construction efforts at Ft. Belvoir as referenced in the Ft. Belvoir Special Projects attachment. The period of performance on the TSR based awards will begin at the time of award in fiscal year FY26, and last until special construction is complete as it is non-severable in nature.

(3) Proposed sole source contractor and demonstration of unique source. The proposed sole source contractor is Verizon as they are the sole provider of the existing EIS services at Ft. Belvoir. Recompeting the network solution task order is not a viable solution as it would delay providing the mission critical voice and data services at Ft.

Belvoir by a year or more and given the nature of unknown special construction required for a new contractor to build infrastructure, the cost of it cannot be known prior to award. It is only once a service is awarded to a contractor, and the contractor begins the process of delivering the service, that it is found special construction is needed and the costs can be ascertained; it is after the fact, making it impossible to determine a not to exceed amount to build into any contract ahead of time.

(4) Procurement discussion. This action allows for the delivery of the ordered and required services on network solution task order HC1013-22-F-0003; it is the vehicle for which the services will be delivered to the various locations at Ft. Belvoir.

(5) Impact. If Verizon is not selected to complete the special construction projects it will lead to a delay in critical services being deployed, increased cost overruns, and additional time for the Government to onboard personnel with the appropriate clearance levels. Verizon manages the base cable plant and the EIS circuits and are best suited for this specific requirement.

5. COST/PRICE FAIR AND REASONABLE DETERMINATION: A determination will be made by the Contracting Officer that the action represents the best value to the Government by conducting both a technical and price evaluation as part of a fair and reasonable price determination. The Government will utilize the various price proposal analysis techniques described in FAR 15.404-1. Both the DITCO PS821 Contracting Branch and PS842 Cost and Pricing Branch have databases that contain historical pricing information on all other special construction efforts found fair and reasonable on EIS since 2019. This will prove as a resourceful tool in comparing pricing for labor and materials for future special construction efforts, including Ft. Belvoir’s.

6. MARKET RESEARCH: Based on current market research conducted by the requiring activity in 2026, it has been determined only Verizon can fully support the Government’s need. The Government has determined that only the provider of the services on the Ft. Belvoir network solution task order, Verizon, can technically provide the infrastructure for the services to ride over. The infrastructure to be provided via special construction is what the services within the

Page 4 of 5 Pages

CUI

various Ft. Belvoir buildings will directly connect into and ride over; the infrastructure is service enabling and work together.

Market research further indicated that Verizon is the only contractor at this time with intimate knowledge and appropriate technical personnel to provide the infrastructure to support the required voice and data services in the timeframe necessary to provide required support. It was through Verizon trying to install services at the locations annotated in the Ft. Belvoir Special Projects attachment that it was determined additional infrastructure was needed, which is often a requirement when establishing an expanding network. This is a logical follow-on effort to enable the delivery of the network services ordered on HC1013-22-F-0003, and it would not be feasible to re-compete the entire network as offerors would not be able to estimate the extent or cost of special construction needed to deliver the services prior to award. For offerors to estimate special construction ahead of time, physical site surveys would need to be done at each location, which includes surveying underground fiber. This is usually a post-award incurred cost and is not an industry standard or practice to complete these types of surveys pre-award due to the cost.

7. ANY OTHER SUPPORTING FACTS: This logical follow-on ensures the Government receives the services needed in a timely manner. The EIS network solution task order currently in place for Ft. Belvoir was awarded to transition voice and data services off GSA’s expiring Washington Interagency Telecommunications System (WITS) III contracts, and that transition took over three years to complete. Ft. Belvoir procured additions/upgrades of critical services to the network on this task order, but efforts are currently stalled due to the need for special construction. A recompete would require another transition of services off one contract vehicle onto another, delaying the delivery of critical services by additional years.

8. ACTIONS THE AGENCY MAY TAKE TO REMOVE OR OVERCOME BARRIERS

THAT LED TO THE EXCEPTION TO FAIR OPPORTUNITY:

(a) Procurement History. Ft. Belvoir’s network solution task order HC1013-22-F-0003 was initially competed amongst nine GSA EIS contractors. Verizon Business was awarded the task order on October 26, 2021, with a period of performance consisting of a 1-year base period, 12, 1-year option periods, and 1, 9-month option ending on July 30, 2032.

(b) Upon completion of turning up the remaining network solution, requiring special construction, this requirement ends. No additional follow-on action to the task order of this type is anticipated.

(c) While the related prior award HC1013-22-F-0003 network solutions task order was accomplished without the need for an exception to fair opportunity, the required special construction to support that award cannot be done in the same manner. Services on the task order cannot be fully delivered without the special construction for added infrastructure being completed. As Verizon Business is the provider of the services on the task order, it also needs to be Verizon Business providing the service enabling infrastructure.
