About this file

This document summarizes a justification for other than full and open competition (J&A) and related federal contract opportunity. The J&A supports a bridge contract award for Approved Products Certification (APCO) and Transport Services (IE) support services from February 3, 2023 through September 2, 2024, with four two-month option periods. The incumbent contractor, enGenius Consulting Group, will provide continued APCO and IE support services, which include maintaining the APCO to support the DoD Approved Product List process and developing and operating the product tracking system. The Defense Information Systems Agency requires these services to certify communication equipment connectivity to the DoD Information Network and Defense Information Systems Network. The bridge contract is necessary because task order expiration and new requirements are delaying follow-on awards. The total bridge contract value is estimated at $15 million utilizing Fiscal Years 2024 and 2025 funds.

JUSTIFICATION FOR OTHER THAN FULL AND

OPEN COMPETITION (OTFAOC)

Federal Acquisition Regulation (FAR) Part 6 Justification & Approval (J&A), Supporting Procurements under FAR Part 12, and FAR Part 15

Purchase Request Number: To be Determined (TBD) Contract Number: TBD Task/Delivery Order Number: Not Applicable Procurement Title: Approved Products Certification (APCO) and Transport Services (IE) Support Estimated Value:

Statutory and Regulatory Authority: 10 U.S.C. 3204(a)(1) and FAR 6.302-1

Justification for OTFAOC Number: JA24-023

Upon the basis of the following justification, I, as Procuring Activity Competition Advocate, hereby approve the use of other than full and open competition of the proposed contractual action pursuant to the authority of FAR 6.302-1.

1. REQUIRING AGENCY AND CONTRACTING ACTIVITY

Requiring Agency:

Defense Information Systems Agency (DISA) Program Executive Office (PEO) Transport Services Directorate (IE)/Mission Support Division (IE6) 6910 Cooper Ave Fort Meade, Maryland 20755

Contracting Activity:

DISA/Defense Information Technology Contracting Organization (DITCO)/PL8313

2300 East Drive Building 3600 Scott Air Force Base, Illinois 62225

2. NATURE/DESCRIPTION OF ACTION(S): As a result of reorganizations within DISA and DISA IE restructuring efforts, a contract strategy was developed to better allow for an integrated approach and reduction of redundant services across the directorate. This revised contract strategy has resulted in a delay of requirements generation for affected contracts/orders and their follow-on efforts. This proposed bridge contract action will extend current support for the APCO and IE Support requirement to allow time to complete the realignment of tasks into existing or new contracts/task orders without a loss or delay of support ensuring the continuity of mission critical APCO and IE support services to DISA and the Department of Defense (DoD) community.

The current task order, GS06F0625Z / HC102818F1471, supporting the APCO and IE support expires on February 2, 2024. This task order was competitively awarded as a small business set-

APCO and Transport Services Support-JA24-023

Page 2 of 6 Pages aside under the General Service Administration’s (GSA) Alliant Small Business (SB) Government Wide Acquisition Contract (GWAC) vehicle. However, the GSA Alliant SB GWAC contract ordering period ended February 2, 2019, and task orders may not go beyond February 2, 2024. As such, the bridge action will result in a new contract award rather than an extension of the existing task order.

The projected period of performance (PoP) for the bridge is a seven-month base period (February 3, 2023 – September 2, 2024) with four, two-month option periods (September 3, 2024 – May 2, 2025).

The total estimated lifecycle value of the Firm Fixed Price (FFP) with Cost Reimbursable (CR) travel bridge will be ( in labor, in other direct costs/travel, and in surge support) and will utilize Fiscal Years 2024 and 2025 Operations and Maintenance (O&M) funds.

3. DESCRIPTION OF SUPPLIES/SERVICES: This action is for the procurement of mission critical APCO and IE support services to DISA IE which provide oversight and continuity of approving authority for all Military Departments and DoD agencies in the acquisition of communication equipment that is to be connected to the DoD Information Network (DODIN) and the Defense Information Systems Network (DISN), with an increased level of confidence through Interoperability and Cybersecurity (IO/CS) certification. These services include maintaining the APCO in support of the DODIN Approved Product List (APL) process and developing, operating, and maintaining the APL Integrated Tracking System which tracks and stores information regarding DoD APL IO/CS testing status to include real time contractor product plans. Failure to provide these APCO and IE support services would be devastating to the warfighter and have worldwide ramifications. Specifically, this could result in mission failure and unnecessarily endanger lives.

Due to the breadth and depth of the requirements, no alternate contractor can develop the work force necessary to replace the current support team and achieve an initial satisfactory level of support expeditiously. The PoP for the bridge is a seven-month base period (February 3, 2023 – September 2, 2024) with four, two-month option periods (September 3, 2024 – May 2, 2025).

4. IDENTIFICATION OF STATUTORY AUTHORITY: Only one responsible source and no other supplies or services will satisfy agency requirements. 10 U.S.C. 3204(a)(1) (FAR 6.302-1/DFARS 206.302-1)

5. DEMONSTRATION OF CONTRACTOR’S UNIQUE QUALIFICATIONS: The enGenius Consulting Group, Inc (enGenius) team has been instrumental in ensuring all new products to be implemented into the DISN and DODIN are tested, certified, and operable in accordance with the APL process prior to connecting to the network. The enGenius team is uniquely qualified because they possess specific expertise and capabilities to meet the Government’s objective.

(a) Description of events.

The current requirement was competitively awarded as a small business set-aside using the GSA Alliant SB GWAC, the contract vehicle used for Global Information Grid Service Management (GSM) Projects and Support (P&S) capabilities. The Alliant Small Business GWAC ordering period ended on February 2, 2019, with all task orders requiring an ultimate completion date of February 2, 2024.

Efforts are currently ongoing to pursue two new competitive task orders. DISA IE is finalizing a performance work statement mapping document to outline the acquisition strategy

Page 3 of 6 Pages for its portfolio. Relevant task areas from this requirement will move to new task order #1, Transport Services Strategic Advisory Support (TSSAS), and new task order #2, Cybersecurity Technical and Analytical Services (CTAS).

New Task Order #1: TSSAS: New requirement - provide Strategic Programming, Planning and Advisory Support services. Requirement is in development phase, market research needed to finalize the strategy. Projected award date is July 12, 2024, based on the complete/actionable package received by December 15, 2023.

Anticipated Contract Strategy: To be determined Anticipated PoP: one-year base period with four, one-year options Estimated Task Order Value: ( with 25% surge of ) Funding type: O&M, DISA Defense Working Capital Funds (DWCF)

New Task Order #2: CTAS: New requirement - provide monitoring for the life cycle of DISA systems, DISN, major supporting and connecting programs, systems, and networks for the purpose of identifying and resolving security issues. Work includes ensuring compliance with the applicable Risk Management Framework (RMF) / Director of Central Intelligence Directive (DCID) security requirements, directives, and regulations, ensuring that the programs, systems, and networks define and maintain appropriate security environments as defined in the RMF/DCID. Projected award date is April 12, 2024.

Contract Strategy: GSA Multiple Award Schedule (MAS) Historically Underutilized Business

Zone (HUBZone) set-aside Anticipated PoP: one-year base period with four, one-year options Estimated Task Order Value: ( with 50% surge of ) Funding type: O&M, DISA DWCF

The bridge will be awarded for up to 15 months which will allow adequate time for the award of CTAS and TSSAS, resolve potential protests, and transition efforts to the new contractors.

(b) Justification.

(1) Minimum Government requirements. The Government requires services in order to continue testing and certifying equipment prior to being connected into the DISN or DoDIN network. The service requires contractor interaction and engagement with the testing lab to ensure operable equipment.

(2) Proposed sole source contractor. EnGenius, the incumbent on the existing task order, is the only source that can continue to fulfil this requirement within the necessary time frame and without risk of substantial break in support to DISA and its mission partners.

EnGenius has been providing APL support services since the inception of the APL Program in 2018. EnGenius has the historical background and a uniquely qualified team to fulfill these contract requirements with extensive past and present subject matter expertise. In addition to the APL program, the enGenius team provides additional high-level support on the Next Generation 911 Support system for the Army. This system will be implemented throughout the entire DoD, Agencies and Services.

(3) Discussion regarding cause of the sole source situation. Efforts are currently ongoing to pursue restructuring of contract requirements, including two new competitive task orders.

DISA IE is finalizing a performance work statement mapping document to outline the

Page 4 of 6 Pages acquisition strategy, which will ultimately determine the timeline for award of the new task orders.

(4) Impact. Failure to maintain the contractor support continuity provided by enGenius until the previously discussed actions can be awarded and transitioned will result in a loss of continuity of services and cause detrimental effects as it will negatively impact mission-critical functionality and services to military operations. Specifically, this could result in mission failure and unnecessarily endanger lives. The current contractor provides highly specialized and critical support to DISA and DISA’s mission partners, and a gap in service would cause a decline in quality of services to DISA and its mission partners.

6. CONTRACT OPPORTUNITIES ANNOUNCEMENT/POTENTIAL SOURCES: This bridge action will be completed as a sole source award to enGenius. This bridge action will be synopsized and posted to SAM.gov in accordance with FAR 5.201.

7. DETERMINATION OF FAIR AND REASONABLE COST: A price analysis will be conducted prior to contract award to ensure the prices paid represent a fair and reasonable cost to the Government in accordance with FAR 15.404-1, Proposal Analysis Techniques. The contracting officer will make a determination that the price is fair and reasonable upon completion of negotiations.

8. MARKET RESEARCH: EnGenius is the only contractor at this time with the requisite knowledge and technical personnel capabilities to support the requirement in the timeframe necessary for uninterrupted support. Market research is currently in process for the new task order #1, TSSAS, and it is expected that this requirement will be competed among small business vendors allowing for fair opportunity. Market research for new task order #2, CTAS, has been conducted and based on the results this requirement is being competitively solicited allowing fair opportunity under the GSA’s MAS as a HUBZone set-aside. However, it is not currently feasible to award the follow-on task orders prior to the expiration of the current task order. The Government has determined that the current level of support can only be provided by the incumbent.

Therefore, enGenius is the only responsible source that can satisfy the agency requirements without risk of a substantial break in support.

9. ANY OTHER SUPPORTING FACTS: None.

10. LISTING OF INTERESTED SOURCES: The Government issued two sources sought notices in November 2022 while initiating market research for new task orders, TSSAS and CTAS, which will include the support being provided by current task order, GS06F0625Z / HC102818F1471. Sources sought notice #832369136, was posted on SAM.gov on November 2, 2022 and sources sought notice #832369148, was posted to SAM.gov on November 9, 2022. Additionally, these sources sought notices were shared with both large and small business ENCORE III contractors. Sources sought notice #832369136 resulted in 44 vendors submitting responses and sources sought notice #832369148 resulted in 15 vendors submitting responses. Based on sources sought notice #832369136, the Government identified multiple vendors in multiple socio-economically disadvantaged groups that can meet the requirements. Sources sought notice #832369148 indicated that there are small business vendors who are interested in this requirement and may be able to meet or partner to meet the capabilities required. As a result of the Government’s analysis, the

Page 5 of 6 Pages

Government determined that the CTAS task order will be procured using the GSA MAS contract vehicle and will be a HUBZone set-aside. Additional market research is required for the TSSAS task order and is currently on-going.

11. ACTIONS THE AGENCY MAY TAKE TO REMOVE OR OVERCOME BARRIERS THAT

LED TO THE EXCEPTION TO FULL AND OPEN COMPETITION:

(a) Procurement History.

Contract/TO Number: GS06F0625Z / HC102818F1471

Brief Description: APCO and IE Support

Contractor: enGenius Consulting Group, Inc Business Type: Small Business Life Cycle Contract Value: $33,747,350

Period of Performance (including all options and FAR 52.217-8):

September 29, 2018 – February 2, 2024

Contract Type: FFP and CR travel

Basis of Award: Competitively awarded as a small business set aside against the GSA Alliant Small Business

GWAC.

(b) An exception to fair opportunity or full and open competition has not been accomplished for any prior procurement for this requirement. All actions for this work have been completed as competitive small business set asides, and there is no anticipation to change this approach. As discussed above, the Government is still conducting market research for new Task Order #1 and has solicited new Task Order #2 using the GSA MAS contract vehicle as a HUBZone set-aside. The support currently being provided by GS06F0625Z / HC102818F1471will be included in those two new requirements.
