JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY
Number: JA20-129
Upon the basis of the following justification, I, as Procuring Activity Competition Advocate, hereby approve the use of other than full and open competition of the proposed contractual action pursuant to the authority of FAR 16.505(b)(2)(i)(B).
1. REQUIRING AGENCY AND CONTRACTING OFFICE:
Requesting Agency:
Defense Information Systems Agency (DISA) Development Business Center (DBC) Services Directorate (SD), SD5 6910 Cooper Ave.
Fort Meade, MD 20755 Contracting Activity:
DISA/Defense Information Technology Contracting Organization- National Capital Region (DITCO-NCR), PL62 6910 Cooper Ave.
Fort Meade, MD 20755
2. NATURE/DESCRIPTION OF ACTION(S): The nature of this action is to award a sole source hybrid firm-fixed-price (FFP) and cost-plus fixed-fee (CPFF) systems engineering task order for the Joint Planning and Execution Services (JPES) Systems Engineering (SE) efforts with a period of performance (PoP) of a four month base period and one, two month option period. The PoP for the current contract ends August 7, 2020. This contract action will provide the required support for an additional six months, if all options are exercised. The PoP of the contract action will be August 8, 2020 – December 7, 2020, with an option for additional services from December 8, 2020 through February 7, 2021. This contract action will ensure continued support during the protest period of the follow-on contract. The JPES SE efforts actively provide systems engineering support with an emphasis on system administration, security engineering, and configuration management to sustain and maintain the existing JPES baselines that the Program Management Office (PMO) is required to keep in an operational state.
The JPES baselines consist of the Joint Operations and Planning System (JOPES), Joint
Joint Command and Control (C2) Capabilities Systems Engineering Bridge-JA20-129
Capabilities Requirements Manager (JCRM), JPES Framework (JFW), and JPES capability.
Fiscal Year (FY) 2020 Operation and Maintenance (O&M) funding will be used.
3. DESCRIPTION OF SUPPLIES/SERVICES: Continuity of services is required for support to the JPES PMO. JOPES is an Acquisition Category III program. JOPES is the integrated Joint Command and Control system used to develop situational awareness and support military operations planning, execution, and monitoring activities for both conventional and nuclear situations (including theater-level nuclear and chemical defense plans). JCRM application provides the integration of complementary force assignments, apportionment, and allocation processes into a single Global Force Management process in support of the National Defense Strategy. JFW is composed of software “infrastructure” components that provide management, storage, and access to authoritative planning data. Data objects are exposed through secure Simple Object Access Protocol based web services and synchronized with other planning databases and geographically distributed nodes. JFW also includes a separate business rules engine and a workflow manager that supports Adaptive Planning & Execution processes. JPES enables DISA to transition from the current JOPES Information Technology System to a series of integrated capabilities that evolve current, disparate planning capabilities into a fully integrated, interoperable, and collaborative joint solution. JPES provides the Generic Schema, which allows external user to keep a local copy of Time-Phased Forced and Deployment Data, carrier, reference, and user permission data, and integrates with the JFW, which provides the back-end data store, attribute-based access control, and the services layer that will replace the infrastructure of the existing JOPES operational system.
The JPES PMO is specifically tasked with providing SE support for the Joint C2 portfolio of programs and projects within SD. The intent of this requirement is to procure specific services to implement and support a systems engineering and integration process for the development of C2 capabilities based on the Joint C2 Objective Architecture. Specifically, the following services are required:
• Developmental and Non-Developmental Engineering support needed to produce Joint C2 capabilities for the Services Development Directorate
• Joint C2 Systems Engineering Process support and analysis, configuration management policy and procedures, developmental and non-developmental configuration management, technical experiments and investigations
• Joint C2 developmental and non-developmental integration activities support
• Joint C2 Global Configuration Network (GCN) Enclave support for maintaining and sustaining all its supported
The current contract expires on August 7, 2020. This effort was re-competed as a fair opportunity requirement utilizing Federal Business Opportunities (FBO) as a 100% small business set aside. On June 12, 2020, the follow-on contract, HC1047-20-D-0002, was awarded.
A bid protest was submitted in a timely manner to trigger an automatic suspension of performance of the follow-on contract pending resolution of the protest in accordance with FAR 33.103(f)(3). The extension of the required services via a new contract action will allow for continued support of this vital program during the protest period, while retaining the ability to provide a consistent level of effort for the JPES PMO, DISA, and its stakeholders without a break in service.
The estimated cost of support for this contract action is which includes all labor categories, with the exception of Task Areas 2 and 5 from the existing contract HC1028-18-D- 0013/ HC1047-19-F-6241. The anticipated PoP for this bridge contract will have a four month base period and one, two month option period.
4. IDENTIFICATION OF THE EXCEPTION TO FAIR OPPORTUNITY:
(a) Exception to Fair Opportunity. The following exceptions apply to exception to fair opportunity accomplished IAW 16.505(b)(2)(i)(B). Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized.
(b) Justification.
(1) Minimum Government Requirements. The JPES PMO and its stakeholders all depend on daily services currently rendered by the incumbent contractor such as such as engineering support, configuration management, and deployment support to those projects in maintenance, sustainment, or operations & support (e.g. JOPES, JCRM, JFW, & JPES capabilities).
(2) Proposed sole source contractor. Due to the bid protest filed on the follow-on effort, Leidos Innovations Corporation is the only source that can fulfill this requirement without risk of a substantial break in service/support to the JPES PMO. The current contract supports the C2 systems and Senior DoD Officials by providing synchronized operations from dispersed locations and provides joint Command, Control, Communications, Computers and Intelligence. In addition, the contract supports the entire force projection cycle while providing responsive command and control. The current effort has the capability to assess the level of success and retain flexibility to re-engage with precision by allowing the Joint Task Force commander the ability to maintain dominant battlefield awareness through a fused, integrated, near real-time picture of the battle space.
(3) A sole-source action is necessary due to a protest filed in response to the award of the follow-on contract, HC1047-20-D-0002. If a bid protest had not been received, this contract action would not be necessary.
5. COST/PRICE FAIR AND REASONABLE DETERMINATION: During source selection of solicitation number HC1047-19-R-0007, a cost/price evaluation was conducted in accordance with FAR 15.404. The contract prices were determined to be reasonable. The proposed cost/prices for the bridge contract action will be compared to the current contract prices as well as the Independent Government Cost Estimate and the proposed prices for the follow-on effort in order to determine fair and reasonableness.
6. MARKET RESEARCH: This contract action is required to ensure continued support until the protest and transition period of the follow-on contract are complete. Market research was conducted for the follow-on contract which was conducted within the last 12 months. The market research identified potential sources which enabled the follow-on contract to be conducted as an open market small business set-aside. Per the DARS 10.002 Procedures, (S- 91)(2), market research is not required for bridge contract actions.
7. ANY OTHER SUPPORTING FACTS: None
8. ACTIONS THE AGENCY MAY TAKE TO REMOVE OR OVERCOME BARRIERS
THAT LED TO THE EXCEPTION TO FAIR OPPORTUNITY:
(a) Current Contract: HC1028-18-D-0013/ HC1047-19-F-6241
(b) Status: Expires August 7, 2020. Competitive fair opportunity competition was completed for follow-on. Award announced June 12, 2020. Stop-work order was issued on June 23, 2020 due to a bid protest.
