(b) Description of the Justification. HC1028-08-D-2012-0007 expires on November 20, 2019; a bridge action is required to prevent disruption of services while the competitive follow-on effort is awarded. Market research was first conducted by DISA ID and these results determined that General Services Administration Alliant would be an appropriate contract vehicle to procure the follow-on effort. Further market research was completed by DITCO and it was determined that ENCORE III Full and Open suite was better suited for the requirement. Due to these changes in the contract vehicle and unforeseen administrative delays, it is in the best interest of the Government to continue existing DIBNet services under the current TO. This sole-source bridge TO is required to continue critical DIBNet services until the new competitive TO is awarded. Currently, the DIBNet re-compete is in the source selection phase with a projected award date of March 1st, 2019.
Due to time constraints, it is not in the Government’s best interest to provide continued coverage under any term than the proposed sole source extension to the current contractor. It is unreasonable to assume any contractor awarded this effort would be able to provide DIBNet support with any resemblance of success in the short amount of time required. The scope of requirements to be provided under the bridge remain unchanged from the requirements currently provided under HC1028-08-D-2012-0007.
(c) Justification.
(1) Minimum Government requirements. The contractor will provide DIBNet support services at its current level of effort under HC1028-08-D-2012-0007, which ends on November 20, 2019, in support of the DoD beginning November 21, 2019. The scope of the DIBNet is a critical web-based tool that enables program participants to exchange classified and unclassified cyber threat information and collaborate with the DoD DC3 on a daily basis. The DIBNet bridge will continue to provide systems engineering and the technical assistance for the continued development and deployment of DIBNet-U and DIBNet-S capabilities. This bridge is required to ensure that there is no lapse in providing critical DIBNet services until award of the follow-on effort is complete.
(2) Proposed sole source contractor. Solers, the current contractor, has been instrumental in supporting the DoD’s DIBNet requirements over the life cycle of HC1028-08-D-2012- 0007 and is the only capable source to continue to provide the necessary services without any degradation to DIBNet and within the short timeframe, given performance is required November 21, 2019. Solers already has skilled, trained staff in place performing the necessary support. Moreover, transition with the institutional knowledge from Solers to the new contractor is key to carrying DIBNet forward successfully.
(3) Discussion regarding cause of the sole source situation. The FAR 52.217-8 six-month extension to HC1028-08-D-2012-0007 will be exhausted on November 20, 2019. The support that Solers provides to DIBNet is critical, and a break in service could prove to be detrimental; therefore, a bridge extending services to HC1028-08-D-2012-0007 is in the best interest of the Government. A competitive award to another source would likely result in substantial duplication of cost to the Government that would not be recovered
Page 4 of 6 Pages from competition and would also result in unacceptable delays in continuation of services as it would take a minimum of 30 days to release a solicitation, obtain proposals and complete source selection. The estimated cost for a bridge to the current TO is
. The requiring activity compared the labor rates currently awarded on HC1028-08-D-2012-0007 to the labor rates used in developing the Independent Government Cost Estimate for the follow-on effort, which were based on current market rates for the DIBNet TO, and found the rates were appropriately estimated based on the year-to-year inflation from when the current TO was originally awarded in 2015.
(4) Demonstration of unique source. Although market research identified other sources capable of providing the required technical support, Solers is uniquely postured to provide DIBNet services without loss of time or work stoppage as Solers understands the requirements and currently possesses the requisite expertise and relevant experience.
Minimally, any other contractor would have to first understand the scope of the DIBNet system’s highly technical requirements, recruit personnel with specialized qualifications, and receive clearance for the new personnel to support the effort before technical support services could continue. This would result in unacceptable delays to the continued support efforts of the DIBNet systems.
(5) Procurement discussion. The acquisition process was impacted due to change in requirements and a change in the contract vehicle. The nature, scope, and criticality of the work in support of DIBNet provided by Solers remain constant. Any lapses or delays would result in the mission failure of DIBNet. Services are needed beyond November 20, 2019 and prior to award of the follow-on effort; hence, it is logical and in the Government’s best interest for Solers to continue to provide these services until DISA/DITCO can execute a competitive follow-on effort that aligns with the scope required and current policies and regulation.
(6) Impact. A bridge award to any other contractor that does not have the institutional knowledge, expertise, and unique skill set would potentially place an additional financial burden on the DIBNet effort and the Government. The DoD would lose the ability to conduct information sharing and collaboration with the Defense Industrial Base partners.
Continuing to contract with Solers will create the best value to the Government by using the contractor’s institutional knowledge, expertise, and unique skill sets and providing the solution with the least technical and cost risk.
5. COST/PRICE FAIR AND REASONABLE DETERMINATION: A price evaluation will be accomplished to determine price fair and reasonable at TO modification. The contracting officer will use established ENCORE II fixed price labor rates on Solers basic TO, historical data on the current TO, and comparison to the independent Government cost estimate to the price proposal.
6. MARKET RESEARCH: DISA ID conducted market research for the follow-on effort. A sources sought notice was published on Federal Business Opportunities.gov from June 13, 2018 through August 9, 2018. Approximately 23 contractors responded to the sources sought. Based
Page 5 of 6 Pages on the results of the sources sought and historical knowledge of the current TO the market research has demonstrated the large business market possesses the required capability and capacity to satisfy the requirements of this effort. Based on the analysis, the ENCORE III Full and Open suite was determined the most appropriate vehicle. The Government is currently recompeting the requirement based on the market research findings. However, as a result of the delay in the acquisition schedule, it is not currently feasible to award the subject TO to another contractor in sufficient time to avoid a break in service. Based on the result of market research, the Government has determined that the current level of support can only be provided by the incumbent, who has been the primary technical support contractor. Solers is the only source that can continue providing the level of support required without risk of a substantial break in support of the DIBNet support services.
7. ANY OTHER SUPPORTING FACTS: None.
8. ACTIONS THE AGENCY MAY TAKE TO REMOVE OR OVERCOME BARRIERS
THAT LED TO THE EXCEPTION TO FAIR OPPORTUNITY:
a) Procurement History. HC1028-08-D-2012, TO 0007 was awarded on September 27, 2013 to Data Systems Analyst, Inc. by DISA/DITCO as a fair opportunity competitive action under the ENCORE II Multiple Award Contract vehicle. After protest and re-evaluation, this TO was reawarded to Solers on March 13, 2015. In May 2019, and in accordance with FAR 52.217-8, the TO was extended for a six-month period. Final performance expires on November 20, 2019.
b) An exception to fair opportunity or full and open competition has not been accomplished for any period procurement for this requirement. The requirements covered under the DIBNet effort are currently being recompeted.
