PD 06-01, Rev. 004 E3 Limited Source Justification Format

Tracking Number: JA18-0014 Bridge Number:

Justification and Approval for “Limited Source Justification” FAR Part 8.405-6

1. Identification of the agency and contracting activity: Defense Health Agency, Contracting Office – Falls Church (CO-FC), 7700 Arlington Blvd, Falls Church, VA 22042.

This is a Limited Source Justification (LSJ) for the DHA Manpower & Organization (M&O) Division acquisition, under the authority of Federal Acquisition Regulation (FAR) 8.405-6, “Limiting Sources.”

The Contracting Activity responsible for this action is the Defense Health Agency, Contracting Office – Falls Church (CO-FC), 7700 Arlington Blvd, Falls Church VA 22042.

2. Nature and/or description of action being approved: Approval is requested for a bridge contract action (bridge) to support the existing level of effort. There is no new work or change to scope as described in Paragraph 3 below. The delivery schedule and period of performance will be for a period of six (6) months, from 30 December 2017 to 29 June 2018. The contract will have a one-month base period and five (5) one-month options periods.

Previously this requirement was fulfilled by contract (W81XWH-16-P-0332) which was awarded by USAMRA to Favor Tech Consulting LLC with a period of performance expiration of 29 December 2017 using NAICS code 541611, via General Services Administration (GSA) schedule contract GS-00F-151GA, which expires 29 March 2022 and included NAICS code 541611. Although Favor Tech Consulting was in the 8(a) Program, a search of the Small Business Administration’s database revealed that the firm was no longer considered a small business under NAICS code 541611 (profile dated 16 May 2017).

The current contract (HT0011-18-F003) was awarded on 20 November 2017 under GSA, GS-00F- 072DA which included NAICS code 541611. On 29 November 2017, DHA received notice of protest and as a result issued a Stop Work to Contract HT0011-18-F0003 on 30 November 2017. Because the current incumbent graduated from the SBA 8(a) program, it is no longer eligible for this short term 8(a) requirement. The Government intends to negotiate a Firm Fixed Price Task Order with NetImpact Strategies, Inc.

3. A description of supplies or services required to meet the agency’s needs:This requirement is for continued support of the DHA M&O Division in the areas of manpower management, manpower programming, and manpower assessments as required under the DoD Planning, Programming, Budgeting, and Execution System (PPBES). The specific support tasks required are as follows: Manpower Assessments, DHA Organization Charts, DHA Manpower Documents, Manpower Planning and Programming, Manpower Resource Reviews and Allocations, Manpower Data Maintenance and Management, Data Entry and Reports, and Federal Activities Inventory Reform Act Reports.

4. Identification of the authority and supporting rationale (see FAR 8.405-6(a)(1)(i) and (b)(1)) and, if applicable, a demonstration of the proposed contractor’s unique qualification to provide the required supply or service.

FAR 8.405-6(a)(1)(i)(B) – Only one source is capable of responding due to the unique or specialized nature of the work. (“… one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized…”

LSJ Support for DHA M&O Div. - Page 2 of 3

This bridge is needed to prevent a gap in services in the support required by DHA M&O Division.

This contract action will enable a continuous level of support while the protest of the new contract is being resolved. Because this is an 8(a) requirement, an 8(a) firm is needed to fulfill this requirement.

NetImpact is in a unique position to provide for continuity of services, preventing any gap which would be detrimental to this important Government program.

tion with DHA’s internal SBA representative, it was determined that going with a different vendor for this bridge short term effort, would immediately cause not only gaps in service, but detrimental delays as a new contractor staff would need to complete training, receive proper clearances, and be issued electronic access and assigned Government provided equipment before they could achieve the required levels of quality and effort.

5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 8.404(d):

The Contracting Officer hereby determines that this action represents the best value to the Government in accordance with FAR 8.404(d). The level of support requested is the same monthly level of support provided under the current contract HT0011-18-F0003.

6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted:

This is a bridge contract action to prevent a gap in services. Following receipt of the protest, market research was conducted to solicit potential 8(a) potential vendors who submitted acceptable proposal under the most recent RFP.

7. Any other facts supporting the justification:

The bridge is required to stop the current disruption of support. Due to the expected number of offeror’s and expected length of technical evaluations, the bridge contract is required to expedite re-establishment of services.

8. A statement of the action, if any, the agency may take to remove or overcome any barriers that lead to the restricted consideration before any subsequent acquisition for the supplies or services is made:

The Agency had already taken steps to overcome barriers that may lead to future restrictions on this acquisition; this was a competitive award. The agency issued a request for quote to 177 8(a) vendors on the GSA 00CORP Professional Services Schedule under SIN 874-1;
