Justification for an Exception to Fair Opportunity

JEFO Log Number: JA15323

1. Identification of the agency and/or the contracting activity, and specific identification of the document as a “Justification for Exception to Fair Opportunity”.

U.S. Army Medical Research Acquisition Activity (USAMRAA) 820 Chandler Street Fort Detrick, MD 21702 Contracting Officer:

Requiring Activity: Defense Health Agency (DHA), Administration & Management Directorate

This is a Justification for Exception to Fair Opportunity (JEFO) authorized by FAR 16.505(b)(2)(i)(C). The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order.

2. Nature and/or description of the action being approved.

Approval is requested for a one (1) month period of performance extension of only the Access and Control, COMSEC, OSS/SCIF and Mission Assurance Division Support tasks on W81XWH-08-D-0034-0012 using the authority of FAR 52.217-8 which was included in the solicitation and award. A new solicitation is underway and proposals have been received. The proposals are currently under evaluation with an anticipated completion and award made by mid- August 2015. The new POP for the extension will be from 1 August 2015 thru 31 August 2015.

This extension will allow sufficient time for the solicitation and award process to be completed.

Projected cost for this modification is approximately

3. A description of the supplies or services required to meet the agency’s needs (including the estimated value).

The services to be authorized for extension under this contract are services for Access and Control, COMSEC, OSS/SCIF, Mission Assurance Division Support for HA/DHA and DHHQ in support of the Defense Health Agency (DHA), Administration & Management Directorate (A&MD). The DHA A&MD is responsible for providing day-to-day access control support of areas not supported by the Pentagon Force Protection Agency (PFPA) within the National Capitol Region (NCR) while adhering to the standards and policies associated with DoD sensitive or classified facilities in the NCR. The contractor assists in the management and access and control of the DHA’s Open Storage Secret (OSS) space as well as the DHHQ Sensitive Compartmented Information Facility (SCIF) and provide direct support to the Communications Security (COMSEC) custodian and is responsible for actions concerning accountability of COMSEC material charged to the COMSEC Custodian’s account.

Projected cost for this modification is approximately The CMID for this action is 24290.

4. Identification of the justification rationale (see FAR 16.505(b)(2)(i)), and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.

In accordance with FAR 16.505(b)(2)(i)(C), the order must be issued on a logical follow-on basis because the extension is necessary to ensure continuity of services, pending competition and award of a follow-on contract. At time of solicitation of this Task Order, all awardees were given a fair opportunity to be considered for the original order.

IT Solutions is the best source and most capable of providing uninterrupted services needed at the level of quality required. Two years into this highly skilled requirement, IT Solutions is qualified and positioned to accomplish additional Access and Control, COMSEC, OSS/SCIF, Mission Assurance Division Support for HA/DHA and the DHHQ by the requested extension.

The continued success of the Administration & Management Directorate is dependent on a strong and knowledgeable team that is fully read in and has the requisite knowledge to address and complete projects and tasks that will lead to successful accomplishment of the A&MD objectives.

At this juncture no other contractor could replace IT Solutions and successfully manage the work required without significant delay and increase in administrative cost incurred by both the Government and the contractor. Acquiring the services of another company at this point will adversely impact the A&MD and their ability to ensure the DHHQ facility runs smoothly. The ever evolving requirements of the Defense Health Agency (DHA), the complexity of incorporating complete agencies into the DHA, combined with the current high operational tempo, as the DHA strives to achieve Full Operational Capability (FOC) by 1 October 2015, has caused the delay in competing this requirement. This contract is critical to the safe operation of the Defense Health Agency (DHA) because it provides the DHA with contract support for the Physical Security Program. DHA has nearly doubled in personnel strength since Initial Operating Capability (IOC) and will continue to grow through FOC. Because of the critical support provided by this contract DHA cannot have a break in service without causing grave risk to DHA’s employees and exposing the DHA to serious vulnerabilities.

5. A determination by the ordering activity contracting officer that the order anticipated cost will be fair and reasonable to the Government.

Awarding a one (1) month extension to IT Solutions represents the best value to the Government because the labor rates are at the current TEAMS Option Period rates. Additionally, their rates have previously been determined to be fair and reasonable per FAR 16.501-2(c). The Government will assess the level of effort and mix of labor proposed to ensure best value is obtained. Based on an analysis of the current level of effort it appears that supporting an extension to IT Solutions would yield the best value to the Government and reduce administrative costs associated with a new procurement of the same tasking on the TEAMS IDIQ contract vehicle.

6. Any other fact supporting the justification.

Awarding to any other TEAMS contractor would lead to unavoidable delays and costs. The extension of the current task is necessary to ensure continuity of services.

7. A statement of the actions, if any, the agency may take to remove or overcome any barriers that lead to the exception to fair opportunity before any subsequent acquisition for the supplies or services is made.

Not Applicable. Before IT Solutions completes their work effort on this task order extension, the Program Office, thru the contracting office, will have a new task order awarded via fair opportunity competition for this work. The work has been solicited and proposals have been received. The proposals are currently under evaluation with an anticipated completion and award made by mid-August 2015. This extension will allow sufficient time for the solicitation and award process to be completed.

8. Evidence that any supporting data that is the responsibility of the technical or requirements personnel (e.g. verifying the Government’s minimum needs or requirements or other rationale for limited sources) and which form a basis for the justification have been certified as complete and accurate by technical or requirements personnel.

Not applicable to this Task Order.

9. A written determination by the approving official that one of the following circumstances applied to the order.

(1) The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract provided that all awardees were given a fair opportunity to be consider for the original order (FAR 16.505(b)(2)(i)(C)).

Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized. IT Solutions has proven successful in providing the services required at the level of quality required to commence operation. IT Solutions currently possesses the operational infrastructure of personnel who have proven in their current performance of the contract requirements to successfully meet the A&MD support requirements. IT Solutions is the only awardee that would be able to meet the highly specialized aspects of Access and Control and OSS/SCIF management support services in this short duration.

I certify that this justification for a one (1) month extension of services, authorized by FAR 16.505(b)(2)(i)(C), extension of services, under Task Order W81XWH-08-D-0034-0012, IT Solutions is accurate and complete to the best of my knowledge and behalf.

I hereby certify the requirement for the provision of Access and Control, COMSEC, OSS/SCIF, and Mission Assurance Division Support for HA/DHA and the DHHQ as depicted in the statement of work for the requested follow on are complete and accurate.

Name/Title: Glen Winzenburg, Division Chief/ Defense Health Agency (DHA) Administration & Management Directorate (A&MD), Mission Assurance Division (MAD).
