Justification and Approval for “Limited Source Justification”

FAR Part 8.405-6 and 16.505

1. Identification of the agency and contracting activity:

This is a Limited Source Justification (LSJ) for a Defense Health Management Systems acquisition, under the authority of Limited Sources, pursuant to 8.405-6 of the FAR. The Contracting Activity responsible for this action is the Contracts Operations Division – Falls Church.

2. Nature and/or description of action being approved: Approval is being requested for a modification of contract HT0012-13-F-0008 (Enterprise Architecture (EA)) with Data Networks, Inc. to extend the period of performance from 26 October 2014 to 26 February 2015, to allow for uninterrupted continued enterprise architecture services until the Government Accountability Office (GAO) protests towards the Engineering, Cyber Security and Configuration Management Support (ECCM) contract (HT0011-14-F-0030) that was awarded 29 September 2014, which this current effort will be absorbed under, are resolved.

3. A description of supplies or services required to meet the agency’s needs (include the estimated value):

Current Contract Value: $ 6,115,164.67 J&A Amount: $ 1,848,895.25 New Total Amount: $ 7,964,059.92

Current Period of Performance: 27 September 2013 to 26 October 2014 Extended Performance Period: 27 October 2014 to 26 February 2015

The proposed modification will extend the period of performance four (4) months from its current expiration date of 26 October 2014 to 26 February 2015. The contract type shall remain unchanged as a firm-fixed price and funded with FY15 Research Development Test and Evaluation (RDT&E) dollars.

Continued services are needed by the incumbent contractor for program continuity and completion of tasks related to the Defense Healthcare Management System (DHMS) Defense Management Information Exchange (DMIX) Program Management Office (PMO) effort to support the current NDAA requirements and DMIX solution.

4. Identification of the authority and supporting rationale (see 8.405-6(a)(1)(i) and (b)(1)) and, if applicable, a demonstration of the proposed contractor’s unique qualification to provide the required supply or service.

In accordance with FAR 52.212-4 (c), Changes, the terms and conditions of this contract may be made only by written agreement of the parties. This award was originally competed however; the clause 52.217-8 was not included. The authority to extend the contract period of performance by four (4) months shall be accomplished in accordance with FAR 8.405-6(a)(1)(B). In the interest of economy and efficiency, the work under the four (4) month extension is a continuation of work under the scope of an original Federal Supply Schedule (FSS) task order competitively and properly placed under FSS policies and procedures with Data Networks, Inc.

Data Networks, Inc. has the operational infrastructure and knowledge required for successful performance and the necessary skillsets to complete this effort without separating the services mid-stream. Given the present circumstance, only Data Networks, Inc. can provide the support required for this short duration without a loss of efficiency and impact to the EA continued development and implementation.

5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 8.404(d) or 16.505(b)(5):

GSA has already determined the prices of supplies and fixed-price services, and rates for services offered at hourly rates, under their schedule contracts to be fair and reasonable. However, DoD ordering activities are still required to make a separate determination of fair and reasonable pricing at the individual order level. This extension will be

Tracking #JA15-0015 executed at the current rates of the contract, which were already determined fair and reasonable at the time of original award.

6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted:

The incumbent contractor is a small business. Market research for the current effort was conducted and commercial sources are available to provide required services. However, such services will not meet the Government’s immediate requirements. Given the immediate need, no other sources could be procured without an disruption in the delivery of the current services or a substantial cost and impact to schedule.

7. Any other facts supporting the justification:

Contract HT0012-13-F-0008 was scheduled to expire on 26 October 2014. The proposed contract modification shall extend contracted services to 26 February 2015, to allow continued support to the DMIX PMO while the GAO protests towards the ECCM contract, which this current effort will be absorbed under, are resolved. The work under the four (4) month extension is a continuation of work under the scope of an original Federal Supply Schedule (FSS) task order competitively and properly placed under FSS policies and procedures with Data Networks, Inc. The continuation of this work is needed for program continuity and completion of tasks to support the program’s overall mission.

8. A statement of the action, if any, the agency may take to remove or overcome any barriers that lead to the restricted consideration before any subsequent acquisition for the supplies or services is made:

Concurrent with this contract extension period of performance, the DHMS is continuing its efforts to award a follow-on acquisition to this requirement utilizing competition procedures. The ECCM contract (HT0011-14-F- 0030) was awarded 29 September 2014. This follow on contract was competed via the NITAAC small business ID/IQ. Unfortunately, a stop work order was issued 14 October 2014 on this contract due to a GAO protest. The stop work is in effect until the protests are resolved. It is anticipated that the stop work order will be lifted prior to the end of this extension’s period of performance.
