For

2. Description of Action: U.S. Army Corps of Engineers – New Orleans District’s Stream Gaging Unit Section requests a firm-fixed-price contract for Brand Name Items. The type of funds are from the Operations and Maintenance Facility Account (B2185101) and Funded Work Item (RF5023) for Stream Gaging Unit.

3. Description of Supplies/Services: The New Orleans District requires the following items as replacement parts for their stream gaging unit: two (2) each Honda 225HP DXRA 25 inch right hand outboard boat motors; one (1) each box kit; four (4) each shift and throttle cables; four (4) each stainless steel props; one (1) each dual ignition with STP-PGMFI; two (2) each filling oil for the outboard motors; two (2) BK Tach, HR meter V#; and two (2) each cable assemblies; includes 5 year manufacture’s warranty against defective workmanship. The estimated value of this action is $37, 870.00.

4. Authority Cited: FAR 13.106-1(b)(1).

5. Reason for Authority Cited: Pursuant to FAR 13.104, the contracting officer must promote competition to the maximum extent practicable from the source whose offer is the most advantageous to the Government, considering the administrative cost of the purchase. However, in accordance with FAR 13.106-1 (b)(1), the contracting officer may solicit from one source if the determination is made that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization) for purchases not exceeding the Simplified Acquisition Threshold (SAT).

6. Efforts to Obtain Competition: In accordance with FAR 13.105, this action will be advertised with combined synopsis and solicitation for a brand name requirement, allowing competition among offerors. The Solicitation will be published on SAM.gov along with this justification and approval for brand name only to have more competition within the limits of the requirements.

4. Actions to Increase Competition: This is a one-time purchase to replace boat outboard motors.

No future procurements are forecasted.

5. Market Research: The motor is an off-the-shelf commercial item and can be procured from any vendor as long as they meet the specifications required in the Scope of Work. On 1 March 2023, a Sources Sought was posted on GSA with a close date of 6 March 2023. No responses were received. No responses were received. Based on this information, it was determined GSA cannot procure an off the shelf motor that meets the specifications. Advertising on SAM will be required.

6. Interested Sources: Two quotes were obtained for market research purposes: one from (Iberia Outboard & Marine Service, Inc. New Iberia, LA 70560-0755) and another from (Slidell Marine, Inc. 36440 Old Bayou Liberty Rd. Slidell, LA 70460).

Control Number: MVN-23-0011

10. Any Other Facts Supporting the Use of Other Than Full and Open Competition: The receiving vessel will need to be retrofitted if another motor is used. This would require new fabrication welding work and resizing the receiving vessel transom to resize for motor installation. If different motors, than the requested, are purchased the orientation of the receiving vessel would have to be recalibrated to fit a different motor than previously planned. Additionally, the vessel is not guaranteed to perform as intended as the orientation of the vessel would have to be modified to ensure the vessel planar orientation is correct in the reverse, idle, and forward modes. Lastly, a new dashboard, new hydrologic steering pump, and other dashboard meters would need to be purchased to replace the existing dashboard, hydrologic steering pump, and other dashboard meters required to operate the receiving vessel.

11. Technical & Requirements Certification: I certify that the supporting data under my cognizance which are included in the justification is accurate and complete to the best of my knowledge and belief.
