About this file
This solicitation requests quotes for dry dock repairs of the USCGC PATOKA, a 75-foot River Class Buoy Cutter with 130-foot barge. The Coast Guard's Surface Forces Logistics Center seeks to award a firm fixed price contract for work to be completed between April 4th and June 13th, 2023. Quotes are due by the date specified in Amendment 1, if released.
Repair and support services are required as detailed in Attachment 2. The small business set-aside solicitation is issued under FAR Part 12 and 13.5 procedures. Quoting vendors must provide documentation including past performance, insurance, technical certifications for prime and any subcontractors, as well as representations and certifications. Eligible small businesses certified for socioeconomic programs may receive preference if award is not made at lowest price. The Coast Guard will evaluate quotes received and make award to the responsible vendor submitting the lowest priced, technically acceptable offer.

SIMPLIFIED ACQUISITION PROCEDURES (SAP) FAR 13.106-1(b)
SOLICITATIONS MAY BE LIMITED TO ONE SOURCE ONLY IF THE CONTRACTING OFFICER DETERMINES THAT ONLY ONE SOURCE IS REASONABLY AVAILABLE. THIS DETERMINATION MUST BE SUPPORTED WITH FULL JUSTIFICATION FOR SOLE SOURCE FROM THE CUSTOMER. WHEN THE CUSTOMER DESCRIBES AN ITEM WITH A PURCHASE DESCRIPTION WHICH LIMITS THE AVAILABILITY TO ONE SOURCE, THE JUSTIFICATION MUST EXPLAIN WHY THE ITEM IS THE ONLY ONE THAT WILL MEET THE GOVERNMENT’S REQUIREMENT. STATEMENTS SUCH AS "ONLY KNOWN SOURCE" OR "ONLY SOURCE WHICH CAN MEET THE REQUIRED DELIVERY DATE" ARE INADEQUATE TO SUPPORT A SOLE SOURCE PURCHASE. Do not use marketing language in this document. Language such as “This company has made its mark,” “This company is recognized as industry’s best,” and “This company is the leader in…” is unacceptable.

BRIEF DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED, AND THE INTENDED USE.
Contractor shall provide the services of qualified Tech Rep who is familiar with the Wartsila Type FSE Shaft Seal to provide the following services – on site. Advise on manufacturer's proprietary information pertinent to the system, and ensure compliance with manufacturers procedures and standards during disassembly, inspection, and reassembly of the system. Assist with proper installation, set-up or repair methods.
UNIQUE CHARACTERISTICS THAT LIMIT AVAILABILITY TO ONLY ONE SOURCE, WITH THE REASON NO OTHER
SUPPLIES OR SERVICES CAN BE USED.
The statement of work requires “Qualified” Tech Rep who is familiar with the Wartsila marine seal applications, however, certain necessary manufacturing data that may be needed to complete the repairs are proprietary and controlled by Wartsila Defense Inc. Wartsila is the only known source that possesses the required capabilities, drawings, specifications, engineering control procedures and proprietary methods to ensure the latest design configuration, manufacturing and quality control required to maintain and support the Type FSE seal arrangement.
A DESCRIPTION OF EFFORTS MADE TO ENSURE THAT QUOTATIONS OR OFFERS ARE SOLICITED FROM AS MANY
POTENTIAL SOURCES AS PRACTICABLE (INCLUDE YOUR MARKET RESEARCH EFFORTS HERE).
In an effort to promote full and open competition and solicit as many potential vendors as possible, a sources sought notice was posted on 30 March 2022 on the SAM.gov Contract Opportunities website. Interested vendors were invited to submit information discussing their capabilities by 15 April 2022. The solicitation will include the Work Item in the Specification and this Justification & Approval.
REASON THAT SUGGESTED SOURCE IS THE ONLY SOURCE WHICH CAN PROVIDE THE SUPPLIES OR SERVICES.
The Statement Of Work doesn’t require that a Certified tech rep is used however, the requirements within the statement of work may require the Contractor to provide specific Wartsila marine technical services to meet the following requirement: Provide manufacturer's proprietary information, software, and tools pertinent to the equipment/system. Assist with proper repair methods, and ensure compliance with manufacturer's procedures and standards during disassembly, inspection, repair, modification, calibration, and reassembly of the equipment/system
EXPLAIN WHY AN ADEQUATE PURCHASE DESCRIPTION OR OTHER INFORMATION SUITABLE TO SOLICIT BY FULL
AND OPEN COMPETITION HAS NOT BEEN DEVELOPED OR ARE NOT AVAILABLE.
The informational data required to complete the repairs is the sole property of Wartsila Defense Inc. The Statement of work requires that the Prime contractor makes the repairs using proprietary data supplied by the manufacturer. Wartsila Defense Inc has control over their proprietary data, drawings, etc, PROVIDE A STATEMENT OF ACTIONS, IF ANY, THE GOVERNMENT MAY TAKE TO REMOVE OR OVERCOME ANY
BARRIERS TO COMPETITION BEFORE FUTURE ACQUISITIONS ARE REQUIRED.
USCG will continue to conduct market research; however, without proprietary technical information described above, obtaining full and open competition is not realistic. The Coast Guard cannot require any vendor to release proprietary information.
