Contracting Officer’s Determination Memorandum for Sole Source (Including Brand Name) for less than SAT
In accordance with FAR 13.106-1 (b) (1), for purchases not exceeding the simplified acquisition threshold (SAT) contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization). The determination must explain why the item or service provider is the only one that will meet the Government's requirement. Statements such as "only know source" or "only source which can meet the required delivery date" are unacceptable to support a sole source purchase.

CHECK THE TYPE OF PURCHASE. Provide the unique characteristics that limit availability to only one source, including the reason(s) no other supplies or services can be used to meet the Government's needs. If you are stating the purchase is mandated by law, regulation, or policy, state the publication, date, and include a copy of the publication with the package. If the request is based on unusual or compelling urgency, describe the circumstances leading to the urgency, including when the requirement became known. A Fox Co Model SA-501 semi-automatic fabric end cutter to be used in the upholstery shop for high volume fabrication projects (protective gowns, face masks, etc)
The upholstery shop currently has a semi-automatic fabric end cutter (manual pull, auto cut) manufactured by Merlin.
This machine allows for a one man operation for high volume jobs. The machine experiences significant downtime and replacement parts are difficult to find. The Merlin units are also no longer being manufactured. Manual fabric end cutting systems are available but they are a two man operation (one person pulling fabric/one cutting) and the process is much slower than with the semi-automated equipment which would significantly effect production times. Fully automatic end cutting systems (auto pulling and cutting) are available but the equipment is too large for the available space. The upholstery shop has room for one 12' long table and they need an 8' minimum cut length. Eastman Machinery has the most compact fully automated fabric end cutter and the equipment itself takes up 6' of table length allowing for a maximum cut length of 6'. The Fox Co Model SA-501 unit takes up less than 4' of table length providing the necessary 8' cut length. The Fox Co SA-501 is the only semi-automatic fabric end cutter currently manufactured that meets the required space constraints.
