About this file
This document is a Justification and Approval (J&A) for a sole source procurement of Yeary Sharktooth brand exhaust valves by the U.S. Army Dugway Proving Ground (DPG). The requirement is to purchase 39 valves of various sizes for use in the Chemical Test Division's operations, with an estimated total value of $511,540. The valves are considered a commercial item and will be acquired under FAR Subpart 13.5 Simplified Procedures. The Yeary Sharktooth valves are the only ones approved for use with chemical warfare agents and are compatible with the existing facility systems. Market research identified several small business vendors who supply these valves. The contract is planned for award on September 30, 2024, using Research, Development, Test and Evaluation (RDT&E) funds. The Contracting Officer has determined the anticipated price will be fair and reasonable.

FAR 13.5 Simplified Procedures for Certain Commercial Items Sole Source Justification and Approval
1. Contracting Activity: U.S. Army Mission and Installation Contracting Command (MICC), Dugway Proving Ground, 5330 Valdez Circle, MS #1 84022
2. Description of Action: Army Test & Evaluation Command (ATEC), U.S. Army Dugway Proving Ground (DPG), West Desert Test Center (WDTC), Lab 103 ORD 3665 requests a firm-fixed-price contract for Yeary Sharktooth brand Exhaust Valves. The Government projects award for 30 September 2024, fiscal year 2024, and Research, Development, Test and Evaluation (RDT&E) funds will be used.
An acquisition plan is not required because this procurement does not meet the threshold at Defense Federal Acquisition Regulation Supplement 207.103(d)(i)(B).
3. Description of Supplies/Services: The object of this procurement is for the acquisition of Yeary Sharktooth brand Exhaust Valves for lifecycle replacement compatible with existing Chemical Test Division operations. The estimated value of this requirement is $511,540.00
Requirement includes:

4. Authority Cited: Simplified Procedures for Certain Commercial Items, Title 41 U.S.C.
1901 (or Title 41 U.S.C. 1903 for Special Emergency Procurement) as implemented by FAR Subpart 13.5:
__Unusual and compelling urgency __Exclusive licensing agreements
___Industrial mobilization _X_ Other: Amount is greater than the simplified acquisition threshold but not exceeding $7.5 million and offers will include only commercial products or commercial services (IAW FAR Subpart 13.5).
5. Reason for Authority Cited: The Yeary Sharktooth brand valves are compatible with existing Chemical Test Division (CTD) chemical laboratory operations, Base Management System, and facility operating configuration systems. Yeary Sharktooth brand valves are Pneumatic Actuator Air Torque valves with a 4-20 mA positioner. The valve has a triple-off set butterfly valve, reduced cavitation, low operating torque, with various butterfly angle shut off control, tight shut off, low flow, medium flow and maximum flow. These valves are the only exhaust valves approved to Chemical Warfare Agents (CWA) exhaust operations and meet U.S. Army, State of Utah, and CTD safety and CWA compliance requirements. The Yeary Sharktooth brand valves are the only valves that meet the criteria for control of the exhaust system associated in working with CWA. If other valves are purchased, the cost to the government would exceed over several hundred thousand dollars in delay while the replacement valves are tested and verified to control exhaust emissions for CWA. Awaiting the results of the test will delay actual CWA testing and cost an additional several hundred thousand should the other valves be found substandard and require replacement with Yeary Sharktooth valves.
Alternatives: Procurement of valves from alternate manufacturers is not acceptable due to the strict CWA operating requirements established by the U.S. Government, Utah State and U.S. Army Dugway Proving Ground. Alternative valves would result in suspended testing operations while other valves are tested at significant cost to the government.
Minimum specification requirements:
--Valves must be compatible with existing CTD chemical laboratory operations, Base Management System, and facility operating configuration systems.
--Valves must be pneumatic actuator valves with a 4-20 mA positioner.
--Valve must have a triple-off set butterfly valve.
--Valve must have reduced cavitation and low operating torque.
--Valve must have various butterfly angle shut off control with tight shut off, low flow, medium flow, and maximum flow.
--Valves must be approved to CWA exhaust operations.
--Valves must meet U.S. Army, State of Utah, and CTD safety requirements.
--Valves must meet CWA compliance requirements.
Impact if justification not approved: Since these valves are critical to ensuring the chambers and hoods maintain engineering controls, failure to acquire these valves will shut down operations, endanger the safety of personnel working with CWA, and WDTC would not be able to support critical U.S. Army chemical test programs. The loss of test dollars would equal approximately over $1.2 million dollars.
6. Efforts to Obtain Competition: The Contracting Officer shall publish the notices required by FAR 5.201 and any bids or proposals received shall be considered. Market research was done by reviewing web brochures and literature, internet searches, communication with vendors and manufacturer, consulting multiple government databases, and researching general industry analysis reports.
7. Actions to Increase Competition: After extensive research and direct contact with manufacturer, several viable small business vendors were identified who supply Yeary Sharktooth brand valves. Yeary Sharktooth valves (brand name) are the only valves in the current market found compatible with existing components used in the CTD facility. It is therefore critical that Yeary Sharktooth brand valves are acquired to ensure compatibility and safety. WDTC-DPG will continue efforts in conducting market research to track if materials or other replacement valves can be used in future chemical agent operations.
8. Market Research: Market Research techniques utilized extensive internet and data searches during the periods of 29 Jul 2024 to 08 Aug 2024. Government databases including the System for Award Management (SAM.gov) and the Federal Procurement Data System (FPDS), were researched for relevant information on like acquisitions.
Manufacturer was contacted directly for product information, availability, and potential vendor information. Several vendors were identified and communicated with who potentially carried the specific supply detailed in the requirement. PCF cabinet database was also researched along with DoD required sources of supplies and services.
Reviewed Federal Supply Schedules including General Service Administration (GSA) GSA Advantage. Provider websites were identified and searched to confirm capability and brand conformity.
9. Interested Sources: The manufacturer was contacted to request a list of potential partners capable of providing the products, all of which are small businesses and registered on SAM.gov. Other small businesses were also identified on SAM.gov who publish Yeary Sharktooth valves on their websites.
10. Other Facts: Procurement History--No past procurement history for MICC-DPG or U.S. Army was found for this type of requirement. General industry standards do not match the specifications required to fulfill technical specs at this time. Only Yeary
Sharktooth brand adheres to technical standards and has approval meeting CWA exhaust operations. Yeary Sharktooth brand meets all U.S. Army, State of Utah, CTD safety and CWA compliance requirements.
