2. DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE
AGENCY'S NEED
Project Manager Warfighter Information Network-Tactical (PM WIN-T) provides the communications network and services that allows the Warfighter to send and receive information in order to execute the mission. Information is the element of combat power that allows
Commanders to magnify the effects of maneuver, firepower, and protection. WIN-T is the transformational Command and Control system that manages tactical information transport at theatre through Company Echelons in support of full spectrum Army operations.
The WIN-T Network is currently being fielded incrementally to the Army. WIN-T Increment 1 provides networking capabilities "At-The-Halt" down to the Battalion level and has completed
Services its fielding to Army Units. WIN-T Increment 2 builds on Increment 1 capabilities and provides initial networking "On-The-Move" down to the Company level only for select Maneuver
Brigades. WIN-T Increment 3 will provide full networking “On-The-Move” down to the
Company level for Maneuver, Fires and Aviation Brigades, and will fully support the Brigade
Combat Team (BCT) Modernization program. WIN-T Increment 4 will provide protected
Satellite Communications “On-The-Move” capability against jamming, detection and intercept.
The PWS specifies requirements for non-personal Integrated Logistics Support (ILS) services the
Contractor shall perform in support of PM WIN-T programs. These Systems Engineering and
Technical Assistance (SETA) services include expertise not readily available within the Project
Management Office or supporting The Communications-Electronics Command (CECOM) Life
Cycle Management Center (LCMC) matrixes and other US Government offices. These services provide the flexibility required for tasks, which cannot be accomplished by the US Government organization within the available time. The efforts under the PWS comprise a broad range of
ILS efforts. This support includes assisting the PM WIN-T, its Product Managers (PdMs), project teams, and PM WIN-T divisions, with programmatic support services on the programs listed below and projects during all phases of the system’s/equipment acquisition life cycle. This list includes the programs identified at the time of solicitation. This list may change in response to new direction and to keep pace with evolving Army needs. 3. IDENTIFICATION OF STATUTORY & REGULATORY AUTHORITY
Statute(s) cited: FAR Part 8.405-6 (a)(1)(i)-an urgent and compelling need exists and following the ordering procedures would result in unacceptable delays, modified under the authority of
Section 201 of the Federal Property and Administrative Services Act of 1949 (40 U.S.C. 501).
4. DEMONSTRATION THAT THE ACQUISITION REQUIRES THE USE OF
AUTHORITY CITED
This Task Order was competed under fair opportunity procedures. The Request for Quote was offered to all GSA Schedule Logworld vendors when released in GSA e-Buy. In response to the
RFQ, four (4) responses were received from four (4) different GSA Schedule Logworld vendors.
The Task Order was awarded to ESP, LLC on 02/06/2014, for a term of one Base Year with 4 one-year Option Periods. Currently the Task Order is in the Base Period (February 24th, 2014-
February 23th, 2015). The Task Order is an incrementally funded Time & Materials type.
The client (Project Manager (PM) Warfighter Information Network-Tactical (WIN-T)) submitted a supporting “Justification to Increase the Not-To-Exceed” which is incorporated in this document. The IGCE was prepared by Jerry Harper, PM WIN-T Division Chief, Readiness
Management Division. Mr. Harper is also the Task Order Contracting Officer’s Representative
(COR). A copy of the IGCE to increase the Not-To-Exceed ceiling is on file.
This Justification addresses the need to increase the NTE due to the reasons which impacted programs as described below:
INCREMENT 1
PM WIN-T has been given directives from Headquarters, Department of the Army (HQ DA) to increase fielding Increment 1 End of Life (EOL) assets by 5 Brigades and 4 Expeditionary Signal
Battalions (ESBs) during the period of performance for this Task Order. In addition, 7 Division
Artillery (DIVARTY) units have been added to the fielding schedule, and 23 Retrograde operations, all of which were not planned during the Task Order Period of Performance (PoP) and were not anticipated at time of task award. In support of National Defense, the Army trains and prepares select groups of units to respond quickly to limited conflicts, natural disasters and contingency operations.
Services
INCREMENT 2
PM WIN-T has also been given directives from HQ DA to increase fielding Increment 2 assets by 2 Brigades and 2 Division HQ elements. Also, Increment 2 has been directed to complete several test events not anticipated at time of task award, but are critical to the success of this program. Due to the accelerated departure from Operation Enduring Freedom (OEF), Increment
2 also began its Reset mission in FY 14, which was previously unanticipated. This increase in fielding work has been deemed of significant importance to the Army. Failure to complete the additional missions would impair the Army’s and the Fielded Units’ ability to communicate using the WIN-T Tactical Internet capability to complete their mission. This would place the lives and safety of combat troops in jeopardy, and degrade their ability to perform their wartime mission-overseas operations in Afghanistan and South Korea with potential deployment in support of directives from the President of the United States and congress.
TRANSPORTABLE TACTICAL COMMAND COMMUNICATIONS (T2C2)
The Army’s mission is to fight and win our Nation’s wars by providing prompt, sustained land dominance across the full range of military operations and spectrum of conflict in support of combatant commanders. This is accomplished by:
Executing Title 10 and Title 32 United States Code directives, to include organizing, equipping, and training forces for the conduct of prompt and sustained combat operations on land.
Accomplishing missions assigned by the President, Secretary of Defense and combatant commanders, and transforming for the future.
In support of the US Army mission, PM WIN-T is in receipt of the Capabilities Production
Document (CPD) requiring the development of the Transportable, Tactical, Command
Communications (T2C2). This is a new start program that was previously unanticipated as a subset of the WIN-T suite of equipment, and represents the Army’s determination that this is an urgent and compelling requirement to support the overall Army mission. This equipment set will increase the communications capabilities of small set units. Failure to support this requirement will severely degrade the ability for small units to communicate, placing the lives of warfighters in these units and their mission in jeopardy.
Timeline: The aforementioned requirements were not anticipated and were not available at the time of the Independent Government Cost Estimate (IGCE) preparation. Receipt of CPD and directives to accelerate schedules by PM WIN-T translates to an increased level of effort from the original CLIN requirement.
The increased Level of Effort is considered to be of crucial nature and no other vendors can start work immediately. The increased Level of Effort described is scheduled for completion within the Task Order Base Year Period of Performance. Any unacceptable delay to the Government and failure to execute these requirements would cause significant detriment to National Defense by causing forward deployed units and deploying units to operate without equipment or training on the WIN-T Tactical Internet capability, which may jeopardize soldier’s lives and degrade mission effectiveness.
Within Scope Determination: The NTE ceiling increase requested are within the scope of the
Performance Work Statement (PWS) as originally published with the RFQ. The PWS was written with the knowledge that programs would be added, modified or scaled to respond to the changing needs of the Army User. However, it could not have been quantitatively known at the time what these changes would be.
This ceiling NTE increase does not constitute additional work or additional scope.
Impact if Ceiling is Not Increased: PM WIN-T is directly responsible for the development, production and sustainment of an extensive list of products, systems and subsystems which comprise the WIN-T architecture. The expertise of services contractors to provide support beyond the government’s existing capabilities is necessary to successfully achieve PM WIN-T’s mission. Any shortfall in the timely use of correct levels of support services personnel will negatively impact the schedule and the quality of these products being made available to the
Warfighter. This will place the lives of warfighters in jeopardy and at the same time degrade system/equipment capability and the success of the Warfighter’s mission.
5. DESCRIPTION OF EFFORTS TO SOLICIT AS MANY OFFERS AS IS
PRACTICABLE
Not Applicable – Urgent and Compelling.
6. DEMONSTRATION THAT THE ANTICIPATED COST WILL BE FAIR AND
REASONABLE
The increase in NTE Ceiling will be affected by awarding additional level-of-effort (man-hours) onto the Task Order. The labor categories and labor rates to be utilized under this increase in level-of-effort are based on ESP’s proposed labor categories and labor rates established at the time of award of the Task Order and currently in effect for the base period. The labor mix and place of performance (Government & Contractor Site) for this action is based on the IGCE developed by Jerry Harper, PM WIN-T Division Chief, Readiness Management Division, as being suitable in support of the additional level-of-effort.
All proposed Task Order labor rates for both Government and Contractor Site are discounted from ESP’s GSA Schedule Logworld Contract No. GS-10F-0008V.
Furthermore, a market research was conducted as part of the evaluation process for award of this
Task Order. Labor rates for the labor categories employed during the evaluation process for award was compared against 3 other GSA Schedule Logworld contractors in February 2014 for price reasonableness determination. ESP’s prices were determined to be fair and reasonable.
The labor mix and amount of additional level-of-effort applied to this modification is considered to be fair and reasonable, as it was established by the Government’s COR, Jerry Harper.
7. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED
Market research was conducted to assist in the fair and reasonable determination. Results of the market research are discussed in Section 6 of this Justification and Approvals and shown on the spreadsheet entitled “Market Research & Analysis”.
8. OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN
COMPETITION
None.
9. LIST OF SOURCES THAT EXPRESSED INTEREST IN THE ACQUISITION
No additional sources were sought and no other sources expressed interest.
10. STATEMENT OF ACTIONS TO OVERCOME BARRIERS TO COMPETITION
None.
Determination
Based on the above, it is determined that it is justified and is in the Government’s best interest to award on a limited sources basis under FAR Part 8.405-6 (a) (1) (i) an urgent and compelling need exists, to increase the Not-to-Exceed (NTE) ceiling for the Task Order Base Period (in the amount of $3,613,708.80) under ESP, LLC’s Task Order No. GSQ0214CJ0004 (ITSS Task
ID02130026).
