J&A to continue Joint Staff J6 Exercise Bold Quest circuit
JUSTIFICATION FOR OTHER THAN FULL AND
OPEN COMPETITION (OTFAOC)
Federal Acquisition Regulation (FAR) Part 6 Justification & Approval (J&A), Supporting Procurements under FAR Part 12, FAR Subpart 13.5, and FAR Part 15
Purchase Request Number: DR27MAR205457 Contract Number: To Be Determined Task/Delivery Order Number: To Be Determined Procurement Title: 1GB ethernet Estimated Value: $21,000.00 (12 months) Statutory Authority: FAR 6.302-1(a)(2)(iii)(B) and 10 U.S.C 2304(c)(1).
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION (OTFAOC)
Upon the basis of the following justification, I, as Contracting Officer, hereby approve the use of other than full and open competition of the proposed contractual action, pursuant to the authority of 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.
1. REQUIRING AGENCY AND CONTRACTING OFFICE:
Requesting Agency:
Joint Staff J6/DDC5I/C3OD2 Engineering & Cyber Capabilities Branch 9800 Savage Road Fort Meade, MD 20755
Contracting Activity:
DISA/Defense Information Technology Contracting Organization (DITCO) PL8211 2300 East Drive, Building 3600 Scott Air Force Base, Illinois 62225-5406
2. NATURE/DESCRIPTION OF ACTION(S): The nature of this requirement is to procure a Firm-Fixed Price (FFP) sole source telecommunications service contract to ZAYO. The performance period will be for 12 months from November 3, 2021 through November 2, 2022. The estimated value for this contract is $21,000.00. Telecommunications Service Request DR27MAR205457 will be used to fund this effort.
3. DESCRIPTION OF SUPPLIES/SERVICES: The purpose of this requirement is to provide continued 1GB Ethernet service for DHA, until a new competed effort can be completed. This service is utilized to provide a 1GB ethernet circuit between Alexandria, VA and Ft Belvoir, VA.
4. IDENTIFICATION OF STATUTORY AUTHORITY: Only one responsible source and no other supplies or services will satisfy agency requirements, 10 U.S.C. 2304(c)(1). FAR 6.302-1/Defense Federal Acquisition Regulation Supplement 206.302-1.
5. DEMONSTRATION OF CONTRACTOR’S UNIQUE QUALIFICATIONS:
(a)Description of events.
The current contract for the 1GB ethernet services is provided by Special Communications. To ensure that the DHA does not suffer a loss in service, the government is intending to complete a sole source award to ZAYO (subcontractor), until such a time that a long-term competitive effort for the required service can be awarded.
(b)Justification.
(1) Minimum Government requirements. DHA requires continued 1GB bandwidth service to sustain mission-essential communications.
(2) Proposed sole source contractor. ZAYO, 1805, 29th street, Suite 2050, Boulder, CO 80301. Special Communications is a reseller of the bandwidth provider ZAYO. Since the service is already being provided by ZAYO, they meet the needs of the government to keep the service in place without any interruptions in service.
(3) Discussion regarding cause of the sole source situation. As the current bandwidth provider, ZAYO was contacted to continue services until such time that a long-term, competitive effort for upgraded services could be completed.
(4) Impact. The criticality of the leased bandwidth is of great significance in terms of DHA’s ability to communicate directly supporting their mission. As such, DHA cannot suffer an interruption of service, which would result in an inability to communicate with mission essential personnel.
6. SAM.GOV ANNOUNCEMENT/POTENTIAL SOURCES: In accordance with FAR 5.202(b)(1)(i), a synopsis of this proposed contract action is not required, as it does not meet the threshold defined in FAR 5.101(a) (1). As indicated above, through conversations with the bandwidth provider, only ZAYO was offered as a potential reseller.
7. DETERMINATION OF FAIR AND REASONABLE COST: The contracting officer, will make a determination on whether the price is fair and reasonable via a price analysis (to include comparison of prices obtained through historical data, market research, and comparison to the Independent Government Cost Estimate) will be utilized. The contracting officer will ensure that the resulting negotiated price is fair and reasonable to the Government.
8. MARKET RESEARCH: Market research was conducted for the long-term, competitive effort from February 2021 to February 2022, by the Contracting Officer’s Representative for that requirement via internet searches, review of historical efforts, and attendance at trade shows, conferences, and industry workshops. Additionally, the Contracting Officer for this sole source requirement conducted market research in October 2021 through discussions with the current bandwidth provider. Although market research has found other qualified contractors, there is not time to compete this requirement without causing an interruption in service of the existing 1GB ethernet capabilities. The program office is proposing to compete a long-term, upgraded requirement as a full and open competitive solicitation.
9. ANY OTHER SUPPORTING FACTS: None.
10. LISTING OF INTERESTED SOURCES:
ZAYO
Bldg 1805 29th street Suite 2050 Boulder, CO 80301.
11. ACTIONS THE AGENCY MAY TAKE TO REMOVE OR OVERCOME BARRIERS THAT
LED TO THE EXCEPTION TO FULL AND OPEN COMPETITION:
(a) Procurement History:
Current Contract: SPEC000021EBM Services: 1GB Ethernet Contract Type: FFP Period of Performance: OCT 21, 2020 through JUL 22, 2023 Type of Set-Aside: None Contractor: Special Communications.
(b) An upgraded requirement of this service is currently being recompeted. The projected award date is NOV 3, 2021. Upon award Special Communications will be provided notice of termination.
12. REFERENCE TO THE APPROVED ACQUISITION PLAN (AP): The value of this effort does not meet the threshold required for an AP.
CONTRACTING OFFICER CERTIFICATION: I certify that this justification is accurate and complete to the best of my knowledge and belief.
