About this file

This document is a Justification and Approval (J&A) for a sole source procurement of Suzuki marine engines and associated parts for the Federal Law Enforcement Training Center (FLETC) in Charleston, SC.

The J&A states that the Suzuki 300HP marine engines are necessary replacements for the existing engines on the FLETC McKee training vessel, which have exceeded their lifespan. The Suzuki engines are the only known product that meets the agency's requirements for compatibility, power, and reliability to conduct maritime training. While other manufacturers were considered, Suzuki was determined to be the most cost-effective option that ensures continuity with the agency's existing equipment and operator familiarity. The total estimated price for two 300HP Suzuki engines and associated rigging parts is provided. The J&A cites the statutory authority and rationale for the sole source procurement, noting the agency's efforts to identify potential competition. The document is in support of the related federal contract opportunity Solicitation Number 70LCHS24QPFB00028 to procure the Suzuki engines and parts for FLETC Charleston.

(2) Nature and/or Description of the action being approved. This requirement is for replacement marine engines from Yanmar Mastry Engine Center. which is essential to the Federal Law Enforcement Training Center’s maritime training requirements, and market research indicates other companies do not have comparable design structure similar to existing setup while also being cost-effective to meet the agency’s needs. The Suzuki 300HP marine engines are replacements for the existing Suzuki 300HP marine engines currently mounted to our FLETC McKee (hull #2803) training vessel. It is necessary to require this GSA pricing single source company to ensure continuity of installation layout, and operability. The Suzuki engines aboard the FLETC McKee 2803 vessel have exceeded their life expectancy and are due for replacement. The Suzuki engines have the sufficient power needed to conduct safe and reliable training under extreme conditions. The older Suzuki (2014) engines use the same modern electronic “fly-by-wire” throttle response system with nearly no maintenance needed. All other FLETC vessels being used for training either came standard with Suzuki engines or have been replaced with Suzuki engines. This ensures our vessel operators are familiar with this type of engine and throttle response, and our contract mechanics are also qualified and are familiar with this engine type.

(4) Identification of Statutory Authority Permitting Other than Full and Open Competition. The statutory authority permitting other than full and open competition 41 U.S.C.3304(a)(1) implemented by the FAR Subpart 6.302-1 entitled “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.”.

(5) Identification of Exception to the Buy American Statute. N/A.

(6) Demonstration that the Nature of the Acquisition Requires use of the Authority Cited.

The action is for the procurement and delivery of equipment that is necessary to provide continuity at the FLETC for all maritime training programs. The new (DF300APXX5) Suzuki Marine Engines would replace the existing Suzuki engines (DF300APXX) that have exceeded their life expectancy for warranty and government training use.

Existing Marine Engines Needing Replacement:

DF300APXX Suzuki Marine Engine (30 inch transom height) Dual Overhead Cam 24-Valve / 4-Stroke / V-6 Cylinder Engine 300 Horsepower, Color: Black

Yanmar Mastry Engine Center. – GSA Product Manufacturer assists the marine law enforcement community to provide high-quality marine products that are tested and evaluated for reliability and durability protection. The specified brand name product is the only known product to meet the needs of the Federal Law Enforcement Training Center’s dynamic and realistic scenarios during underway maneuvering and vessel pursuit training.

Additionally, the Suzuki engines will require less cost for installation, service, and initial cost per engine.

(7) Description of Efforts Made to ensure that Offers are Solicited from as Many Potential Sources as is Practicable. There are four outboard motor manufactures. Suzuki, Yamaha, Mercury and Honda. Suzuki is available as priced in para (3). Yamaha is available from GSA Advantage at per engine (Does not include wiring harnesses, throttles or gauges). Mercury is also available on GSA Advantage at per engine (Does not include wiring harnesses, throttles, or gauges). Honda does not manufacture 300 hp engines.

When researching availability and price for the Suzuki engines GSA Advantage directed us to the manufacturer who provided us the prices listed in para (3) through Yanmar Mastery Engine Center. The price listed in DHS Advantage is which is more per engine than directly from manufacturer.

(8) Determination by the Contracting Officer that the anticipated Cost to the Government will be Fair and Reasonable. The contracting officer will evaluate the anticipated price for fair and reasonableness based on pricing being consistent with commercial vendor pricing.

The contracting officer shall review the pricing information when submitted with the proposal and conduct necessary analysis to make a fair and reasonable determination.

(9) Description of Market Research. Various other marine engine manufacturers were considered to include Yamaha, per engine through GSA (Does not include wiring harnesses, throttles or gauges). Mercury, per engine through GSA (Does not include wiring harnesses, throttles or gauges). Honda does not manufacture 300 hp engines. Utilizing other marine engine manufacturers other than Suzuki would not be cost-effective to the government.

(10) Any Other Facts Supporting the Use of Other Than Full and Open Competition. See information provided in paragraphs (5) and (8) above.

(11) A Listing of the Sources, if Any, That Expressed, in Writing, an Interest in the

Acquisition. No firms have indicated an interest in this acquisition at this time.

(12) A Statement of the Actions, if Any, the Agency May Take to Remove or Overcome Any Barriers to Competition Before Any Subsequent Acquisition for Supplies or Services Required. The FLETC conducts market research periodically to attempt to locate sources for suitable/equal equipment that will operate with FLETC equipment the government is attempting to resolve the incompatibility issues which will allow full and open competition or at a minimum identify several more models that will work properly with law enforcement equipment.
