Justification and Approval for Other Than Full and Open Competition

This is a Justification and Approval (J&A) document for a non-competitive sole source contract award. The Defense Logistics Agency Weapons Support (DLAWS) at Warren proposes to award a firm-fixed-price contract to Oshkosh Defense LLC (CAGE 75Q65, located in Oshkosh, Wisconsin) for the supply of Transmission, Mechanical components (NSN 2520-01-718-6450, part number 57K02044) used on the M1300 Heavy Equipment Transporter (HET) tractor truck. The contract requires delivery of 8 units as a base quantity with an option for an additional 8 units (maximum quantity of 16 total), with a delivery date of 425 days after receipt of order (DARO).

The justification is based on 10 U.S.C. § 3204(a)(1) and FAR 6.302-1, citing that Oshkosh is the sole responsible source and only approved manufacturer capable of providing the transmission mechanical. Oshkosh owns the proprietary technology, technical data package (TDP), and intellectual property rights for the transmission, which was specifically designed and tested for the M1300 HET. The Government does not possess the technical data or intellectual property rights needed to enable competitive procurement. Market research conducted on February 9, 2026, identified alternative transmission manufacturers (American Axle & Manufacturing, Aisin, Eaton, Paccar, and SAPA) but confirmed that no other source can meet the specific form, fit, and function requirements without an available TDP. Reverse engineering the transmission would be uneconomical, with estimated payback periods of multiple years even assuming 25% cost savings through future competition. The Government contacted Oshkosh on March 20, 2026, requesting purchase of the intellectual property rights, but the contractor declined due to active manufacturing of the item. No prior procurement history exists for this first-time contract action. Solicitation notices required by FAR 5.201 will not be posted based on the urgent sole source exception at FAR 5.202(a)(2).

5. Authority Cited: The statutory authority permitting other than full and open competition for this effort is 10 United States Code (U.S.C.) 3204(a)(1) as implemented by Federal Acquisition Regulation (FAR) 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.

6. Reason for Authority Cited: Oshkosh, the Original Equipment Manufacturer, owns the rights, title, and interest in its proprietary technology and is the only approved source to manufacture the Transmission, Mechanical, part number 57K02044, CAGE 75Q65, for the Government. Oshkosh is the sole owner of the transmission mechanical technical data package (TDP) and as such, they are the only approved source of supply able to manufacture and provide the Transmission, Mechanical for the Army.

a. Background:

• Technical Data Package (TDP) Status: The Government does not have the pertinent technical data or own the necessary intellectual property data rights to the pertinent technical data to enable competitive procurement.

• Technical Justification: The mechanical transmission is critical to vehicle safety and crucial to maintaining high levels of vehicle availability and readiness.

Oshkosh originally developed, tested, and qualified the transmission as part of vehicular testing. The transmission has successfully operated in the field met all mobility requirements. Unlike other commercially produced transmission, mechanical parts, this has been designed specifically for use on M1300 Heavy Equipment Transporter (HET) tractor truck. If the Government were to purchase a transmission, mechanical part that has not undergone extensive verification, mission failures and potential loss of mission critical functions to the vehicle could occur.

• Payback Calculator: Since the Government does not own any of the technical data, the Government would have to reverse engineer (RE) the transmission mechanical.

The Government would not be able to recover, through subsequent competition, the duplication of costs involved in RE the item to create a competitive TDP or qualify additional source(s) within a reasonable time frame. At the current average , a current cost of $ and assuming 25% savings achieved through competition, the $ in annual savings would take years to offset the estimated $ cost of RE the item and validating a competitive TDP or qualifying another source.

End Item: HET M1300

The market research results are limited because the fully defined TDP for the Transmission Assembly on the HET M1300 is not available. The research found the following sites:

https://www.aam.com/what-we-do/our-products/driveline https://www.aisin.com/en/product/mobility/ats-cvts-mts/ https://www.eaton.com/us/en-us/products/transmissions.html https://paccarpowertrain.com/products/#transmissions-hd https://sapatransmission.com/products-and-services/mobility-systems/mobility-systems-for-wheeled-vehicles/

The results of the research show technical information for makers of transmission assemblies: American Axle & Manufacturing, Aisin, Eaton, Paccar and SAPA (Sociedad Anónima Placencia de las Armas). Oshkosh supplies the transmission assembly on the HET M1300. However, there is not fully defined TDP available to properly verify any other offeror would meet the same form, fit, and function. Integrating an unverified transmission assembly on the HET M1300 would likely result in erratic vehicle hesitation or stopping, decreased fuel efficiency and damage of drivetrain components, including engine, drive shaft, differentials and axles.

Erratic vehicle hesitation or stopping and failure of transmission pose undue risks to the vehicle. Drivetrain components are considered critical safety items. Such failures would negatively impact maintenance, readiness, and safety.

The specific technical information for the part that is needed for search criteria is included in the technical data owned by the source of supply. Oshkosh is the source of the transmission assembly and sells the part through authorized distributors. The Government verified with Oshkosh that they are the source for part number 57K02044.

Contacted the contractor to request consideration for the United States Government (USG) to purchase the intellectual property on 20 March 2026. The contractor is not interested in selling the technical data rights/intellectual property at this time due to this item being actively manufactured.
