About this file

This is a Justification and Approval (J&A) document for a sole-source federal contract award SPRDL1-25-R-0227.

The Defense Logistics Agency Weapons Support (DLAWS) at Warren proposes to award a firm-fixed-price contract to Petroleum Analyzer Co L.P. (PAC), a Commercial and Government Entity (CAGE) located in Houston, Texas, for National Stock Number (NSN) 6635-01-717-1501, Cloud Pour Point, using Army Working Capital Funds. The contract will provide PAC Cloud and Pour Point Analyzers (part number 0119-012-001ML / 12686215), with a base quantity of 12 units and a 100% option quantity of 12 units, for a total maximum contract value that is redacted. The analyzer is a laboratory instrument measuring cloud point and pour point of diesel fuel used in the Petroleum Quality Analysis System-Enhanced (PQAS-E), a mobile fuel testing laboratory deployed to ensure fuel quality for aircraft, helicopters, and ground vehicles. The justification for sole-source procurement under 10 U.S.C. § 3204(a)(1) and FAR 6.302-1 (Only One Responsible Source) is based on the lack of a competitive Technical Data Package, the Government's absence of rights to specifications, extensive testing and validation completed by Ground Vehicle Systems Center (GVSC), integration with custom Laboratory Information Management System (LIMS) software requiring specific code for each instrument's unique outputs, custom anti-shock trays developed for PQAS-E deployment, temperature storage requirements (-25 to 140 degrees Fahrenheit), and detailed technical manuals specific to this instrument. Market research identified three alternative cloud and pour point analyzers (Cannon MPC-6, Analytical Automated Mini, and Orbis AirSTAR CPPP), all of which were rejected as technically unsuitable due to sample size requirements, physical space constraints, or operational complexity in the mobile lab environment. A Sources Sought Notice posted to SAM.gov on July 14, 2025, received two vendor responses (Expotech USA, Inc. and Kijero, LLC), both identified as distributors of other brands. The document includes certifications from DEVCOM GVSC, TACOM procurement, and the Contracting Officer (Timothy A. Nichols, DLA Land and Maritime), all signed on dates in December 2025.

Previous J&A: N/A by FAR 5.201 will be posted. Sole Source Notices required by FAR 5.201 will be posted.

b. Subcontracting competition: Unless the contract is awarded to a small business, the solicitation and resulting contract will include FAR clauses 52.219-8, "Utilization of Small Business Concerns"; 52.244-5, "Competition in Subcontracting"; 52.219-16, "Liquidated Damages--Subcontracting Plan", and Defense Federal Acquisition Regulation Supplement 252.219-7003, "Small Business Subcontracting Plan (DoD Contracts)," to maximize small business opportunities and utilization.

8. Actions to Increase Competition: There are no plans to increase competition for future procurements due to the reasons cited above.

9. Market Research: A Sources Sought Notice was posted to SAM.gov on 14 July 2025. and was open for 15 days. Two responses were received from interested vendors. See the paragraph below for details.

The two interested companies were Expotech USA, Inc. (CAGE 1N3K2) and Kijero, LLC. (CAGE 9WH06). Both companies are distributors or resellers of other brands. If these companies provide the specific part number from Petroleum Analyzer Company, there is no reason that they cannot fulfill the requirements.

DEVCOM Engineering completed web-based market research on 18 July 2025, searching for companies that provide compact instruments capable of testing the cloud and pour points of diesel fuel. The following instruments were found searching for "cloud and pour point analyzer":

a. Cannon MPC-6 Automatic Pour/Cloud/Freeze Point Tester – The Cannon instrument does not meet the specific requirements as it requires significantly more samples to run a test, and it also lacks RS-232 capability needed to connect to the PQAS-E LIMS.

b. Analytical Automated Mini Pour/Cloud Point Tester – The Analytical instrument has a form factor that takes up much greater space than the current model in the PQAS-E. Due to the already tight fit of all the instruments on the countertop, this instrument would not fit.

c. Orbis AirSTAR CPPP – The Orbis instrument uses a liquid bath to cool the sample, which adds complexity as well as spilling concerns in a mobile lab environment. The bath would have to be drained and filled each time the lab was moved, which adds time to the process as well as creates a waste stream that is not currently present.

10. Interested Sources: To date additional sources have expressed interest as listed
