The Defense Logistics Agency – Land Warren (DLA-WRN) proposes to award a new firm-fixed-price contract to JLG Industries, Commercial and Government Entity (CAGE) 1YHH8, for the procurement of axle assemblies (NSN 2520-01-439-5441, part number 8040248) used on the All-Terrain Lifter Army System (ATLAS) forklift. The contract involves a base quantity of 19 units with no option quantities, for a total of 19 axle assemblies. The procurement is justified under 10 U.S.C. § 3204(a)(1) and FAR 6.302-1 as a sole-source acquisition because only JLG Industries possesses the unique qualifications required. JLG is the original manufacturer and the only source capable of providing axle assemblies that meet the ATLAS specifications without known performance issues. The Government lacks the necessary technical data and proprietary rights to enable competitive procurement. Reverse engineering and qualifying alternative sources would be prohibitively costly (estimated in the millions of dollars) and time-consuming, with costs that could not be recovered through subsequent competition given the small, variable demand for these assemblies driven by field requirements. A Sources Sought Notice was posted on SAM.gov for 15 days, yielding one response from BHPE LLC, which was directed to the Source Approval Program; internet searches confirmed no viable alternative sources exist for this specific application. The Government will include small business subcontracting requirements unless the contract is awarded to a small business concern. Procurement history shows four prior contracts for these axle assemblies, all awarded on a sole-source basis to either JLG Industries or ASRC Federal Facilities Logistics, LLC, with unit prices ranging from $13,986.07 to $25,993.96. The contract is treated as a commercial product, and no certified cost or pricing data will be required from the contractor.

Previous J&A: SPRDL1-18-R-0161 sources.
There are no known funding efforts in progress at this time to develop the competitive technical data required to make the axle assemblies fully competitive. No contractors are in the process of being qualified at this time, nor will be prior to the contract award due to funding constraints.
8. Market Research: A Sources Sought Notice was posted to SAM.gov on and was open for 15 days. One response was received, with the assessment of the response below:
BHPE LLC (CAGE 9SWS7) responded on 5 February 2025 expressing interest in becoming a source for this requirement. The contract specialist informed BHPE LLC, that they could contact the Competition Management Office to apply to become an additional source through the Source Approval Program (SAP). The contract specialist provided the point of contact for the SAP to the vendor.
The Ground Vehicle Support Center project engineer performed internet searches on 5 February 2025 searching for axle assemblies that could meet the ATLAS specifications.

Findings: The keyword used for this search was the part number featured in this procurement. The result was the actual axle that is approved for the ATLAS application.

Findings: This market search resulted in selection of axle assemblies and related products for off-road applications for sale. There was a variety of makes and models.
These axles are not a candidate for the ATLAS because they are not the correct size and not specified for the ATLAS application.

Findings: This search resulted in a listing of remanufactured JCB axles for sale. These axles are for JCB rough terrain forklifts and not applicable for the Army ATLAS forklift.
