Justification and Approval for Other Than Full and Open Competition

This document is a Justification and Approval (J&A) for a sole-source contract award by the Defense Logistics Agency - Land Warren (DLA-WRN). DLA-WRN proposes to award a firm-fixed-price, Indefinite Delivery Indefinite Quantity (IDIQ), five-year contract to Oshkosh Defense LLC for the provision of Axle Assembly, Automotive, Driving (NSN 2520-01-569-6437, part number 3831541). The contract includes a Guaranteed Minimum Quantity (GMQ) of five units with an estimated five-year maximum quantity of 119 units. The Acquisition Method Code is 3 (acquire for the second or subsequent time directly from the actual manufacturer), and the Acquisition Method Suffix Code is D (data needed to acquire competitively is not physically available). The contracting officer, Leah Bourdeau, determined the anticipated cost to be fair and reasonable based on detailed cost and price analysis, with the contractor not required to submit certified cost or pricing data as the item is classified as a commercial product.

The justification establishes that sole-source procurement is appropriate under 10 U.S.C. 3204(a)(1) because Oshkosh is the only responsible source capable of manufacturing this axle assembly for the M1074A1 and M1075A1 Palletized Loading System vehicles. The Government does not possess rights to the Technical Data Package (TDP) or specifications; Oshkosh possesses proprietary technical data and exclusive manufacturing expertise developed during vehicle design and initial production phases. Market research conducted November 4, 2024, and a Sources Sought Notice posted to SAM.gov on December 17, 2024, yielded no viable alternative sources. Commercial axle manufacturers (Meritor, Rockwell, DANA/Spicer, Hendrickson) were reviewed but do not offer identical form, fit, and function. Reverse engineering to develop competitive specifications would require an estimated minimum of $3,500,000 in development costs and additional lead time, with recovery through competition providing marginal annual savings insufficient to justify the investment within a reasonable timeframe. The contract award was approved by the Competition Advocate on March 14, 2025, subject to availability of funds.

8. Market Research: A Sources Sought Notice was posted to SAM.gov on 17 December 2024 and was open for 15 days.

One response was received from BHPE LLC (CAGE 9SWS7) via email which provided a general overview of its company but did not convey interest in the Source Approval Process. BHPE LLC did not respond to an email requesting further information.

Market research was conducted by the GVSC Heavy Tactical Vehicle Sustainment Team 4 November 2024, to find suitable competition for the Oshkosh axle assembly.

Axles are identified by characteristics such as weight rating and wheel end hardware, as well as interfaces with suspension and wheel/tire assemblies. The materials, dimensions, mounting details, and performance requirements are not available for this assembly. Due to the lack of a TDP or in-depth technical specifications of the sole-source part, the validity of researched axles is difficult to evaluate. Other manufacturers offer similar axles, but the form, fit, and/or function of alternatives are not identical to the sole-source part.

Keywords searched: axle assembly, M984A1 military axle, HEMT axle, heavy truck axle.

Commercial axles offered by Meritor, Rockwell, DANA/Spicer, and Hendrickson were reviewed. There is not enough information to determine if these options will fit on the vehicle and operate in the same manner as the sole-source part. For this assembly, Oshkosh purchases a commercial axle from a supplier but modifies it for military use.

The modification, which involves adding components to increase performance and properly interface with military suspensions, is proprietary to Oshkosh and is not known by the Government.

Additionally, a visual comparison of the axle from the Army technical manual to the researched alternatives was conducted, but none of the commercially available parts appear to be identical in mounting, size, or shape. Due to internal components, even a part that appeared the same externally could vary in performance, capability, or manufacturing.
