About this file

This document is a Justification and Approval (J&A) for Other Than Full and Open Competition for a federal contract action.

The Defense Logistics Agency Warfare-Readiness Network (DLA-WRN) is proposing to award a New Firm-Fixed-Price contract to Data Device Corporation (DDC), a Commercial and Government Entity (CAGE) number 19645, for a Remote Power Control (RPC) unit, National Stock Number 6130-01-575-0929, Part Number 12467273-4, using Army Working Capital Funds. The RPC provides power to four Remote Switch Modules, the Improved Fire Control Unit, and the Auxiliary Hydraulic Pump on the Abrams Family of Vehicles. The contract deliverables consist of a base quantity of 335 units with a 100% option for a total quantity of 670 units. The Acquisition Method Code is "3 - Acquire, for the second or subsequent time, directly from the actual manufacturer," and the Acquisition Method Suffix Code is "B - Acquisition of this part is restricted to source(s) specified on Source Control, Altered Item, or Selected Item drawings/documents." The statutory authority for restricting competition is 10 U.S.C. § 3204(a)(1) under FAR 6.302-1, with the finding that only one responsible source and no other supplies or services will satisfy agency requirements.

The justification cites that DDC possesses unique technical and engineering expertise and proven manufacturing capabilities to produce the RPC, and the Government lacks a complete Technical Data Package (TDP) and does not own proprietary rights to documents necessary to create a competitive TDP. A Sources Sought Notice posted to SAM.gov on November 5, 2024, for 15 days received no responses. Online market research identified similar products from manufacturers including Lowell, Raritan, and Engenius, but none conform to the unique specifications in Product Fabrication Specification document SC-SA15142 or fit the space constraints required within the M1 Abrams. Reverse engineering was identified as the only recourse to increase competition, with estimated costs of $8.99 million and a timeline of 81 months, making it economically prohibitive. The procurement history shows previous contracts with DDC (SPRDL1-19-D-0121 awarded July 19, 2019, valued at $1,131,181.23; SPRDL1-17-C-0295 awarded September 8, 2017, valued at $531,300; and SPRDL1-15-P-0061 awarded December 24, 2014, valued at $79,660). The solicitation will include FAR clauses for Small Business Subcontracting Plans unless awarded to a small business to maximize small business opportunities and utilization.

Previous J&A: SPRDL1-19-F-0438

Defense Federal Acquisition Regulation Supplement (DFARS) 252.219-7003, "Small Business Subcontracting Plan (DoD Contracts)" to maximize small business opportunities and utilization.

7. Actions to Increase Competition: There are no plans to increase competition for future procurements due to the reasons cited above.

8. Market Research: A Sources Sought Notice was posted to SAM.gov on 5 November 2024 and was open for 15 days. No responses were received.

Online market research was performed by Ground Vehicle Support Center (GVSC) Engineering November of 2024, by reviewing vendor catalogs, and searching for product literature published online, in effort to find other manufacturers and/or commercial items or non-developmental items that could meet Government needs or could be modified to meet the Government needs. While similar products are produced by several manufacturers, those items are not designed specifically for the M1 Abrams tank, nor tested to the M1 Abrams' unique requirements to attain qualification, as described in section 5.

Keywords: Remote Power Controller

Website: Lowell https://www.lowellmfg.com/product-category/power-solutions/rpc-remote-power-control/

Website: Raritan https://www.raritan.com/products/power/power-distribution/rack-pdu?utm_campaignID=7012E000000xEta&gad_source=1

Website: Engenius https://www.engeniustech.com/power-distribution-unit-product-line.html?gad_source=1

Findings: While Remote Power Controller products are produced by several manufacturers, they are not designed and tested to supply the suitable subcomponent required for the M1 Abrams. None of the available products conform to the unique specifications per Product Fabrication Specification document SC-SA15142.

Additionally, as the United States Government does not have a complete TDP, it cannot be verified that any commercially available parts will conform to the unique space claim required within the M1 Abrams FOV.

9. Interested Sources: To date no additional sources have expressed interest in this item.
