About this file
This is a Justification and Approval (J&A) for Other Than Full and Open Competition document prepared by the Defense Logistics Agency - Land Warren (DLA-WRN) for contract SPRDL1-25-R-0026. The J&A justifies awarding a sole source contract to CEF Industries LLC (CAGE 00268) for Linear Actuators, part number 13055589, used in the M109 Howitzer Family of Vehicles. The contract covers a base quantity of 62 units with a 100% option quantity of 62 units, totaling 124 units, with the contract value redacted but estimated to be significant.
The justification cites 10 U.S.C. 3204(a)(1) as the authority for sole source procurement, stating that CEF Industries is the only approved manufacturer and the government lacks the technical data package (TDP) necessary for competitive procurement. The document estimates that developing a competitive TDP would cost approximately $2.25 million and take over 51 years to recover through competitive savings. Market research was conducted through a Sources Sought Notice posted on SAM.gov from November 4, 2024, for 30 days, which received one response from All Clear Aerospace & Defense Inc. However, the interested party was advised to contact the Competition Management Office regarding qualification requirements. The J&A includes procurement history showing previous contracts awarded to CEF Industries in 2019 ($243,891) and 2022 ($395,903), both under FAR 6.302-1 sole source authority. The document is signed by various officials including the Contracting Officer and Competition Advocate, with approval for acquisitions between $750,000 and $15 million.

Control Box during power operations, the Latch Assembly unlatches the Rammer Assembly until desired position of the tray assembly is reached. This assembly includes a linear actuator and a spring-loaded latch.
The Government does not have the pertinent technical data to enable competitive re-procurement.
CEF Industries LLC (CAGE 00268) is the sole approved source to manufacture this Linear Actuator 13055589. This vendor has passed the requirements of the Government qualification tests to include performance, reliability, and durability tests.
This contractor has the unique and proven qualities and capabilities, facilities, resources, and manufacturing and development experience, to produce this part. CEF Industries LLC has also demonstrated the unique and proven manufacturing capabilities to establish and maintain the processing control required to repetitively produce this item. The authorized source tested the items in the vehicle to the vehicle specifications.
This linear actuator is part of the Latch Assembly 13055605 used on the M109A7 Self- Propelled Howitzer. The sole source, CEF Industries is the only known source for the identified item to have the proper form, fit, and function for U.S. Government application.
As stated earlier, the Government doesn't have the necessary Technical Data Package (TDP) to allow for competitive procurement of the Linear Actuator 13055589.
Developing a detailed level 3 TDP and qualify a new source of supply would carry a significant amount of risk and that a new vendor would have to develop their own design, and test it to operate at all levels, including testing at the vehicle level.
Competitive procurement is not an option at this time. The table “TDP Development Costs to Qualify a Second Source” below gives the details of the estimated costs associated with pursuing competitive procurement. This estimate is based on Engineering expertise and development cost of similar items.
"TDP Development Costs to Qualify a Second Source":
Task Cost Estimate
a. Engineering design and development $900,000
b. Prototype testing /Analysis of Application Specific Design $500,000
c. Development of Qualification Procedures/Requirements $400,000
d. Logistical Development $250,000
e. System Support Package (SSP) $200,000 Total: $2,250,000
Details:
a) This effort include identify all deficiencies, conduct market research on available similar parts and components, work in conjunction with M109 systems integrator, identify the system’s components and their interrelationships; obtain existing parts; tear down the design to understand it; create representations of the system in another form or a higher

b. Subcontracting competition: Unless the contract is awarded to a small business, the solicitation and resulting contract will include FAR clauses 52.219-8, "Utilization of Small Business Concerns"; 52.244-5, "Competition in Subcontracting"; 52.219-16, "Liquidated Damages--Subcontracting Plan";" and Defense Federal Acquisition Regulation Supplement 252.219-7003, "Small Business Subcontracting Plan (DoD Contracts)," to maximize small business opportunities and utilization.
7. Actions to Increase Competition: There are no plans to increase competition for future procurements due to the reasons cited above.
8. Market Research: A Sources Sought Notice was posted to SAM.gov on 04 November 2024 and was open for 30 days. One response was received and summarized below.
U.S. Army, DEVCOM – Armaments Center Engineer has completed web-based market research on 22 October 2024. A search on NSN-Now website (nsn-now.com/Indexing/PublicSearch.aspx) for part number “13055589” resulted in CEF Industries, LLC (CAGE 00268) being the only listed manufacturer. Ability One website (https://www.abilityone.gov) search for the part number didn’t return any result. To competitively procure these items, the government would have to develop a detailed technical data. This effort is cost prohibitive.
Additional market research found this item is commercial but requires a minor modification not customarily available in the commercial marketplace, made to meet Government requirement.
9. Interested Sources: To date, one additional source has expressed interest as listed above in Section 8.
As a result of the Sources Sought posting on SAM.gov, one response was received from an interested party. The interested party was advised to contact the Competition Management Office for details on how they may become qualified for future procurements, including mandatory testing requirements.
