JUSTIFICATION AND APPROVAL
FOR OTHER THAN FULL AND OPEN COMPETITION
SPRDL1-25-R-0016
1. Contracting Agency: Defense Logistics Agency - Land Warren (DLA-WRN).
2. Description of Action: DLA-WRN proposes awarding a new Firm-Fixed-Price contract to an offeror providing the product of FMC Technologies, Commercial and Government Entity (CAGE) 71454, for National Stock Number (NSN) 4320-01-351- 8586, Pump, Triplex, HP, using Army Working Capital Funds.
3. Description of Supplies/Services: The NSN 4320-01-351-8586, part number 5266613, Pump, Triplex, HP, is used on the 3K Reverse Osmosis Water Purification Unit (ROWPU). The delivery for this contract is for a base quantity of 6 each, with an option quantity of 6 each, making a total quantity of 12 each. The estimated total value of this contract is .

4. Authority Cited: The statutory authority permitting other than full and open competition for this effort is 10 United States Code (U.S.C.) 3204(a)(1) as implemented by Federal Acquisition Regulation (FAR) 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.
5. Reason for Authority Cited: This item is a high pressure, positive displacement, plunger pump that provides the 1,000 pounds per square inch (psi) required to push the pre-treated water through the Reverse Osmosis (RO) membranes at a rate of 101 gallons per minute (GPM) to produce potable drinking water. The pump is made of a corrosion resistant nickel aluminum bronze that is suited for saltwater operations.
The Government does not own the necessary intellectual property data rights to the pertinent technical data to enable competitive procurements.
The Government does not have rights to the Technical Data Package (TDP) or specifications. The Government did not provide funding for preparation of a fully detailed TDP after approval. For these reasons, the item is source controlled. This is the only approved part number when procured from the original equipment manufacturer and approved distributors.
FMC Technologies has developed, tested, and obtained the Government’s approval of this item for application to the 3K GPH ROWPU assemblies at their own cost. The Government provided no funding for this effort. A 2000-hour test would need to be conducted on a new pump to successfully demonstrate the user's reliability requirement at a cost of
The Government would not be able to recover, through subsequent competition, the duplication of costs involved in reverse engineering the item to create a competitive TDP or qualify additional source(s) within a reasonable time frame.

6. Efforts to Obtain Competition:
a. Effective competition: Due to the reasons cited in Section 5 above the Government is not pursuing competition for this item. Additionally, notices required by FAR 5.201 will be posted.
b. Subcontracting competition: Unless the contract is awarded to a small business, the solicitation and resulting contract will include FAR clauses 52.219-8, "Utilization of Small Business Concerns"; 52.244-5, "Competition in Subcontracting"; 52.219-16, "Liquidated Damages--Subcontracting Plan"; and Defense Federal Acquisition Regulation Supplement (DFARS) 252.219-7003, "Small Business Subcontracting Plan (DoD Contracts)," to maximize small business opportunities and utilization.
7. Actions to Increase Competition: There are no plans to increase competition for future procurements due to the reasons cited above.
8. Market Research: A Sources Sought Notice was posted to SAM.gov on 3 February 2025 and was open for 15 days.
Three small business responses were received - one from BHPE LLC (CAGE: 9SWS7), one from Kampi Components (CAGE: 7Z016), and one from Carver Water Technologies (CAGE: 9D8R9). All three firms indicated that they were interested in the upcoming procurement as potential suppliers of new or rebuilt units, but not as manufacturers. Each firm was advised that they will be notified once the solicitation is issued.
U.S. Army Combat Capabilities Development Command Engineering completed web-based market research on 28-29 January 2025, searching for companies that produce triplex plunger pumps. Listed below are the websites with pumps that are potential alternatives to the FMC pump.
Contacted Buckhorn Pumps CAGE (3CCJ4) on 29 January 2025 and received verification from POC Ty Weaver 254-965-2555 Ext 227, that FMC Technologies is still making the part.
