About this file

This is a Justification and Approval (J&A) document for a sole source procurement by the Defense Logistics Agency Land Warren (DLA-WRN).

DLA-WRN is awarding a new firm-fixed-price, five-year Indefinite Delivery Indefinite Quantity (IDIQ) contract to Oshkosh Defense, LLC (CAGE 75Q65) for National Stock Number (NSN) 2520-01-577-8298, a Transfer Transmission Assembly used on the Heavy Equipment Transporter (HET) A1. The contract covers a minimum guaranteed quantity of three units over five years with a maximum quantity of 38 units. Manufacturing is restricted to Oshkosh Defense as a Commercial and Government Entity (CAGE) 75Q65 or an approved source offering the product. Army Working Capital Funds will finance the procurement. The justification cites 10 U.S.C. § 3204(a)(1) under FAR 6.302-1 as the authority for sole source procurement, determining only one responsible source exists capable of providing the validated and tested Transfer Case. The Government does not own the Technical Data Package (TDP) or specifications, and reverse engineering would be uneconomical and time-prohibitive. Oshkosh Defense owns all data rights and possesses the only technical expertise and proper facilities for manufacturing. A Sources Sought Notice posted to SAM.gov on September 6, 2024, received no responses. Procurement history shows three prior awards to Oshkosh Defense: SPRDL1-19-D-0105 ($2,356,976.70, May 2019), SPRDL1-18-C-0215 ($402,721, March 2018), and SPRDL1-13-C-0107 ($312,089, May 2013), all under FAR 6.302-1. The solicitation will include FAR clauses for small business subcontracting opportunities. The approval was granted on the basis that no effective competition can be pursued.

8. Market Research: A Sources Sought Notice was posted to SAM.gov on 6 September 2024 and was open for 15 days. No responses were received.

The market research results are limited because the TDP for the Transfer Case on the HET A1 is not available. The specific technical information needed for search criteria is included in the technical data owned by the source of supply. Per technical manuals and WebFLIS, Oshkosh Defense is the source, and the procurement history indicates that Oshkosh is the supplier. The Government verified with Oshkosh Defense that they are the source for part number 3815354. The research conducted over the internet by the Tactical Vehicle and Watercraft Sustainment System (TVWS) Engineer on 12 March 2024, found the following sites:

https://www.cummins.com/components/drivetrain-systems/transfer-cases https://www.uspowertrain.com/products/category/transfer-case https://www.meritor.com/en/products/transfer-cases/ https://cotta.com/products/transfer-cases/ https://spicerparts.com/parts/transmission/off-highway/transfer-cases

The results of the research show technical information for makers of the Transfer Case:

Cummins, US Powertrain, Meritor, Cotta and Spicer. Oshkosh Defense supplies the transfer case for the HET A1. Drivetrain components are considered

There is not enough technical information available to properly verify other offerors would meet the same form, fit, and function. Integrating an unverified Transfer Case on the HET A1 would likely result in reconfiguration of other subcomponents of the drivetrain, along with to the undercarriage and vehicle.
