About this file

This document is a Justification and Approval (J&A) for a sole source contract awarded by the Defense Logistics Agency Land Warren (DLA-WRN) to Oshkosh Defense, LLC. The procurement involves a new firm-fixed-price, indefinite delivery/indefinite quantity long-term contract for a Centrifugal Pump Unit (NSN 4320-01-563-3339) used on Heavy Expanded Mobility Tactical Trucks (HEMTTs) M978 and A2. The contract includes a guaranteed minimum quantity (GMQ) of 12 units and a maximum quantity of 300 units over a five-year period.

The justification emphasizes that Oshkosh Defense is the only source capable of providing this specialized centrifugal pump, which is custom-designed for the specific vehicle application. Market research confirmed no alternative sources can meet the technical requirements. The contract is being awarded under FAR 6.302-1 (Only One Responsible Source) authority, with a total estimated value of $2 million. This includes costs for reverse engineering, prototype development, testing, and technical documentation. Previous contracts with Oshkosh Defense for similar items were also awarded on a limited source basis, establishing a precedent for this procurement approach.

SPRDL1-24-R-0143 (JA-00824)

Previous J&A: SPRDL1-19-R-0053 includes accelerated life testing, cold and hot environments, salt spray, and maximum load operation.

Costs Reverse Engineering Project Definition: $ 175,000 Understand Design Requirements: $ 125,000 Prototype Development: $ 500,000 Developmental Testing: $ 375,000 Component, Safety, and System Level Testing: $ 325,000 Write TDP, Technical Bulletins, and Provision Parts: $ 200,000 Reliability and Operational Testing: $ 300,000 Total: $2,000,000

The Government would not be able to recover, through subsequent competition, the duplication of cost involved in procuring the data or reverse engineering to increase competition in a reasonable amount of time. At the current average usage rate of units each year, a current unit cost of $ and assuming 25% savings achieved through competition, the $ in annual savings would take over to offset the estimated $2,000,000 cost of reverse engineering the item and developing a competitive TDP.

6. Efforts to Obtain Competition:

a. Effective competition: Due to the reasons cited in Section 5 above, the Government is not pursuing competition for this item.

Sole Source Notices required by FAR 5.201 will be posted.

b. Subcontracting competition: Unless the contract is awarded to a small business, the solicitation and resulting contract will include FAR clauses 52.219-8, "Utilization of Small Business Concerns"; 52.244-5, "Competition in Subcontracting"; 52.219-16, "Liquidated Damages--Subcontracting Plan";" and Defense Federal Acquisition Regulation Supplement (DFARS) 252.219-7003, "Small Business Subcontracting Plan (DoD Contracts)," to maximize small business opportunities and utilization.

7. Actions to Increase Competition: There are no plans to increase competition for future procurements due to the reasons cited above.

8. Market Research: The Contract Specialist posted Sources Sought Notice #2024- SPRDL1-24-R-0143 to SAM.gov on 24 June 2024 and was open for 15 days. No sources have expressed interest.

The GVSC Tactical Vehicle Sustainment Engineer performed market research by reviewing manufacturer websites on 24 Apr 2024 to find suitable competition for the

Banjo, Pentair, and ACE offer a wide range of high-performance centrifugal pumps.

They offer multiple options and configurations, but technical information such as maximum pressure, flow rate, input shaft size and spline spacing, flange type, as well as mounting dimensions are needed to find the appropriate configuration. The engineer obtained the data sheet and reviewed the technical and performance characteristics.

The Government does not have any of the technical information needed to continue further research. As a result of the Market Research, it was concluded that the Government does not have enough detailed information to investigate similar centrifugal pumps for the HEMTT M978 Base and A2. With the system level requirements and design being proprietary, it can be said for certain that this centrifugal pump is custom for the application and cannot be identified as a Commercial Off The Shelf item.

The Contracting Officer made the determination that the Centrifugal Pump Unit is a commercial item based on procurement history. The prior award was made using FAR Part 12 procedures and the award is precedent setting in accordance with DFARS case 2020-D033 and DFARS 212.102(a)(ii)(A).

9. Interested Sources: To date no additional sources have expressed interest in this item.
