About this file
This document is a Justification and Approval (J&A) for other than full and open competition for a firm-fixed-price contract to procure Halon fire extinguishers from Kidde Technologies, Inc., the sole approved source for this specialized equipment.
The Defense Logistics Agency - Land Warren (DLA-WRN) seeks to award a contract for NSN 4210-01-512-7180, seven-pound Halon fire extinguishers used in M992A2 Field Artillery Ammunition Support Vehicles. The requirement is for a base quantity of 281 units with an option for an additional 281 units, totaling 562 units. The contract authority is 10 U.S.C. 3204(a)(1) (Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements). Kidde Technologies Inc. (CAGE 05BU0) is the only source that has developed, tested, and obtained government approval for this fire extinguisher application. The Government does not own the technical data package and lacks proprietary rights to create competitive alternatives. Reverse engineering the critical components is estimated at $1.75 million, with payback requiring over a decade at assumed 10% cost savings. Market research conducted June 2024, including a 45-day Sources Sought notice posted to SAM.gov that generated no responses, confirmed no alternative commercial fire extinguishers meet the required performance specifications. The incumbent contract (SPRDL1-19-C-0151) was awarded April 4, 2019, valued at $1,155,697.32 under FAR 6.302-1(a)(2)(ii)(A). Unless awarded to a small business, the resulting contract will include small business subcontracting plan requirements under FAR 52.219-8, 52.244-5, 52.219-16, and DFARS 252.219-7003.

Reverse Engineering Description Cost (RE) Activities (Millions)
Obtain existing part samples Obtain existing Kidde Halon Fire Bottle for tear $ 0.050 down, analysis and testing to define structural & performance characteristics.
Hardware design, integration, Design & fabricate pressure vessel and pressurized $ 0.750 and fabrication/install gas filling system (generate prototype technical data package and prototypes); choose industry standard chemical agent for fire suppressant; acquire leak detection equipment, perform vehicle fit up.
Verify/validate components and overall system meet $ 0.750 safety, industry, and military performance standards including but not limited to discharge rates leak detection, electrical requirements, and fire detection.
Finalized technical data package including build to $ 0.200 print drawings, update component and system specifications. Generate tech manuals and establish manufacturing processes.
Component and vehicle system testing
Documentation (drawings/E C P / Tech Manuals)
Total RE $ 1.75
The Government would not be able to recover, through subsequent competition, the additional costs involved in procuring the proprietary data or reverse engineering to create a competitive package in a reasonable amount of time. At the current at the current unit cost of and assuming a 10% savings achieved through competition, the annual savings would take over years to offset the estimated $1.75M cost of reverse engineering the item and qualifying another source.
Efforts to Obtain Competition:
Effective competition: Due to the reasons cited in ection 5 above, the Government is not pursuing competition for this item. The Government is limiting the competition to the source cited in Section 2 above. SOLE SOURCE: Notices required by FAR 5.201 will be posted.
Subcontracting competition: Unless the contract is awarded to a small business, the solicitation and resulting contract will include FAR clauses 52.219-8, "Utilization of Small Business Concerns"; 52.244-5, "Competition in Subcontracting"; 52.219-16, "Liquidated Damages--Subcontracting Plan";" and Defense Federal Acquisition Regulation Supplement (DFARS) 252.219-7003, "Small Business Subcontracting Plan (DoD Contracts)," to maximize small business opportunities and utilization.
7. Actions to Increase Competition: There are no plans to increase competition for future procurements due to the reasons cited above.
8. Market Research: A Sources Sought Notice was posted to SAM.gov on 28 May 2024 and was open for 45 days. There were no responses.
On 02 June 2024, Ground Vehicle System Center (GVSC) Engineering completed web-based market research for online product literature to determine if commercially available fire extinguishers would meet the Government’s needs. The following websites provided information on fire extinguishers but neither product met the required performance necessary for the aforementioned Government vehicles. The following keywords were used in the internet search: Halon Fire Extinguishers; Automatic Fire Extinguishing System (AFES), Halon 1301.
Below, in tabulated form, are the search results obtained via their respective websites or through information requests.
Contractor Website Findings Brooks Equipment https://www.brooksequipment.com Reviewed product catalog. They distribute
Fireboy Extinguishing Systems which do not meet our performance requirements.
Control Fire Systems https://www.controlfiresystems.com During review, discovered they provide the suppression agent in bulk to vendors.
Kidde Technologies is one of their vendors.
Fike Corporation https://www.fike.com/fire-protection/ Requested information via website. Models solutions/chemical-agents were not listed on website. Vendor requires vehicle design/interface information to consider inquiry for fire extinguisher. In addition, vendor was not aware of any two part extinguishing agents. Discontinued investigation due to vendor’s requirements and vendor’s unfamiliarity with this type of fire extinguisher.
Contractor Website Findings (continued) Fire Trace https://www.firetrace.com
Marotta https://marotta.com
Information request was submitted to see if they have a lb Fire Extinguisher for a vehicle crew compartment. Response to the request resulted in discovering vendor did not carry off the shelf models that would meet the M992A2 application.
Requested information via website.
Reviewed products online and they provide parts but not a whole Automatic Fire Extinguishing System (AFES).
Also, if a viable source were found that met the requirements of the fire extinguisher, extensive testing, to include component and full vehicle testing, would need to be conducted in order to validate the performance. In addition, the vehicles would need to be retrofitted to allow for integration of a new fire bottle package.
The current fire extinguisher is a non-commercial product and has been developed, tested and obtained Government approval as stated in ection 5 above. Kidde Technologies has been contacted and is not willing to sell their technical data.
9. Interested Sources: To date no additional sources have expressed interest as listed above in Section 8.
