SPRDL1-24-R-0024

1. Contracting Agency: Defense Logistics Agency - Land Warren (DLA-WRN).

2. Description of Action: DLA-WRN proposes to award a new Firm-Fixed-Price contract to SCI Technology, Commercial and Government Entity (CAGE) 2J622, for National Stock Number (NSN) 1290-01-676-9866, Turret Drive Control Unit II (TDCU-II) Assembly, using Army Working Capital Funds.

3. Description of Supplies/Services: The NSN 1290-01-676-9866, part number (P/N) 13007370-1, TDCU-II Assembly is used on the Bradley Fighting Vehicle System (BFVS). The deliverables for this contract are for a base quantity of 217 each, with an option quantity of 217 each, making a total quantity of 434 each. The total maximum value of this contract is $

The TDCU-II NSN 1290-01-676-9866 is the centerpiece of the Turret Drive System (TDS). It is the main Line Replacement Unit (LRU) to control the TDS in the Bradley A3 Variants (BFVS).

100. Suitable technical data, Government data rights, or manufacturing knowledge are not available to permit acquisition from other sources, nor qualification testing of another part, nor use of a second source part in the intended application. Although, by DoD- STD-100 definition, altered and selected items shall have an adequate Technical Data Package (TDP), data review discloses that required data or data rights are not in Government possession and cannot be economically obtained. If one source is available, AMCs 3, 4, or 5 are valid. If at least two sources exist, AMCs 1 or 2 are valid.

4. Authority Cited: The statutory authority permitting other than full and open competition for this effort is 10 United States Code (U.S.C.) 3204(a)(1) as implemented by the Federal Acquisition Regulation (FAR) 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.

5. Reason for Authority Cited: BAE Systems is the owner of the Source Control Drawing for the TDCU-II Assembly. BAE contracts the making and assembly of this item to SCI Technology. SCI Technology is the only entity capable of meeting the Governments requirements without resulting in an unacceptable delay. SCI Technology P/N 13007370-1 was designed to meet the standards/specifications of DOD-STD- 00100D (AR). SCI Technology is an approved source that meets the standards/ specifications.

The Government does not have the pertinent technical data or the rights to the TDP and specifications to enable competitive re-procurement. The Government does not own the necessary intellectual property data rights to the pertinent technical data to enable competitive re-procurement. The reverse engineering effort by BAE referenced in the previous J&A for SPRDL1-20-R-0081 was not fully successful, and due to testing failures and the expiration of funds, the technical data to qualify additional sources was never accomplished.

SCI Technology is a source that has manufactured the TDCU-II Assembly. SCI Technologies has the requisite manufacturing facilities for component sourcing, tooling, trained personnel, technical information and acquired expertise to produce this item.

SCI Technology has demonstrated the ability to successfully produce and deliver the TDCU-II Assembly to meet United States Government (USG) requirements. Failure to use SCI Technology to produce the TDCU-II Assembly could have unacceptable performance risk.

The time required to increase competition through reverse engineering for this item creates an unacceptable delay.

6. Efforts to Obtain Competition:

a. Effective competition: Due to the reasons cited in section 5 above, the Government is not pursuing competition for this item. Notices required by FAR

5.201 will be posted.

b. Subcontracting competition: Unless the contract is awarded to a small business, the solicitation and resulting contract will include FAR clauses 52.219-8, "Utilization of Small Business Concerns"; 52.244-5, "Competition in Subcontracting"; 52.219-16, "Liquidated Damages--Subcontracting Plan";" and Defense Federal Acquisition Regulation Supplement (DFARS) 252.219-7003, "Small Business Subcontracting Plan (DoD Contracts)," to maximize small business opportunities and utilization.

7. Actions to Increase Competition: There are no plans to increase competition for future procurements due to the reasons cited above.

8. Market Research: A Sources Sought Notice was posted to SAM.gov on 2 November 2023 and was open for 30 days. No responses were received.

The U.S. Army, Combat Capabilities Development Command – Armaments Center, Rock Island conducted Market Research on 26 September 2023. An online search using google.com was conducted for the words “Turret Drive Control Unit II Assembly” “Bradley Fighting Vehicle” and “NSN 1290-01-676-9866”. After no success, i2Log was used to look up original CAGE codes and past procurement history, coming across SCI Technology as the original source. SCI Technologies was contacted and Robert Cox confirmed that SCI Technology still produces the TDCU-II Assembly.

9. Interested Sources: To date no additional sources have expressed interest in this item.
