JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN COMPETITION

SPRLD1-23-R-0003

1. Contracting Agency: Defense Logistics Agency - DLA Land Warren (DLA-WRN).

2. Description of Action: DLA-WRN proposes to award a new Firm-Fixed-Price contract to Ensign Power Systems, Commercial and Government Entity (CAGE) 05ZM0, for National Stock Number (NSN) 6150-01-699-8560, Electrical Distributing System, using Army Working Capital Funds (AWCF).

3. Description of Supplies/Services: The Electrical Distributing System, NSN 6150- 01-699-8560, part number 9133-01, is used on the Armored Multi-Purpose Vehicle (AMPV) Mission Command Variant and is the 3-Phase controller that connects to the external slave receptacle, allowing a connection between shore sources/generators and the vehicle. The deliverable for this contract is for a base quantity of 14 each, with no option quantity. The total estimated value of this contract is $ .

4 - Acquire, for the first time, directly from the actual manufacturer.

Acquisition Method Suffix Code (AMSC):

R - The Government does not own the data or the rights to the data needed to purchase this part from additional sources. It has been determined to be uneconomical to buy the data or rights to the data. It is uneconomical to reverse engineer the part. This code is used when the Government did not initially purchase the data and/or rights. If only one source has the rights or data to manufacture this item, AMCs 3, 4, or 5 are valid. If two or more sources have the rights or data to manufacture this item, AMCs 1 or 2 are valid.

4. Authority Cited: The statutory authority permitting other than full and open competition for this effort is 10 United States Code (U.S.C.) 3204(a)(1) as implemented by the Federal Acquisition Regulation (FAR) 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.

5. Reason for Authority Cited: The Electrical Distribtuting System is a 3-Phase controller, and can work as a voltage regulator. A 3-Phase controller works by having small high speed switches which turn on and off thousands of times a second with each switch decreasing in voltage. This is to create a stair-step voltage wave which is a way to have Direct current (DC) voltage emulate the curve of an Alternating Current (AC) wave. A voltage regulator ensures that the electronics in the vehicles' system are not overcharged and the alternator is not stressed. This Electrical Distributing System is used as a electronic power converter for the Mission Command Variant of the AMPV.

The Government does not have the pertinent technical data to enable competitive re-procurement. The Government does not own rights to the necessary intellectual property to enable developmet of a TDP.

Ensign Power is the only current source for the Electrical Distributing. The United States Government (USG) does not own the Technical Data Package (TDP) for 9133-03.

Ensign Power is the sole owner of their technical data. The Government does not have proprietary rights to the data that would be required to produce a competitive TDP. The above identified supplier has developed this item for application in the AMPV at their own cost. The Government did not fund their efforts in developing and testing this item.

Only Ensign Power has the capability to manufacture the 3-Phase controller Assembly, perform failure analysis, develop inspection and acceptance criteria for components, and repair/rebuild and test the Assembly. Installing hardware that has not undergone similar verifications could lead to a failure of the Unit under battlefield conditions and could damage the vehicle, compromise the mission, and endanger the life of the crew.

Due to the limited performance and technical data available on the Electrical Distributing System, Reverse Engineering (RE) is the only recourse the Government could entertain to increase competition through development of a competitive TDP. A significant amount of time and money would be necessary to Reverse Engineer, procure and test prototypes, and release the design. The nature of this hardware requires significant qualification testing and system level testing. To reverse engineer, validate the design, procure prototypes for testing, perform testing, and release a competitive data package would entail a significant amount of time, facility resources, labor-hours, and funding. To complete the RE process successfully, the Government would have to obtain a sufficient sample size of existing parts to provide a 95% probability and 90% confidence level in the actual size and performance of the existing item to be studied. Once a large enough sample has been collected, the Government would then tear down and understand the design, develop a new design, conduct prototype development, perform component level testing, perform system level testing, perform Reliability Availability Maintainability (RAM) testing, and then produce the final TDP. Required funding would include $700k to obtain existing part samples, $187.5k to reverse engineer and fabricate prototypes, $2,757K for testing (which includes Electromagnetic Interference testing [$977,186], component testing [$500K], and Reliability Availability Maintainability testing of one vehicle for 5000 miles [$1,280K]) and $750k for Technical data package (TDP) creation. The total cost of the RE effort would be $5,587,766 M.
