FOR OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Agency: Defense Logistics Agency - DLA Land Warren.

2. Description of Action: The proposed action is to award a contract to Mettler Toledo, LLC, (CAGE: 12021) for Titrators, National Stock Number 6630-01-564-5504.

The Titrator is used on the Petroleum Quality Analysis System - Enhanced (PQAS-E) for testing the Total Acid Number (TAN) of jet and diesel fuels.

Type of action: This will be for a new contract.

Contract Type: The action will be issued as a Firm Fixed Price (FFP) Indefinite Delivery Indefinite Quantity (IDIQ), Five-Year Long-Term Contract using Army Working Capital Funds (AWCF)

3. Description of Supplies/Services:

The Titrator is a piece of laboratory equipment used in the PQAS-E for testing the TAN of jet and diesel fuels. This test is required by MIL-STD-3004 for quality assurance to ensure that the fuel meets all specifications before use.

The deliverables for this contract are as follows:

Acquisition Method Suffix Code (AMSC):

R - The Government does not own the data or the rights to the data needed to purchase this part from additional sources. It has been determined to be uneconomical to buy the data or rights to the data. It is uneconomical to reverse engineer the part.

This code is used when the Government did not initially purchase the data and/or rights. If only one source has the rights or data to manufacture this item, AMCs 3, 4, or 5 are valid. If two or more sources have the rights or data to manufacture this item, AMCs 1 or 2 are valid.

4. Authority Cited: The statutory authority permitting other than full and open competition for this effort is: 10 United States Code (U.S.C.) 2304(c)(1) as implemented by Federal Acquisition Regulation (FAR) 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Reason for Authority Cited: The Titrator is a laboratory instrument for testing the TAN jet fuels. This particular instrument is unique in its physical size which allows it to be mounted on the counter of the PQAS-E. It also integrates directly with the balance in the PQAS-E which allows weights to be automatically transferred into the Titrator during testing. The test is fully automated using a proprietary method that was developed in conjunction by Ground Vehicle Systems Center (GVSC) and Mettler Toledo. Procurement by other than full and open competition is necessary because the Titrator is needed to insure standardization of equipment, test procedures, training, spare parts, and manuals with the PQAS-E.

The Government does not have rights to the Technical Data Package (TDP) or specifications.

The Titrator was extensively tested by TARDEC (GVSC in their labs for reliability, accuracy, and precision as well as completing Production Verification Testing in the PQAS-E prototype before being chosen for use in the PQAS-E. Due to the unique environments for laboratory equipment (cold storage, hot storage, high humidity, and high vibration) the PQAS-E will be operated in, the ruggedness of the instrument is vital for it to be reliable in the field. To help achieve this reliability, special anti-shock trays were developed for each instrument in the PQAS-E to help mitigate the effects of shock and vibration from the movement of the PQAS-E whether mounted on its trailer or on a Palletized Load System (PLS). If a different model instrument was chosen, new trays would have to be designed, manufactured, and tested to ensure suitability for use in PQAS-E and the instrument itself would also have to be tested to verify it can withstand the shock and vibration that is caused from the PQAS-E traveling over unimproved roads and rough terrain. Additionally, the storage temperature requirements of the PQAS-E dictate that the instruments used in it have to be able to be stored at -25 degrees Fahrenheit (F) and up to 140 degrees F. Laboratory instruments do not normally see temperature extremes such as these. A new instrument would also have to be tested to verify that it can withstand these storage temperatures as well as perform as expected after being warmed up or cooled down quickly. Due to the small size of the Titrator, maximization of counter space is available to house more

6. Efforts to Obtain Competition:

a. Effective competition efforts:

Due to the reasons cited in Section 5 above, sole source procurement is the only possible method for procurement for this item.

SOLE SOURCE: Notices required by FAR 5.201 will be posted.

b. Subcontracting Competition: Unless the contract is awarded to a small business, the solicitation and resulting contract will include FAR clauses 52.219-8, "Utilization of Small Business Concerns"; 52.244-5, "Competition in Subcontracting"; 52.219-16, "Liquidated Damages--Subcontracting Plan";" and Defense Federal Acquisition Regulation Supplement (DFARS) 252.219-7003, "Small Business Subcontracting Plan (DoD Contracts)," to maximize small business opportunities and utilization.

7. Actions to Increase Competition: There are no plans to increase competition for future procurements due to the reasons cited above. There are no contractors currently in the process of being qualified as an alternate source of supply for this item.

At this time, there are no current or planned efforts to qualify additional sources due to the fact that the Government does not possess a full-defined and validated TDP for this item.

Additional Market Research efforts:

The PQAS-E Systems Engineer, on the Petroleum and Storage Distribution Team, conducted web searches on 23 June 2020 for suitable titrators that would satisfy the form, fit, and function of the titrator currently used in the PQAS-E. Search criteria included titrator, automatic titrator, total acid number, and ASTM (American Society for Testing and Materials) International D3242.

Internet searches were performed as described below:

Findings: The three instruments that were found in the web searches are not suitable substitutes for the titrator in question. All of the instruments would require new mounting provisions, new technical manual work packages, new LIMS software, and new spare parts to be incorporated into the PQAS-E. Furthermore, a new instrument would have to be tested for accuracy and robustness, as all the PQAS-E instruments have been, to ensure it is up to the standards needed for a mobile laboratory environment.

9. Interested Sources: To date no additional sources have expressed interest in this item.

10. Other Facts: Procurement History:

Purchase Order, W56HZV-19-P-0100, was awarded on 21 May 2019 to Mettler-Toledo for the procurement of three each of the Titrator. The total contract value was $82,202.82. The solicitation was solicited as Other Than Full and Open Competition Not Previously Addressed.

Purchase Order, SPRDL1-19-P-0223, was awarded on 15 May 2019 to GFS Supply & Services Company for the procurement of five each of the Titrators. The total contract value was $144,995.00. The solicitation was solicited as a 100% Small Business Set Aside.

Purchase Order, SPRDL1-19-P-0060, was awarded on 21 November 2018 to GFS Supply & Services for the procurement of two each of the Titrators. The total contract value was $56,198.00. The solicitation was solicited as Other Than Full and Open Competition Not Previously Addressed.

Purchase Order, SPRDL1-17-P-0311, was awarded on 10 May 2017 to Mettler-Toledo for the procurement of three each of the Titrators. The total contract value was $90,314.70. The solicitation was solicited as Other Than Full and Open Competition Not Previously Addressed.
