About this file
This is a Justification and Approval (J&A) document for other than full and open competition for a sole-source procurement.
The Defense Logistics Agency Weapons Support (DLAWS) Warren, contracting on behalf of the Integrated Logistics Support Center (ILSC) Detroit Arsenal, proposes to award a firm-fixed-price contract to Meritor Industrial Products, LLC (CAGE 3D6E9) for National Stock Number 3010-01-570-7426, a Carrier Gear Assembly (Meritor part number 320001045A01168). The component is an axle differential assembly used on M1074A1 and M1075A1 military vehicles, designed to transfer engine power to wheels while allowing differential rotation. The procurement includes a base quantity of 7 units with an option for 7 additional units, totaling 14 units. The contract will be funded through Army Working Capital Funds using Acquisition Method Code 3 (subsequent direct purchase from manufacturer) with Acquisition Method Suffix Code R (proprietary technical data).
The justification cites 10 U.S.C. § 3204(a)(1) under FAR 6.302-1 (Only One Responsible Source) as authority for sole-source procurement. The Government lacks ownership of the Technical Data Package (TDP) or specifications, making it uneconomical to reverse-engineer or purchase data rights to qualify alternative sources. Oshkosh and Meritor possess exclusive technical expertise for manufacturing this assembly; developmental and operational testing validated Meritor's capability to meet reliability and maintainability requirements. Market research via SAM.gov Sources Sought Notice (posted January 28, 2026 for 15 days) and internet searches for commercial alternatives yielded no viable competition. Prior procurement history shows five previous contracts ranging from approximately $13,287 to $15,684. The solicitation will include FAR clauses for small business utilization and subcontracting competition. No plans exist for increasing competition in future procurements due to the proprietary nature of the item.
