Justification and Approval for Other Than Full and Open Competition

This is a Justification and Approval (J&A) document for a sole-source procurement of fuel injector assemblies for military equipment.

The Defense Logistics Agency Weapons Support (DLAWS) at Warren is awarding a new firm-fixed-price contract to Renk America LLC., a commercial and government entity (CAGE 02978) located in Muskegon, Michigan, for NSN 2910-01-439-9834 fuel injector assemblies. The contract covers a base quantity of 90 units with an option quantity of 90 units (100% option) for a total of 180 units. These fuel injectors are components of the M88A2 HERCULES internal combustion engine. The procurement is funded using Army Working Capital Funds, with a base period of performance of 480 days after receipt of order (DARO) and an option period available under FAR 52.217-6.

The justification for sole-source procurement under 10 U.S.C. 3204(a)(1) and FAR 6.302-1 is based on Renk America LLC being the only responsible source capable of meeting requirements. The fuel injectors are uniquely designed for the AVDS-1790 8CR diesel engine and have received U.S. government approval and NATO Laboratory Test certification (AEP-5). No competitive Technical Data Package exists for the injectors; developing one would require estimated costs and significant time delays for reverse engineering, prototype testing, and validation. Alternative suppliers identified during market research (Bosch, Interstate-McBee) lack specific tailoring for the AVDS-1790 system and have not completed necessary qualification testing. The document notes that no other sources, including GSA schedules, UNICOR, Ability One, or government inventories, have suitable alternatives available.

. These fuel injectors are specifically designed to provide sufficient, high-pressure fuel to the these fuel injectors are unique to this application. Renk America LLC. has developed, tested, and received U.S. government approval for this item for use in the M88A2 HERCULES.

Furthermore, the approved source’s item has met the North Atlantic Treaty Organization (NATO) requirement for successful completion of Allied Engineering Publication (AEP)- 5, NATO Laboratory Test for Gas Turbine and Diesel Engines, while operating on an AVDS-1790-8CR diesel engine.

Should an alternative source of supply be identified, qualification testing will be required.

Currently, the fuel injectors are purchased using the manufacturer’s part number because a competitive Technical Data Package (TDP) for the fuel injectors is not available for use by the Government procurement activity. There are no current plans to acquire a competitive TDP, owing to a lack of funding necessary to obtain and validate the data required to support a competitive acquisition. Developing a competitive package would necessitate significant time and financial investment to reverse-engineer the component, procure and test prototypes, and release a validated design. The estimated cost to develop a competitive package through reverse engineering could reach , with an estimated delay of at least to encompass prototype

Finally, since neither of these sources have produced this specific item for the M88, they have not completed the necessary testing to become a qualified source.
